The said case was registered against the<br \/>\n\tpresent respondent No.1 &#8211; original accused for the offence<br \/>\n\tunder Sections 7 &amp;   16 of the Prevention of Food Adulteration<br \/>\n\tAct (for short &#8220;PFA Act&#8221;) in the Court of learned<br \/>\n\tMetropolitan Magistrate, Court No.8, Ahmedabad. The said Judgment of<br \/>\n\tthe trial Court has been challenged by the Food Inspector on the<br \/>\n\tground that the Judgment and order passed by learned Magistrate is<br \/>\n\tagainst the law and evidence on record.\n<\/p>\n<p>According<br \/>\n\tto the prosecution case on 18.09.2007, at 12.30 O&#8217;clock, the<br \/>\n\tcomplainant, along with his peon,  visited the business premises of<br \/>\n\tthe respondent &#8211; accused and took the sample of &#8220;sweet<br \/>\n\tMava&#8221;, in presence of panch witness,  for the purpose of<br \/>\n\tanalysis. Thereafter, after completing the necessary procedure, the<br \/>\n\tcomplainant sent one sample to the Public Analyst, for analysis. The<br \/>\n\tPublic Analyst submitted the report in which it has been found that<br \/>\n\tthe said sample was adulterated.   Upon receipt of the report the<br \/>\n\tcomplainant, after obtaining sanction, filed complaint against the<br \/>\n\trespondent &#8211; accused for the offences under Section 7 and 16<br \/>\n\tof the Act in the Court of learned Metropolitan Magistrate,<br \/>\n\tAhmedabad, being Criminal Case No. 4372 of 2008.\n<\/p>\n<p>At<br \/>\n\tthe conclusion of trial and after appreciating the oral as well as<br \/>\n\tdocumentary evidence, the learned Magistrate vide impugned Judgment,<br \/>\n\tacquitted the respondent &#8211; accused.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate,  appearing on behalf of the appellant &#8211; Corporation<br \/>\n\thas contended that the Judgment and order of acquittal is contrary<br \/>\n\tto law and evidence on record and is not proper. Learned Advocate<br \/>\n\thas contended that the learned Magistrate has not considered the<br \/>\n\tevidence adduced on behalf of the prosecution and that the<br \/>\n\tdocumentary evidence produced by the prosecution gets corroboration<br \/>\n\twith the evidence of the complainant and, therefore, the learned<br \/>\n\tMagistrate has erred in evaluating the complete sets of documents<br \/>\n\twhile giving the benefits of doubt to the respondent &#8211;<br \/>\n\taccused. She has contended that the offences committed by the<br \/>\n\taccused are directly connected with the health of the public at<br \/>\n\tlarge. She has contended that while taking the sample the<br \/>\n\tcomplainant has followed the proper procedure.  She has contended<br \/>\n\tthat there are direct and indirect evidence connecting the<br \/>\n\trespondent with the crime. She has contended that from the oral as<br \/>\n\twell as documentary evidence it is already established beyond<br \/>\n\treasonable doubt that the prosecution has followed the mandatory<br \/>\n\tprovision of law.\n<\/p>\n<p>I<br \/>\n\thave gone through the papers produced in the Case. I have also gone<br \/>\n\tthrough the evidence produced before the trial Court as well as the<br \/>\n\tExpert Opinion. I have also gone through the Judgment of the trial<br \/>\n\tCourt. I have also considered the decisions cited by both the<br \/>\n\tparties before the trial Court. Looking to the papers it clearly<br \/>\n\tappears that the food Inspector has not followed the procedure as<br \/>\n\tprescribed by the Rules. The Report of Public Analyst and the report<br \/>\n\tof Central Food Laboratory shows different nature and colour. The<br \/>\n\ttrial Court has also clearly observed that there is no standard<br \/>\n\tprescribed in Appendix B for the sample and the method of taking<br \/>\n\tsample and sealing procedure are suspicious and also that the report<br \/>\n\tof Public Analyst and Central Food Laboratory shows that the nature<br \/>\n\tand colour of sample are different. Looking to the facts of the case<br \/>\n\tit clearly appears that the learned Magistrate has observed that the<br \/>\n\tprosecution has failed to prove its case beyond reasonable doubt.<br \/>\n\tLooking to the evidence produced on record, in my opinion, the trial<br \/>\n\tCourt has rightly given the benefit of doubt to the respondent &#8211;<br \/>\n\taccused.   In the facts of the case I am in complete agreement with<br \/>\n\tthe reasons assigned by the trial Court.\n<\/p>\n<p>It<br \/>\n\tis settled legal position that in acquittal Appeal, the Appellate<br \/>\n\tCourt is not required to re-write the Judgment or to give fresh<br \/>\n\treasonings when the Appellate Court is in agreement with the reasons<br \/>\n\tassigned by the trial Court acquitting the accused. In the instant<br \/>\n\tcase, this Court is in full agreement with the reasons given and<br \/>\n\tfindings recorded by the trial Court while acquitting the<br \/>\n\trespondents &#8211; accused and adopting the said reasons and for<br \/>\n\tthe reasons aforesaid, in my view, the impugned Judgment is just,<br \/>\n\tlegal and proper and requires no interference by this Court at this<br \/>\n\tstage. Hence, this Appeal requires to be dismissed.\n<\/p>\n<p>In<br \/>\n\tthe result, the Appeal is hereby dismissed. The impugned Judgment<br \/>\n\tand order dated 07.04.2010 passed by the learned Metropolitan<br \/>\n\tMagistrate, Court No. 8, Ahmedabad, in Criminal Case No. 4372 of<br \/>\n\t2008, acquitting the respondent &#8211;
