The F.I.R. alleged that the two Bank employees entered\ninto  a criminal conspiracy with the two account-holders  to\ncheat  the  Bank  and, in pursuance  thereof  an  amount  of\nRs.54,600  was allowed to be withdrawn by the  account-hold-\ners,   who  had\t tendered  three  cheques   aggregating\t  to\nRs.54,600,  on the basis of the false credit entries in\t the\nbooks  of  accounts of the Bank, and  connected\t credit\t and\ndebit-vouchers\twere also prepared. The case against one  of\nthe account-holders was later dropped.\n    The\t High  Court quashed the  proceedings  only  against\nRespondent No. 1 on the ground that the allegations made  in\nthe  F.I.R.  did not constitute any offence of\tcheating  or\nforgery.  Against  this decision, the State as well  as\t the\nBank filed appeals in this Court.\nQuashing the proceedings against all the respondents,\n    HELD:  1.  If the allegations made in the FIR  taken  at\ntheir  face  value  and accepted in their  entirety  do\t not\nconstitute  an offence, the criminal proceedings  instituted\non the basis of such FIR should be quashed. [837C]\n    In the instant case, the Respondent No. 1 and the  other\naccused had accepted the three cheques in question and\tsent\nthe  same for clearance after debiting the LOC account.\t The\ncheques\t were  encashed and the money was  received  by\t the\nBank.  It may be that there was some delay in crediting\t the\nLOC account or that the money against the three\n835\ncheques\t were credited in the accounts of the  account-hold-\ners,  but the allegations made either in the FIR or  in\t the\ncharge-sheet do not show that they had acted dishonestly, or\nwith deliberate intention to cause wrongful gain or wrongful\nloss  to the Bank. When the amount was allowed to  be  with-\ndrawn  by the account-holders, necessary entries had  to  be\nmade in the accounts of the Bank and these entries cannot be\ncharacterised as false. No document has been referred to  in\nthe FIR as the outcome of forgery. [837E-F, 838A]\n    The High Court was, therefore, right in holding that the\nallegations  made in the FIR did not constitute any  offence\nof cheating or forgery and that as the criminal\t proceedings\nhad been started on the basis of a FIR which did not contain\nany  definite  accusation  and it amounted to  an  abuse  of\nprocess of the Court, they were liable to be quashed. [837G,\n838B]\n    Since  the allegations in the FIR are the  same  against\nall  the accused persons, the entire proceedings as  against\nall the accused persons should be quashed. Accordingly,\t the\nentire criminal proceedings are quashed. Kohli,  Manoj\t Saxena and R.D.  Upadhyay  for\t the<br \/>\nRespondents.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\n    DUTT,  J. These two appeals by special leave,  one\tpre-<br \/>\nferred by the State of U .P. and the other by the State Bank<br \/>\nof India, are directed against the judgment of the Allahabad<br \/>\nHigh  Court whereby the High Court has quashed the  criminal<br \/>\nproceedings being Crime Case No. 40 of 1983 in the Court  of<br \/>\nSpecial Judge, Anti-Corruption, only as against the respond-<br \/>\nent  R.K.  Srivastava. In quashing the\tproceedings  in\t the<br \/>\nexercise of its jurisdiction under section 482 Cr. P.C., the<br \/>\nHigh Court took the view that allegations made in the  First<br \/>\nInformation Report<br \/>\n<span class=\"hidden_text\">836<\/span><br \/>\n(FIR) did not constitute any offence. In order to appreciate<br \/>\nthe view of the High Court, it is necessary to refer to\t the<br \/>\nFIR which reads as follows:\n<\/p>\n<blockquote><p>\t      &#8220;An  information has been received  that\tShri<br \/>\n\t      P.C.  Saxena  and Shri  Ram  Kumar  Srivastava<br \/>\n\t      while posted and functioning as Accountant and<br \/>\n\t      Clerk-cum-Godown\tKeeper in the State Bank  of<br \/>\n\t      India, Agriculture Development Branch, Budaun,<br \/>\n\t      respectively entered into a criminal conspira-<br \/>\n\t      cy  with Shri Sarwant Singh and his wife\tSmt.<br \/>\n\t      Rajwant  Kaur,  Props. of M\/s.  National\tMill<br \/>\n\t      Store, Budaun, during the month of June,\t1982<br \/>\n\t      to cheat the State Bank of India, Budaun,\t and<br \/>\n\t      in  pursuance of the said criminal  conspiracy<br \/>\n\t      an.amount\t of Rs.54,600&#8242; was withdrawn on\t the<br \/>\n\t      basis of false credit entry made in the  books<br \/>\n\t      of  accounts of the Bank and connected  credit<br \/>\n\t      and  debit  vouchers were\t also  prepared\t and<br \/>\n\t      passed  by the accused employees of  the\tBank<br \/>\n\t      and payment were made to the accused  persons,<br \/>\n\t      namely,  Shri Sarwant Singh and  Smt.  Rajwant<br \/>\n\t      Kaur who tendered cheque No. 348459 dated 2.5.<br \/>\n\t      1982  for Rs.18,600 cheque No. 348482 for\t Rs.<br \/>\n\t      19,200,  date 2.6. 1982 and cheque No.  502206<br \/>\n\t      dated 2.6.82 for Rs. 16,800 = 54,600.<br \/>\n\t\t\tThe  above facts constitute  offence<br \/>\n\t      punishable u\/s 120-B, 420, 468,471 I.P.C.\t and<br \/>\n\t      5(2) r\/w 5(1)(d) of PC Act, 1947.\n<\/p><\/blockquote>\n<blockquote><p>\t\t\tA  regular case is therefore  regis-<br \/>\n\t      tered  and its investigation is  entrusted  to<br \/>\n\t      Shri  V.P. Arya, Inspector of this  establish-<br \/>\n\t      ment.&#8221;\n<\/p><\/blockquote>\n<p>According to the FIR, as against three cheques of the aggre-<br \/>\ngate  amount  of Rs.54,600, presumably\tof  three  different<br \/>\nBanks,\ta  credit  entry was made in the  accounts  of\tM\/s.<br \/>\nNational Mill Stores Co., Budaun, and M\/s. New Manufacturing<br \/>\nCo.,  Budaun, and their partners, Sardar Sarwant  Singh\t and<br \/>\nhis  wife Smt. Rajwant Kaur, in the State Bank of India\t and<br \/>\nthe  said  sum of Rs.54,600 was allowed to be  withdrawn  by<br \/>\nthem by the respondent and the accused P.C. Saxena.<br \/>\n    The\t allegations in the FIR appear to be vague  and\t al-<br \/>\nthough\tit  is alleged that the respondent and\tthe  accused<br \/>\nP.C.  Saxena made false credit entries in the books  of\t ac-<br \/>\ncounts\tof the Bank and connected credit and debit  vouchers<br \/>\nwere also prepared and passed by them, no<br \/>\n<span class=\"hidden_text\">837<\/span><br \/>\nparticulars of the same have been given. It appears from the<br \/>\nchargesheet  that the said Shri Sarwant Singh and  his\twife<br \/>\nSmt.  Rajwant  Kaur and their firms, namely,  M\/s.  National<br \/>\nMill  Stores  Co., Budaun, and M\/s. New\t ManufaCturing\tCo.,<br \/>\nBudaun,\t have current accounts in the State Bank  of  India,<br \/>\nBudaun. After the said three cheques amounting to  Rs.54,600<br \/>\nwere  tendered, the respondent and the accused\tP.C.  Saxena<br \/>\nsent  the  said cheques for clearance and allowed  the\tsaid<br \/>\nShri  Sarwant Singh and his wife Smt. Rajwant Kaur to  with-<br \/>\ndraw the sum of Rs. 54,600 from their current account.<br \/>\n    It\tis now a well settled principle of law that  if\t the<br \/>\nallegations  made in the FIR are taken at their\t face  value<br \/>\nand accepted in their entirety do not constitute an offence,<br \/>\nthe criminal proceedings instituted on the basis of such FIR<br \/>\nshould be quashed. In the instant case, on the basis of\t the<br \/>\nsaid  FIR the respondent and the said P.C. Saxena  and\tShri<br \/>\nSarwant\t Singh were charged under sections 120-B,  420,\t 468<br \/>\nand 471 I.P.C. and section 5(2) read with section 5(1)(d) of<br \/>\nthe  Prevention\t of Corruption Act, 1947. According  to\t the<br \/>\nappellant, as no prima facie case was made out against\tSmt.<br \/>\nRajwant\t Kaur,\twife  of Shri Sarwant Singh,  she  has\tbeen<br \/>\ndropped from the array of the accused persons.<br \/>\n    The\t question is whether the facts disclosed in the\t FIR<br \/>\nconstitute  the\t offences with which the accused  have\tbeen<br \/>\ncharged. It is manifestly clear from the allegations in\t the<br \/>\nFIR  that the respondent or the other accused had no  inten-<br \/>\ntion  whatsoever  to make any wrongful gain or to  make\t any<br \/>\nwrongful loss to the Bank. They had accepted the said  three<br \/>\ncheques amounting to Rs.54,600 and sent the same for  clear-<br \/>\nance  after debiting the LOC account. The said cheques\thave<br \/>\nbeen  encashed and the money was received by the State\tBank<br \/>\nof  India. It may be that there was some delay in  crediting<br \/>\nthe LOC account or that the money against the three  cheques<br \/>\nwere credited in the accounts of the said Shri Sarwant Singh<br \/>\nand his wife, but the allegations made either in the FIR  or<br \/>\nin the charge-sheet do not show that the respondent and\t the<br \/>\nsaid  P.C.  Saxena had acted dishonestly, that\tis  to\tsay,<br \/>\nacted with a deliberate intention to cause wrongful gain  or<br \/>\nwrongful  loss. In our opinion, the High Court\thas  rightly<br \/>\nheld that the allegations made in the FIR do not  constitute<br \/>\nany offence of cheating, nor do they constitute any  offence<br \/>\nof  forgery.  It is true that it has been alleged  that\t the<br \/>\nsaid  sum of Rs.54,600 was withdrawn on the basis  of  false<br \/>\ncredit entries made in the books of accounts of the Bank and<br \/>\nconnected  credit and debit vouchers were also prepared\t and<br \/>\npassed\tby  the respondent and the other accused.  When\t the<br \/>\nsaid sum of Rs.54,600<br \/>\n<span class=\"hidden_text\">838<\/span><br \/>\nhad  been allowed to be withdrawn by the said  Shri  Sarwant<br \/>\nSingh and his wife, necessary entries had to be made in\t the<br \/>\nbooks  of accounts, but it is not understandable  how  these<br \/>\nentries\t can be characterised as false entries. No  document<br \/>\nhas been referred to in the FIR as the outcome of forgery.<br \/>\n    The\t High  Court has rightly held that as  the  criminal<br \/>\nproceedings have been started against the respondent on\t the<br \/>\nbasis  of a FIR which does not contain any definite  accusa-<br \/>\ntion, it amounts to an abuse of process of the court and, as<br \/>\nsuch,  is liable to be quashed. We entirely agree  with\t the<br \/>\nview expressed by the High Court.\n<\/p>\n<p>    The\t High  Court  has quashed the  proceedings  only  as<br \/>\nagainst the respondent No. 1, R.K. Srivastava. In our  opin-<br \/>\nion,  when the allegations in the FIR are the  same  against<br \/>\nall  the accused persons, the entire proceedings as  against<br \/>\nall  the accused persons including the said P.C. Saxena\t and<br \/>\nthe said Shri Satwant Singh should be quashed.<br \/>\n    Accordingly,  while we uphold the judgment of  the\tHigh<br \/>\nCourt, we quash the entire criminal proceedings being  Crime<br \/>\nCase No. 40 of 1983 also as against the accused P.C.  Saxena<br \/>\nand  Shri  Sarwant  Singh.
