Justice R.BASANT\n\n Dated :10\/10\/2007\n\n O R D E R\n                                R.BASANT, J\n                        ------------------------------------\n                       Crl.M.C.No.3130 of 2007\n                        -------------------------------------\n               Dated this the 10th day of October, 2007\n\n                                  O R D E R\n<\/pre>\n<p>      The petitioner faces indictment in a prosecution for the offences<\/p>\n<p>punishable, inter alia, under Section 420 I.P.C. The petitioner had<\/p>\n<p>come before this Court and this Court had directed the petitioner to<\/p>\n<p>surrender before the learned Magistrate positively on or before<\/p>\n<p>25.09.07. On account of reasons beyond the control of the petitioner,<\/p>\n<p>the petitioner could not appear before the learned Magistrate on<\/p>\n<p>25.09.07 personally, it is submitted. He appeared through counsel and<\/p>\n<p>filed an application for condoning his absence.               That petition was<\/p>\n<p>dismissed and a warrant of arrest has been issued against the<\/p>\n<p>petitioner.\n<\/p>\n<p>      2.    According to the petitioner, he is absolutely innocent. His<\/p>\n<p>absence on 25.09.07 was not wilful.                 He has filed an application<\/p>\n<p>explaining the circumstances under which he could not appear. He is<\/p>\n<p>willing to surrender before the learned Magistrate. But he apprehends<\/p>\n<p>that his application for regular bail may not be considered by the<\/p>\n<p>learned    Magistrate   on     merits,       in    accordance   with  law   and<\/p>\n<p>expeditiously. It is therefore prayed that directions under Section 482<\/p>\n<p>Cr.P.C may be issued in favour of the petitioner.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3130 of 2007            2<\/span><\/p>\n<p>      3.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate the circumstances<\/p>\n<p>under which he could not earlier appear before the learned Magistrate.<\/p>\n<p>I have no reason to assume that the learned Magistrate would not<\/p>\n<p>consider such application on merits, in accordance with law and<\/p>\n<p>expeditiously. Every court must do the same. No special or specific<\/p>\n<p>direction appears to be necessary. Sufficient general directions have<\/p>\n<p>already been issued in <a href=\"\/doc\/147290035\/\">Alice George v. The Deputy Superintendent<\/p>\n<p>of Police<\/a> [2003(1) KLT 339].\n<\/p>\n<p>      4.
