Shruti Pathak, learned advocate<br \/>\nfor Miss. Megha Jani, learned advocate appearing for the respondent<br \/>\nNo. 2. Though served, nobody appears on behalf of other respondents.\n<\/p>\n<p>2.\tBy<br \/>\nway of this application under Section 24 of the Code of Civil<br \/>\nProcedure, applicant original defendant No. 4 has prayed for an<br \/>\nappropriate order to transfer the Civil Suit No. 610 of 1997 pending<br \/>\nin the Court of learned Civil Judge (S.D.), Rural, Ahmedabad.\n<\/p>\n<p>3.\tShri<br \/>\nMehta, learned advocate appearing for the applicant has submitted<br \/>\nthat other proceedings being Civil Suit Nos. 1652 of 1981, 4380 of<br \/>\n1982, 3331 of 2003, 175 of 2007 and 295 of 2007 between the same<br \/>\nparties with respect to the same properties are pending in the City<br \/>\nCivil Court, Ahmedabad and, therefore, to avoid any conflicting<br \/>\norder, it is requested to transfer the proceedings pending in the<br \/>\nCourt of learned Civil Judge, (S.D.), Rural, Ahmedabad to the learned<br \/>\nCity Civil Court, Ahmedabad.\n<\/p>\n<p>4.\tMiss.\n<\/p>\n<p>Shruti Pathak, learned advocate for the respondent No. 2 has<br \/>\nsubmitted that she has not objection if the proceedings are<br \/>\ntransferred to the learned City Civil Court, Ahmedabad.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe above, more particularly, when other proceedings stated herein<br \/>\nabove between the same parties with respect to the same properties<br \/>\nare pending in the City Civil Court, Ahmedabad to avoid any<br \/>\nconflicting order it will be in the fitness of things to exercise the<br \/>\npower under Section 24 of the Code of Civil Procedure and to transfer<br \/>\nthe proceedings pending in the Court of learned Civil Judge, (S.D.),<br \/>\nRural, Ahmedabad to the learned City Civil Court, Ahmedabad.\n<\/p>\n<p>6.\tFor<br \/>\nthe reasons stated above, application succeeds. Civil Suit No. 610 of<br \/>\n1997  pending in the Court of learned Civil Judge, (S.D.), Rural,<br \/>\nAhmedabad  is hereby ordered to be transferred to the City Civil<br \/>\nCourt at Ahmedabad and to be heard with Civil Suit Nos. 1652 of 1981,<br \/>\n4380 of 1982, 3331 of 2003, 175 of 2007 and 295 of 2007.
