    This is Regular Second Appeal by the legal<\/p>\n
representatives of the deceased mortgagee\/the sole<\/p>\n
defendant in O.S.No.651\/91 on the file of the<\/p>\n
Munsiff’s Court, Thiruvananthapuram assailing the<\/p>\n
concurrent verdicts of the courts below, negativing<\/p>\n
the claim of the mortgagee to kudikidappu right on<\/p>\n
redemption by virtue of Explanation IV to Section 2<\/p>\n
(25) of the Kerala Land Reforms Act.\n<\/p>\n
    2. Counsel for the appellants submits that in<\/p>\n
view of the decision of this Court in S.N.D.P.,<\/p>\n
Poothotta Branch v. Ammini (ILR<\/a> 2008 (2) Kerala 99)<\/p>\n
the  evidence  adduced  before  the  Land  Tribunal<\/p>\n
cannot be looked into by the civil court unless<\/p>\n
such evidence had been adduced before the civil<\/p>\n
court or let in, in the manner provided under the<\/p>\n
Evidence Act and so, therefore, there is absolutely<\/p>\n
no evidence regarding the income and on the basis<\/p>\n

of the income of the mortgagee, the claim advanced<\/p>\n
for    kudikidappu right   should  not  have   been<\/p>\n
negatived.    All the same, it has been proved by<\/p>\n
production   of   Exhibit  A5  by   the  plaintiff\/<\/p>\n
respondent that the appellants own three cents of<\/p>\n
land    in Manacadu  Village  within  the city  of<\/p>\n
Thiruvananthapuram.   Counsel  for  the  appellants<\/p>\n
further   submits that   in view  of  the decision<\/p>\n
aforesaid,   it  is  true  that documents  produced<\/p>\n
before the Land Tribunal cannot as such form part<\/p>\n
of evidence in the case, but, all the same, by a<\/p>\n
registered document, the property purchased under<\/p>\n
Exhibit A5 was sold by the appellants on 4.5.1977,<\/p>\n
namely, Sale Deed No.557\/1977 and that ought to<\/p>\n
have been permitted to be produced and therefore,<\/p>\n
at least an opportunity be granted to him to<\/p>\n
produce the documents, as otherwise, the valid<\/p>\n
rights of the appellants to kudikidappu will be<\/p>\n
deprived of to them.\n<\/p>\n

     3. Counsel for the respondent seriously opposes<\/p>\n
the submission on the ground that the appellants,<\/p>\n
in order to entitle themselves to kudikidappu right<\/p>\n
on redemption, have to prove also that their annual<\/p>\n
income does not exceed Rs.2000\/-, in view of the<\/p>\n
explanation to Section 2(25) of the Kerala Land<\/p>\n
Reforms Act.\n<\/p>\n
     4.   The appellate court has observed that the<\/p>\n
predecessor in interest of the appellants has given<\/p>\n
evidence before the Land Tribunal that his monthly<\/p>\n
income    is  Rs.300\/-  per   month,  but,   however,<\/p>\n
according to the counsel for the appellants, the<\/p>\n
said admission cannot be taken into account, as the<\/p>\n
evidence of the predecessor in interest of the<\/p>\n
appellants was being recorded by the Land Tribunal<\/p>\n
in view of the decision in S.N.D.P.’s case (cited<\/p>\n
supra).\n<\/p>\n
     5.   All the same, it is worthy to note that the<\/p>\n
defendant in the suit has not entered the witness<\/p>\n
box at all during trial of the suit and the<\/p>\n

plaintiff cannot compel him also to appear before<\/p>\n
court to tender evidence, so as to enable him being<\/p>\n
confronted with the prior statement given before<\/p>\n
the Land Tribunal.   The burden is on the mortgagee,<\/p>\n
who claims right under Explanation IV to Section 2<\/p>\n
(25) of the Kerala Land Reforms Act, to establish<\/p>\n
both the ingredients for application of Explanation<\/p>\n
IV, namely, that he is not having land in excess of<\/p>\n
what is mentioned in Explanation IV and also that<\/p>\n
his income does not exceed Rs.2,000\/- per annum.<\/p>\n
If the contention of the appellant’s counsel is<\/p>\n
accepted, for want of any evidence on the side of<\/p>\n
the     mortgagee\/kudikidappukaran,  who   is    the<\/p>\n
predecessor in interest of the present appellants,<\/p>\n
it has to be held that he had not established his<\/p>\n
contention so as to obtain right conferred under<\/p>\n
explanation IV to Section 2(25) of the Kerala Land<\/p>\n
Reforms Act. Thus, there is no meaning in providing<\/p>\n
an opportunity as requested for by the counsel for<\/p>\n
the appellants to produce certified copy of the<\/p>\n

document to show that Exhibit A5 property purchased<\/p>\n
by   the   defendant in the  suit  had  been   sold<\/p>\n
subsequently.\n<\/p>\n
     6.    It is also brought to my notice by the<\/p>\n
learned counsel for the respondent that as far as<\/p>\n
this case is concerned, the decision in S.N.D.P.’s<\/p>\n
case (cited supra) will have no application at all,<\/p>\n
as this Court was dealing with a first appeal,<\/p>\n
wherein, the question considered was as to whether<\/p>\n
the trial court was justified in looking into the<\/p>\n
evidence that was adduced before the Land Tribunal.<\/p>\n
This is a case wherein, by reason of Section 125(6)<\/p>\n
of the Kerala Land Reforms Act, the first appellate<\/p>\n
court    was entitled to  look  into  the  evidence<\/p>\n
adduced before the Land Tribunal as well for the<\/p>\n
reason that for the purpose of appeal, the decision<\/p>\n
of the Land Tribunal, on reference under Section<\/p>\n
125(3), will also be deemed to be part of the<\/p>\n
finding of the civil court and without looking into<\/p>\n
the evidence adduced before the Land Tribunal, the<\/p>\n

appellate court cannot consider the correctness of<\/p>\n
the finding entered into by the Land Tribunal in<\/p>\n
the appeal filed against the decree in the suit.<\/p>\n
     7. The position canvassed for the respondent<\/p>\n
is tenable.   Viewed in that way also, there is no<\/p>\n
merit at all in the contentions advanced on behalf<\/p>\n
of the appellants.   There is, thus, no merit at all<\/p>\n
in this appeal and there is no question of law and<\/p>\n
much less, any substantial question of law that<\/p>\n
arises for consideration by this Court in this<\/p>\n
Regular Second Appeal.\n<\/p>\n
     This Regular Second Appeal, in the circumstances,<\/p>\n
is dismissed in limine, refusing admission.<\/p>\n
