S.J. MUKHOPADHAYA)<\/p>\n<p>\tThis<br \/>\nappeal has been preferred by Mr Amrish M Upadhyay, Joint Charity<br \/>\nCommissioner, Rajkot Region, Rajkot against the observations made by<br \/>\nthe learned Single Judge by order dated 21.2.2011 in Special Civil<br \/>\nApplication No. 7756 of 2010.  At para 5 therein, the following<br \/>\nobservations have been made :-\n<\/p>\n<p>5.\tThis<br \/>\nCourt deems it proper to put on record that, &#8216;the officer was full of<br \/>\narrogance, showing no respect to the Court, showing no repentance for<br \/>\nhis conduct about which the Court was required to make the<br \/>\nobservations in its earlier order and also on reading this affidavit.<br \/>\n This is for the consumption of the appointing\/ disciplinary<br \/>\nauthority of this officer.\n<\/p>\n<p>The<br \/>\nofficer of this rank, who is dealing with the public in discharge of<br \/>\nhis duty everyday is conveying an impression about &#8216;the judicial<br \/>\nsystem&#8217; in the State. Therefore, this Court is of the opinion that<br \/>\nsuch an officer is not fit to be continued in office.  This Court<br \/>\ndeems it necessary to direct the Registry to send a copy of the (i)<br \/>\nimpugned order,  a copy of (ii) Exhibit 12, which is the list of<br \/>\ndocuments produced with that, a copy of (iii) document at serial<br \/>\nno.43 (trust deed dated 11th May 1948),  a copy of (iv)<br \/>\nthe order of this Court dated 18th January 2011,  (v) this<br \/>\norder, to the disciplinary authority\/ appointing authority of the<br \/>\nofficer for taking appropriate note of the same and to initiate<br \/>\ndepartmental proceedings, if deemed fit.  It is expected that the<br \/>\ndisciplinary authority will consider whether such an officer is<br \/>\nrequired to be continued in office or is required to be kept out of<br \/>\noffice by passing an appropriate order of suspending him with<br \/>\nimmediate effect, so that he does not damage the image of the<br \/>\njudiciary, any further.\n<\/p>\n<p>2.\tThe learned<br \/>\ncounsel appearing on behalf of the appellant would submit that the<br \/>\nappellant is not challenging the validity of the decision of the<br \/>\nCourt made by order dated 21.2.2011 passed in the writ petition as<br \/>\nwas preferred by Shree Saurashtra Gandhiji Gramodhar Trust &amp; 4<br \/>\nothers.  The appellant only prays to delete the portion of the<br \/>\nobservations as made at para 5 against the appellant, who was not a<br \/>\nparty in person.\n<\/p>\n<p>3.\tOn 3.2.2011,<br \/>\nwhile notices were issued on the respondents, this Court allowed the<br \/>\nappellant to file an affidavit taking unconditional apology.<br \/>\nThereafter, the appellant has filed an affidavit, para 4 of which<br \/>\nreads as follows :-\n<\/p>\n<p>&#8220;4.\tI<br \/>\nsay that I have tendered my apology unconditionally before the ld.<br \/>\nSingle Judge.  I have a very high regard for this Hon&#8217;ble Court and<br \/>\nbeing an employee of the State Government, I cannot try to undermine<br \/>\nthe majesty of law and of this Hon&#8217;ble Court.  I have no slightest<br \/>\nidea of showing any disrespect to this Hon&#8217;ble Court.  I again tender<br \/>\nmy unconditional apology with my folded hands to this  Hon&#8217;ble Court.<br \/>\n I have never shown my arrogance to this Hon&#8217;ble Court and if<br \/>\nanswering my question to the Hon&#8217;ble Court, if the Hon&#8217;ble Court felt<br \/>\nthat I ought not to have answered the same, I again tender my<br \/>\nunconditional apology for the same.  Before joining the service, I<br \/>\nhave worked in this Hon&#8217;ble Court and I keep high esteem for this<br \/>\nHon&#8217;ble Court and at no point of time, I have ever tried to show any<br \/>\ndisrespect majesty of this Hon&#8217;ble Court.  I tender my unconditional<br \/>\napology to this Hon&#8217;ble Court with all my sincere feeling and all<br \/>\nhumanity at my command and I earnestly request this Hon&#8217;ble Court to<br \/>\naccept the same.&#8221;\n<\/p>\n<p>4.\tMr Amrish<br \/>\nUpadhyay, Joint Charity Commissioner, now posted at Ahmedabad,<br \/>\nappeared in person and asked for unconditional unqualified apology.<br \/>\nThe learned counsel appearing on behalf of the respondent submitted<br \/>\nthat he has no objection if the observations are deleted, but<br \/>\nsubmitted that the officer should be more cautious while filing<br \/>\naffidavit before a Court.\n<\/p>\n<p>5.\tHaving heard<br \/>\nthe learned counsel for the parties and taking into consideration the<br \/>\nfact that Mr Amrish Upadhyay has appeared in person and sought for<br \/>\nunconditional apology and has stated that he will not make such<br \/>\nmistake in future, we accept the apology and delete the observations<br \/>\nmade against the officer at para 5 of the order dated 21.2.2011, as<br \/>\nquoted above.  The substantive portion of the order dated 21.1.2011<br \/>\npassed in Special Civil Application No. 7756 of 2011 by the learned<br \/>\nSingle Judge is not altered.  It will be binding between the parties.\n<\/p>\n<p>6.\tThe appeal<br \/>\nand the Civil Application both stands disposed of.\n<\/p>\n<p>\t\t\t\t\t\t[S.
