1.\tThese
\nappeals at the instance of Oil and Natural Gas Corporation, the
\nAcquiring Body, under section 54 of the Land Acquisition Act read
\nwith section 96 of Civil Procedure Code are against the judgment and
\naward dated 18\/10\/1999 passed by learned Assistant Judge, Mehsana in
\nLand Acquisition Reference Case No.1269 and 1271 of 1993 .\n<\/p>\n
2.\tThe
\nState had acquired certain land on temporary basis of  the original
\nclaimants under section 35 of the Land Acquisition Act, 1894. After
\nfollowing procedure the Land Acquisition Officer vide his order dated
\n20\/4\/1990 awarded crop compensation and also awarded rental
\ncompensation at the rate of Rs.80\/- per Are per year. Feeling
\naggrieved by the said decision the claimants filed references before
\nthe learned Assistant Judge, Mehsana claiming rental compensation at
\nthe rate of Rs.350\/- per Are per year and further crop compensation.
\nThe learned Assistant Judge, Mehsana vide award impugned awarded
\nadditional compensation at the rate of Rs.190\/- per Are per year and
\nfurther awarded 20% additional crop compensation. It is against the
\nsaid awards the present appeals have been filed.\n<\/p>\n
3.\tLearned
\nAdvocate for the appellant submitted that the issue involved in these
\nappeals is squarely covered by the ratio laid down in the case of Oil
\n& Natural Gas Corporation Ltd. Vs. Sankarji Hemaji & Anr
\nreported in [2008] 17 GHJ (523). The operative part of the said
\nJudgement reads as under:\n<\/p>\n
“41.\tSimilarly,
\nevent he conduct and the action of the then Special Land Acquisition
\nOfficer, who has referred the references applications in more than
\n100 cases to the reference court, though the applications for
\nreference were filed after a period of more than 20 years, is also
\nrequired to be considered seriously at the hands of Government. Under
\nthe circumstances, Chief Secretary, Revenue Department is directed to
\nhold necessary inquiry against the concerned Special Land Acquisition
\nOfficer with regard to his conduct and actions. Registry is directed
\nto communicate this order to the Chief Secretary, Revenue Department,
\nState of Gujarat for compliance.\n<\/p>\n
42.\tFor the
\nreasons stated hereinabove,all the appeals succeed and are allowed
\nwith costs which is quantified at Rs.5000\/- (Rupees Five Thousand
\nonly) per each appeal. The impugned common judgment and award dated
\n15.10.2005 passed by the learned Principal Senior Civil Judge,
\nMehsana (Mr. J.R. Shah) inland Reference Case Nos.3780 to 3784 of
\n2003 is hereby quashed and set aside and it is held that:\n<\/p>\n
[i]\tThe
\nreference applications submitted by the original claimants were not
\nmaintainable.\n<\/p>\n
[ii]\tThe
\nreference applications were required to be dismissed on the ground of
\nlimitation considering Article 137 of the Limitation Act.  In the
\nalternate, the same were required to be dismissed on the ground of
\ndelay and laches.\n<\/p>\n
[iii]\tThe
\nreference court has no jurisdiction to decide any other question
\nexcept the difference as to sufficiency of compensation in a
\nreference under sec.35(3) of the Act.\n<\/p>\n
[iv]\tThe
\nreference court has no jurisdiction to decide any other question
\nexcept the difference as to sufficiency of compensation in a
\nreference under section 35(3) of the Act.\n<\/p>\n
[v]\tThe
\nreference court has no jurisdiction to declare acquisition
\nproceedings and the award declared by the Special Land Acquisition
\nOfficer under sec.35(3) of the Act as illegal and\/or non-est in a
\nreference under section 35(3) of the Act.\n<\/p>\n
[vi]\tThe
\nreference court has no jurisdiction to declare possession of the
\nacquiring body as illegal and\/or unauthorized and consequently the
\nreference court has no jurisdiction to declare the ONGC-acquiring
\nbody as trespasser that too without framing any issue.\n<\/p>\n
[vii]\tThe
\nreference court has no jurisdiction toward compensation by way of
\nmesne profit declaring compensation of the acquiring body as illegal
\nand unauthorized.\n<\/p>\n
[viii]\tThe
\nreference court has also no jurisdiction to award statutory benefits
\nand or interest, as awarded by the reference court, as if the
\nacquisition proceedings is a permanent acquisition.\n<\/p>\n
[ix]\tThe
\nreference court has no jurisdiction to determine the dispute with
\nregard to sufficiency of the compensation beyond the period of three
\nyears from the date of taking the possession.\n<\/p>\n
[x]\tThe
\nReference Court has no jurisdiction to restore the possession of the
\nland to the original owners while deciding the reference under
\nsec.35(3) of the Act.”\n<\/p>\n
4.\tThe
\nratio laid down in the aforesaid case is squarely applicable to the
\nfacts of the case.  Learned advocate for the respondents is not able
\nto point out anything to take a different view of the matter.\n<\/p>\n
5.\tIn
\nthe premises aforesaid, these appeals are allowed. The judgment and
\naward impugned in these appeals are quashed and set aside.  No order
\nas to costs.\n<\/p>\n
