Justice V.K.MOHANAN\n\n Dated :25\/06\/2008\n\n O R D E R\n        C.N.RAMACHANDRAN NAIR &amp; V.K.MOHANAN, JJ.\n                        -------------------------\n                      WP(C) No. 4054 of 2004\n                    ---------------------------------\n              Dated, this the 25th day of June, 2008\n\n                           J U D G M E N T\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>      Petitioner was appointed as High School Assistant to teach<\/p>\n<p>Mathematics in the 5th respondent&#8217;s School on a vacancy arising on<\/p>\n<p>account of shifting of one Smt.Radhamony to Higher Secondary<\/p>\n<p>section of the same school.            Regularisation of petitioner&#8217;s<\/p>\n<p>appointment was withheld on account of delay in regularisation of<\/p>\n<p>appointment of the said Smt.Radhamony. In other words, the post<\/p>\n<p>to which the petitioner was appointed becomes a regular vacancy<\/p>\n<p>only when the said Smt.Radhamony is regularised in the higher<\/p>\n<p>secondary section of the school. The impugned orders are passed<\/p>\n<p>at a time when Smt.Radhamony&#8217;s service was not regularised, with<\/p>\n<p>effect from the date on which petitioner joined. However, learned<\/p>\n<p>counsel for the petitioner submitted that later Ms.Radhamani&#8217;s<\/p>\n<p>service is regularised with effect from the date on which she was<\/p>\n<p>promoted, that is when petitioner joined duty.          Consequently,<\/p>\n<p>petitioner is entitled to regularisation on the date on which she was<\/p>\n<p>absorbed.
