Justice S.S.SATHEESACHANDRAN\n\n Dated :24\/08\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n            W.P.(C).No.24212 OF 2009\n           --------------------------\n     Dated this the 24th day of August 2009\n     -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p>        The writ petition is filed seeking the<\/p>\n<p>following reliefs.\n<\/p>\n<\/p>\n<p>        i)    To  call  for   the  records  in O.S<\/p>\n<p>No.41\/2007 in the  Sub Court, Nedumangad, under the<\/p>\n<p>Supervisory jurisdiction of the Hon&#8217;ble High Court<\/p>\n<p>and set aside Ext.P3 order in I.A No. 46\/2008 in<\/p>\n<p>O.S o.41 \/2007 holding that it is highly illegal,<\/p>\n<p>arbitrary and Court below had failed to exercise<\/p>\n<p>the discretion in a judicial way.<\/p>\n<p>        ii)  To issue such other writ direction or<\/p>\n<p>order to quash Ext.P3 order as the Court was failed<\/p>\n<p>to exercise the jurisdiction in a legal way.<\/p>\n<p>W.P.(C).No.24212 OF 2009      Page numbers<\/p>\n<p>          2.    Petitioner is the plaintiff in O.S No.<\/p>\n<p>41 of 2007 on the file of Sub Court, Nedumangad.<\/p>\n<p>Suit is one for money, and the respondent is the<\/p>\n<p>sole defendant in that suit.             The case of the<\/p>\n<p>plaintiff in a nutshell is that the first defendant<\/p>\n<p>allowed him to occupy a building owned by him<\/p>\n<p>receiving an amount of Rs.5,00,000\/- as security.<\/p>\n<p>While he continued in occupation of that building,<\/p>\n<p>the second respondent, bank proceeded against that<\/p>\n<p>building    since     it  had  already    been   given  as<\/p>\n<p>security for a loan availed by the first defendant.<\/p>\n<p>Admittedly the property was brought to sale and the<\/p>\n<p>plaintiff      was     evicted   from     that   building.<\/p>\n<p>Petitioner \/ plaintiff moved an application for<\/p>\n<p>impleadment of the second respondent \/ bank as a<\/p>\n<p>codefendant in the suit.          The learned Sub Judge<\/p>\n<p>after    issuing     notice   to   the    proposed  second<\/p>\n<p>defendant \/ bank and hearing the bank as well<\/p>\n<p>W.P.(C).No.24212 OF 2009     Page numbers<\/p>\n<p>dismissed the application for impleadment by Ext.P3<\/p>\n<p>order.     Propriety and correctness of Ext.P3 order<\/p>\n<p>is challenged in the writ petition invoking the<\/p>\n<p>supervisory jurisdiction vested with this court<\/p>\n<p>under Article 227 of the Constitution of India.<\/p>\n<p>          3.     I heard the learned counsel for the<\/p>\n<p>petitioner.      Having regard to the submissions made<\/p>\n<p>and taking note of the facts and circumstances<\/p>\n<p>presented, I find no notice to the respondents is<\/p>\n<p>necessary and it is dispensed with.          The learned<\/p>\n<p>counsel    for    the   petitioner    submits  that  the<\/p>\n<p>impleadment of the second respondent \/ bank in the<\/p>\n<p>suit is necessary so that he can get appropriate<\/p>\n<p>orders for claiming the excess amount obtained by<\/p>\n<p>the bank by sale of the property which now remain<\/p>\n<p>in the suspense account of the bank. A sum of<\/p>\n<p>Rs.3,00,000\/- is still in the suspense account<\/p>\n<p>after satisfying the decree debt due on sale of the<\/p>\n<p>W.P.(C).No.24212 OF 2009     Page numbers<\/p>\n<p>property.       If that be so, petitioner can take<\/p>\n<p>appropriate steps as envisaged by law, for which<\/p>\n<p>the impleadment of the bank as a codefendant when<\/p>\n<p>no relief against the bank is claimed in the suit<\/p>\n<p>is   not   necessary.      I  find   no  impropriety  or<\/p>\n<p>illegality in Ext.P3 order passed by the learned<\/p>\n<p>Sub Judge disallowing the request of the petitioner<\/p>\n<p>to implead the second respondent as a codefendant<\/p>\n<p>in the suit.
