SIRI JAGAN, J.\n               - - - - - - - - - - - - - - - - - - - - - - -\n                  W.P.(C)No. 37455 of 2010\n               - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 17th day of December, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>     The petitioner is working as Re-touching Artist Grade-I<\/p>\n<p>in the Government Press, Mannanthala. According to the<\/p>\n<p>petitioner, he is entitled to be promoted as Supervisor<\/p>\n<p>(Plate Making\/Reproduction), as per the Draft Special Rules<\/p>\n<p>framed, which is pending finalisation.                     The petitioner<\/p>\n<p>therefore submits that, in view of Exts.P6 &amp; P7 judgments,<\/p>\n<p>the respondents are bound to make promotions in<\/p>\n<p>accordance with the Draft Special Rules, which is not being<\/p>\n<p>done. The petitioner submits that, the petitioner is now put<\/p>\n<p>in    charge     of    the       post       of      Supervisor      (Plate<\/p>\n<p>Making\/Reproduction) and he is to retire from service on<\/p>\n<p>31.03.2011. The petitioner therefore seeks the following<\/p>\n<p>reliefs:\n<\/p>\n<blockquote><p>      i)  Declare that the petitioner is entitled to get promotion to<br \/>\n          the post of Supervisor (Plate Making) in the Government<br \/>\n          Press, Mannanthala which arose on 29.06.2010 in<br \/>\n          accordance with Ext.P5 Draft Special Rules;<\/p><\/blockquote>\n<p>      ii) Issue a writ of mandamus or any other appropriate writ,<br \/>\n          direction or order directing the respondents to forthwith<\/p>\n<p>W.P.(C)No. 37455 of 2010<br \/>\n<span class=\"hidden_text\">                                     -2-<\/span><\/p>\n<p>            promote the petitioner to the post of Supervisor (Plate<br \/>\n            Making) in the Government Press, Mannanthala;<\/p>\n<p>       iii) Issue a writ of mandamus or any other appropriate writ,<br \/>\n            direction or order directing the Respondents to fill up the<br \/>\n            vacancy of Supervisor (Plate Making) which arose on<br \/>\n            29.06.2010 in accordance with Ext.P5 Draft Special<br \/>\n            Rules as directed by this Hon&#8217;ble Court in Exhibits P-6<br \/>\n            and P-7 judgments.\n<\/p>\n<p>       iv)  Issue a writ of mandamus or any other appropriate writ,<br \/>\n            direction directing the respondents to consider Exhibit<br \/>\n            P-8 representation in the light of Exhibit P-6 judgment<br \/>\n            and promote him to the post of Supervisor (Plate<br \/>\n            Making) in the Government Press, Mannanthala, which<br \/>\n            arose on 29.06.2010;\n<\/p>\n<p>\n      I have heard the learned Government Pleader also. In<\/p>\n<p>the facts and circumstances of the case, I am of opinion<\/p>\n<p>that, it is only appropriate that the 2nd respondent considers<\/p>\n<p>the claim of the petitioner for promotion in the light of<\/p>\n<p>Exts.P6 &amp; P7 judgments.                   This shall be done as<\/p>\n<p>expeditiously as possible, at any rate within two months<\/p>\n<p>from the date of receipt of a copy of this judgment, after<\/p>\n<p>affording an opportunity of being heard to the petitioner.<\/p>\n<p>                                                         S.
