No.38979 of 2010\n          LALMOHAR RAI son of Late Jagdhari Rai,\n          Resident of village-Sherpur, P.S.-Maner,\n          District-Patna.\n                              Versus\n                          STATE OF BIHAR\n                             -----------\n<\/pre>\n<p>2   19.11.2010            Heard       learned      counsel       appearing       on<\/p>\n<p>                 behalf     of     the    petitioner       and     the    learned<\/p>\n<p>                 counsel appearing on behalf of the State.<\/p>\n<p>                          Petitioner is in custody in connection<\/p>\n<p>                 with Sessions Trial No. 241 of 1985 arising<\/p>\n<p>                 out of Maner P.S. Case No. 194 of 1983 for the<\/p>\n<p>                 offence punishable under Sections 341,324 and<\/p>\n<p>                 307 of the Indian Penal Code.\n<\/p>\n<p>                         This is a case of misuse of privilege of<\/p>\n<p>                 bail.\n<\/p>\n<p>                         The petitioner was earlier granted bail<\/p>\n<p>                 by the Court below on 6.4.1985. On account of<\/p>\n<p>                 absence    of     proper    pairvi    his    bail       bond   was<\/p>\n<p>                 cancelled       on   23.4.1991     and    subsequently         the<\/p>\n<p>                 petitioner was arrested on 29.5.2010.<\/p>\n<p>                          Learned        counsel     for     the     petitioner<\/p>\n<p>                 submits that the petitioner would abide by the<\/p>\n<p>                 terms and conditions set out by this Court for<\/p>\n<p>                 consideration of his prayer for bail.<\/p>\n<p>                          Taking          into       consideration              the<\/p>\n<p>                 circumstances and considering the submissions<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>          of the learned counsel, let the petitioner,<\/p>\n<p>          Lalmohar      Rai,        be     released       on    bail    on<\/p>\n<p>          furnishing      bail       bonds     of    Rs.10,000\/-       (ten<\/p>\n<p>          thousand) with two sureties of the like amount<\/p>\n<p>          each   to    the    satisfaction          of   the   Additional<\/p>\n<p>          Sessions Judge 1st Danapur, District-Patna in<\/p>\n<p>          connection with Sessions Trial No. 241 of 1985<\/p>\n<p>          arising out of Maner P.S Case No. 194 of 1983<\/p>\n<p>          subject to the condition that the petitioner<\/p>\n<p>          would personally be present before the trial<\/p>\n<p>          Court on each and very date fixed in the trial<\/p>\n<p>          and the failure on the part of the petitioner<\/p>\n<p>          to remain present before the trial Court on<\/p>\n<p>          two consecutive dates fixed without reasonable<\/p>\n<p>          explanation to the satisfaction of the Court<\/p>\n<p>          below,      would       confer     liberty     on    the   Court<\/p>\n<p>          concerned          to      initiate        proceeding        for<\/p>\n<p>          cancellation of his bail bonds and to take him<\/p>\n<p>          into custody.\n<\/p>\n<\/p>\n<p>                                           (Jyoti Saran, J.)<br \/>\nPrakash\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Lalmohar Rai vs State Of Bihar on 19 November, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
