K.S.RADHAKRISHNAN)<\/p>\n<p>\tThe<br \/>\nissue raised in this Appeal is whether the appellant-petitioner is<br \/>\nbound to pay premium @ 20% of market price for transfer of land upon<br \/>\nmerger of Shri Premshankar Khedu Sahakari Jinning and Pressing<br \/>\nSociety Limited with Mandvi Taluka Kheti Paknu Rupantar Ane Vechan<br \/>\nKarnara Sahakari Mandli Limited.\n<\/p>\n<p>\tOn<br \/>\ngoing through the impugned order, we find that the authorities have<br \/>\nmainly proceeded on the ground that the appellant-petitioner had<br \/>\nagreed to pay the premium @ 20% of market price of the land.  But the<br \/>\nquestion as to `whether upon merger of the two Societies,<br \/>\npetitioner-appellant is bound to pay premium @ 20% of the market<br \/>\nprice of land&#8217;, has not been considered by the authorities.\n<\/p>\n<p>\tAt<br \/>\nthis stage, learned counsel for the appellant-petitioner submits that<br \/>\nthe premium amount @ 20% of the market rate has already been paid by<br \/>\nthe previous Society.\n<\/p>\n<p>\tIn<br \/>\nthe aforesaid circumstances, we are inclined to dispose of this<br \/>\nappeal with a direction to the Collector, Surat, to examine as to<br \/>\nwhether the appellant-petitioner is again required to pay premium @<br \/>\n20% of the market price, since the appellant-petitioner-Society was<br \/>\nmerged with another co-operative Society, even though the<br \/>\nappellant-petitioner has consented and paid the premium amount on the<br \/>\nprevious occasion.\n<\/p>\n<p>\tAccordingly,<br \/>\nwe set aside the impugned order dated 25.06.2007 and direct the<br \/>\nCollector, Surat, to examine as to whether the appellant-petitioner<br \/>\nis again required to pay premium @ 20% of the market price upon<br \/>\nmerger of the appellant-petitioner-Society with another co-operative<br \/>\nSociety, even though the appellant-petitioner has consented and<br \/>\npreviously paid the premium amount and take a fresh decision in<br \/>\naccordance with law within a period of one month from the date of<br \/>\nreceipt of this order.\n<\/p>\n<p>\tThe<br \/>\nLetters Patent Appeal and the Civil Application stand disposed of<br \/>\naccordingly.\n<\/p>\n<p> Notice is discharged.\n<\/p>\n<p>(K.S.\n<\/p>\n<p>RADHAKRISHNAN, C.J.)<\/p>\n<p>(MOHIT<br \/>\nS.
