THE PANCHAYAT SEVAK, MANIA PANCHAYAT,\n                  BLOCK KATORIA, DISTT- BANKA\n                                  -----------\n<\/pre>\n<p>4   27.8.2010               C.W.J.C.No. 710 and C.W.J.C.No. 745 both of 2010<\/p>\n<p>                are by Panchayat Teachers, who are duly selected and appointed,<\/p>\n<p>                whose appointments have been cancelled by the order of District<\/p>\n<p>                Teacher Appointment Appellate Authority, Banka in Case no.<\/p>\n<p>                610\/13.05.2009 and 708\/18.07.2009. C.W.J.C.No.1959 of 2010<\/p>\n<p>                is by one Smt. Ranjana Kumari for implementation          of the<\/p>\n<p>                aforesaid order of the tribunal.\n<\/p>\n<p>                            Heard Mr. Rajendra Prasad Singh, learned Senior<\/p>\n<p>                Counsel, in support of first two writ petitions in which Mr. S.D.<br \/>\n<span class=\"hidden_text\">                        3<\/span><\/p>\n<p>Sanjay ,learned counsel, opposed the writ petitions and Mr. S.D.<\/p>\n<p>Sanjay, learned counsel appearing in support of third writ<\/p>\n<p>partition is opposed by Mr. Rajendra Prasad Singh.<\/p>\n<p>              The facts are lie in a very narrow compass.\n<\/p>\n<p>              Mr. Rajendra Prasad Singh, learned Senior Counsel<\/p>\n<p>for the petitioners in first two writ petitions submits that the<\/p>\n<p>order of the tribunal is not sustainable on several grounds<\/p>\n<p>primarily first that the complainant before the tribunal has no<\/p>\n<p>locus standi to move an application, secondly the application<\/p>\n<p>was filed beyond the time prescribed and thirdly the tribunal has<\/p>\n<p>passed order without notice and without hearing the affected<\/p>\n<p>parties.\n<\/p>\n<p>              On the other hand, Mr. S.D. Sanjay, submits that the<\/p>\n<p>whole selection process being vitiated, any person could have<\/p>\n<p>brought this fact to the notice of the tribunal. He submits that<\/p>\n<p>because of gross irregularity committed in the selection, the<\/p>\n<p>tribunal rightly interfered and this Court should not interfere in<\/p>\n<p>the matter.     So far as third writ petition is concerned, the<\/p>\n<p>consequence would depend upon the result of first two writ<\/p>\n<p>petitions.\n<\/p>\n<p>              Having heard the parties and considered the matter,<\/p>\n<p>in my view, the first two writ petitions must succeed. Firstly they<\/p>\n<p>must succeed on the third ground that affected parties are not<\/p>\n<p>heard. It is elementary principle of law that no order can be<\/p>\n<p>passed against a person adverse to him without granting him<br \/>\n<span class=\"hidden_text\">                       4<\/span><\/p>\n<p>opportunity of hearing. It must be remembered that the tribunal,<\/p>\n<p>so constituted, is a quasi judicial function and has to comply<\/p>\n<p>with principle of natural justice. Thus, the order of the tribunal<\/p>\n<p>being in violation of principle of natural justice       cannot be<\/p>\n<p>upheld and has to be quashed.\n<\/p>\n<p>            In view of the findings, as aforesaid, it is not<\/p>\n<p>necessary for me to decide the other issues though I may brought<\/p>\n<p>notice the same because of ultimate order I propose to pass.<\/p>\n<p>Apart from other issue, Mr. Rajendra Prasad Singh submits that<\/p>\n<p>the complainant before the tribunal had no locus standi to<\/p>\n<p>maintain the action. Mr. S.D. Sanjay submits to the contrary ,<\/p>\n<p>though admits, that the applicant before the tribunal was the<\/p>\n<p>husband of one of the aspirants to the post of Panchayat Teacher<\/p>\n<p>and not the applicant herself. This is a question of locus standi<\/p>\n<p>to maintain a complaint.\n<\/p>\n<p>            I may here notice that the tribunal has been<\/p>\n<p>constituted under rule 28 of the Bihar Primary Panchayat<\/p>\n<p>Teachers (Appointment and Service Condition)Rules, 2006. It is<\/p>\n<p>thus a tribunal of limited jurisdiction. It has no inherent power to<\/p>\n<p>entertain public petition. It relates to matters of appointment and<\/p>\n<p>service condition. Thus before a person can move the tribunal or<\/p>\n<p>the tribunal entertain a complaint, it must be shown that the<\/p>\n<p>complainant has locus standi. This matter which the tribunal<\/p>\n<p>would be required to examine. The other important aspect is<\/p>\n<p>with regard to limitation . Under rule 18 , as was originally<br \/>\n<span class=\"hidden_text\">                               5<\/span><\/p>\n<p>        enacted, a complaint has to be filed before the BDO and it was<\/p>\n<p>        specifically provided     that such a complaint had to be filed<\/p>\n<p>        within thirty days . The period of thirty days was not extendable.<\/p>\n<p>        Thus, Mr. Rajendra Prasad Singh submits that the complainant<\/p>\n<p>        even if he has locus standi had to move the application within<\/p>\n<p>        thirty days and not after three years of the selection process.<\/p>\n<p>                    In view of the findings given by this Court in respect<\/p>\n<p>        of the first issue, it is necessary to set aside the order of the<\/p>\n<p>        tribunal and remand the matter to the tribunal for fresh<\/p>\n<p>        consideration on all aspects that may be raised including those<\/p>\n<p>        noted above after due notice to all the parties<\/p>\n<p>                    So far as petitioners in first two writ petitions are<\/p>\n<p>        concerned, no notice is required to be issued to them as they are<\/p>\n<p>        aware    of the order passed by this Court          and it is their<\/p>\n<p>        responsibility to serve a copy of this order to the tribunal and<\/p>\n<p>        request for fixing a date for re-initiating the proceeding.<\/p>\n<p>                    As the matter relates to recruitment          of the year<\/p>\n<p>        2006, the tribunal should decide the matter at an early date<\/p>\n<p>        preferably within a period of three months from the date of<\/p>\n<p>        production of a copy of this order before the tribunal.<\/p>\n<p>                    In view of order passed in first two writ petitions, no<\/p>\n<p>        order need be passed in third writ application.<\/p>\n<p>                    With the aforesaid observations and directions all<\/p>\n<p>        these three writ applications are disposed of.<\/p>\n<p>                                          ( Navaniti Prasad Singh, J.)<br \/>\nsingh\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Smt.Ranjana Kumari vs The State Of Bihar &amp;Amp; Ors on 27 August, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.710 of 2010 1.
