Justice S.S.SATHEESACHANDRAN\n\n Dated :31\/05\/2010\n\n O R D E R\n       THOTTATHIL B.RADHAKRISHNAN\n        &amp; S.S.SATHEESACHANDRAN, JJ.\n       ---------------------------------------\n              W.P.(C).No.18701 of 2007\n       ---------------------------------------\n      Dated this the 31st day of May, 2010\n\n                    JUDGMENT\n<\/pre>\n<p>THOTTATHIL B.RADHAKRISHNAN, J.<\/p>\n<p>         The Union Territory of Lakshadweep<\/p>\n<p>has prescribed &#8220;B.Sc. Degree having Zoology and<\/p>\n<p>Chemistry as main subjects&#8221; and an additional<\/p>\n<p>qualification as an equivalent qualification<\/p>\n<p>for  the  purpose     of   being    considered    for<\/p>\n<p>appointment  to   the    category     of   &#8216;Fisheries<\/p>\n<p>Teacher&#8217;  in    its     service.     It    issued   a<\/p>\n<p>notification    inviting       applications.      The<\/p>\n<p>respondents,   who   possess     B.Sc.    Degree   in<\/p>\n<p>Zoology from the University of Calicut, filed<\/p>\n<p>the original application contending that they<\/p>\n<p>possess B.Sc. Degree with Zoology as the main<\/p>\n<p>subjects,  yet    they     are    entitled    to   be<\/p>\n<p>considered.\n<\/p>\n<p>         2.   Before the Tribunal they pressed<\/p>\n<p>into  service   the    finality     of   an   earlier<\/p>\n<p>judgment   of     the     Tribunal       issued    in<\/p>\n<p>W.P.(C).No.18701 of 2007<\/p>\n<p>                        :: 2 ::\n<\/p>\n<p>\nO.A.No.385\/03. The Tribunal, agreeing with its<\/p>\n<p>earlier order and the views expressed therein,<\/p>\n<p>directed the establishment to consider the<\/p>\n<p>applicants also by relaxing the qualification.<\/p>\n<p>         3.   Having heard learned counsel on<\/p>\n<p>both sides, we do not deem it necessary to go<\/p>\n<p>into any of the issues arising for decision, as<\/p>\n<p>to the correctness of the impugned order of the<\/p>\n<p>Tribunal, including as to whether it has been<\/p>\n<p>issued in excess of jurisdiction or whether the<\/p>\n<p>prescription of qualification is sustainable.<\/p>\n<p>This is because the establishment has reported<\/p>\n<p>that all the candidates, who appeared for the<\/p>\n<p>competitive   test     following   notification,<\/p>\n<p>including the applicants, failed. Not only<\/p>\n<p>that,   with   the     passage   of time,   the<\/p>\n<p>establishment has amended the recruitment rule.<\/p>\n<p>With these two facts situation, there can be a<\/p>\n<p>recruitment only on a notification being issued<\/p>\n<p>in terms of the amended recruitment rules.
