       Common   issues   arise   for   consideration   in   these   writ<\/p>\n
petitions and therefore they are being disposed of by a common<\/p>\n
judgment.   Writ Petition No.6415 of 2007 is taken as the leading<\/p>\n
case for convenience.\n<\/p>\n
       1.     Petitioners in these writ petitions were appointed on a<\/p>\n
contract\/daily   wage   basis   in   different   capacities   in   the   Kerala<\/p>\n
State   Open   School,   which   is   stated   to   be     a   wing   of   the   State<\/p>\n
Council of Educational Research and  Training and Centre.  They<\/p>\n
have   been   serving   in   different   capacities     either   on   a   contract<\/p>\n
basis   or   on   a   daily   wage   basis   for   various   periods.     Exhibit   P3<\/p>\n
notification   came   to   be   issued   by   the     2nd  respondent   inviting<\/p>\n
applications   for     70   temporary   vacancies,   in   different   posts.\n<\/p>\n
Some   of   the   petitioners   earlier   approached   this   Court<\/p>\n
challenging   the   notification,   inter   alia,   on   the   ground   that<\/p>\n
Special   Rules   have   not   been   framed   for   effecting   appointments<\/p>\n

to   these   posts.     What   is   proposed   to   be   now   done   is     again<\/p>\n
appointment on a provisional basis and not regular appointment.\n<\/p>\n
Consequently, there is no reason why persons like the petitioner<\/p>\n
who   were   appointed   on   a   provisional   basis   should   not   be<\/p>\n
permitted   to   continue   until   regular   hands   are   appointed,   it   is<\/p>\n
contended.   Reference is made in W.P. (C ) No.4308 of 2007   to<\/p>\n
Exhibit P1 order passed in W.P. (C) No.26600 of 2006, which is<\/p>\n
also one of the petitions being disposed of by this judgment.\n<\/p>\n
       2.     In   a   counter   affidavit   filed   by   the   Government     in<\/p>\n
W.P (C) No.26600 of 2006, it is mentioned that the Kerala State<\/p>\n
Open School is under the Administrative control of the Director<\/p>\n
of   State   Council   of   Educational   Research   and   Training   and   is<\/p>\n
functioning as a separate wing of SCERT.  Appointments of staff<\/p>\n
to the post of teaching faculties, to the administrative branch in<\/p>\n
the State Council is on a deputation basis from the existing staff<\/p>\n
of   the   General   Education   Department.     But   in   the   case   of   the<\/p>\n
Kerala State Open School all the staff members were engaged on<\/p>\n
a daily wages\/contract basis except in the case of the State Co-\n<\/p>\n
ordinator. Special Rules for the State Council or the Open School<\/p>\n
are yet to be approved by the Government.   The staff pattern as<\/p>\n

such   is   approved   by   the   governing     body   of   the   State   Council<\/p>\n
also.   Petitioners are working on a daily wage basis.   They have<\/p>\n
no right to continue in service and they have no right  to prevent<\/p>\n
a   fresh   selection   being   conducted   by   the   respondents.\n<\/p>\n
Petitioners   are   entitled   to   participate   in   the   same   selection,<\/p>\n
notified under Exhibit P2 in W.P. (C ) No.4308 of 2007.\n<\/p>\n
       3.     A     separate   counter   affidavit   has   been   filed   by   the<\/p>\n
State Council   in W.P (C ) No.26600 of 2006 as also in W.P. (C)<\/p>\n
No.4308   of   2007.       It   is   contended     that   several   among   the<\/p>\n
petitioners   are   not   qualified   for   the   post.     They   have   been<\/p>\n
appointed on a daily wage basis or  on a contract basis.  Regular<\/p>\n
appointments   in   the   Open   School   can   be   effected   only   when<\/p>\n
approval   is   obtained   in   that   regard   from   the   Government.\n<\/p>\n
Government   will   have   to   approve   the   staff   pattern.     It   is<\/p>\n
therefore   that     the   present   selection   procedure   has   been<\/p>\n
notified.   A selection board has been constituted to  conduct the<\/p>\n
interview   for   the   various   posts.     In   paragraph   8   of   the   counter<\/p>\n
affidavit, it is stated as follows.\n<\/p>\n
              “A   Selection   Board   has   been   constituted   to   conduct<\/p>\n
       the interview for the various posts in the SCERT vide Office<\/p>\n
W.P ( C) Nos.  26600, 27317, 27201, 27487 of 2006 & 6415, 6419,4308  of 2007<\/p>\n

       Order   No.A1\/3038\/2006\/SCERT   dated   30.6.2007   with<\/p>\n
       Processor   M.A.Khader,   Director,   SCERT   as   covnenor   and<\/p>\n
       with Chairman for each Board.  A meeting of the Chairman<\/p>\n
       and   members   of   various   Boards   was     convened   by   the<\/p>\n
       Convenor,   Director,   SCERT   on   3.7.2007   and   a   guideline<\/p>\n
       was prepared in the meetings.  The norms for awarding the<\/p>\n
       scores and areas of interview questions were also discussed<\/p>\n
       and finalised in the meeting.\n<\/p>\n
                      Guidelines for conducting interview:\n<\/p>\n
              a)      Members from the approved panels may only be<\/p>\n
       included in the interview Board.\n<\/p>\n
              b)      5   Boards   may   be   constituted   from   the   panel   to<\/p>\n
       conduct the interview.\n<\/p>\n
              c)      There   should   be   minimum   2   and   maximum   3<\/p>\n
       members in each Board including the Chairman<\/p>\n
              d)      The   finalisation   of   scores   may   be   completed   in<\/p>\n
       the interview day itself and the Board Chairman may keep<\/p>\n
       the signed mark sheets under safe custody<\/p>\n
              e)      The   average   of   the   interview   scores   shall   be<\/p>\n
       signed by the Chairman and members.\n<\/p>\n

       4.     I   heard     the   Learned   counsel   for   the   petitioners,<\/p>\n
learned   Government   Pleader,   the   learned   standing   counsel   for<\/p>\n
the   State   Council   as   also   the   learned   standing   counsel   for   the<\/p>\n
Open School.\n<\/p>\n
       5.     Admittedly,   all   the   petitioners   have   been   appointed<\/p>\n
either on a daily wage basis or on a contract basis.   They were<\/p>\n
not   engaged\/appointed   pursuant   to   any   notified   selection<\/p>\n
procedure.  Orders of appointments have also not been placed on<\/p>\n
record.     Petitioners   cannot   claim   any   enforceable   right   to   be<\/p>\n
permitted   to   continue   in   service   till   regular   appointments   are<\/p>\n
effected   or   claim   regularization   of   their   services.     They   cannot<\/p>\n
seek   to   interdict     the   selection   now   undertaken   by   the<\/p>\n
respondents to the various posts even if it is for appointment on<\/p>\n
a daily wages or on a contract basis.  I also take note of the stand<\/p>\n
taken   by   the   State   Council     in   formulating   Guidelines   in<\/p>\n
conducting selection to the various posts even if such selection is<\/p>\n
for   appointment   on   a   provisional   basis.       Petitioners   cannot<\/p>\n
complain   any   disability   in   participating   in   such   selection,<\/p>\n
provided they are qualified for such posts.\n<\/p>\n

       6.     In   the   circumstances,     I   do   not   find   any     reason   to<\/p>\n
issue   any   directions   to   the   respondents   regarding   the   alleged<\/p>\n
illegality   or   irregularity   in   the   selection   undertaken   by   the<\/p>\n
respondents as notified under Exhibit P2.       Petitioners have no<\/p>\n
enforceable right   as against the respondents on the strength of<\/p>\n
their   engagement\/appointment   on   a   daily   wage   basis.     The   law<\/p>\n
laid   down   by   the   Supreme   Court   in  State   of   Karnataka   Vs.<\/p>\n
Ms.Umadevi   [2006   (4)   SCC   1]  also   stands   in   the   way   of   the<\/p>\n
petitioners.\n<\/p>\n
       For   all   these,   the   writ   petitions   are     bereft   of   merit   and<\/p>\n
therefore they are dismissed.\n<\/p>\n
