JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/01\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Mr.Balvantsinh, learned advocate for Mr.Bhavin J. Satwara, learned<br \/>\ncounsel, waives service of notice of Rule on behalf of the<br \/>\nrespondents. On the facts and in the circumstances of the case and<br \/>\nwith the consent of the learned counsel for the respective parties,<br \/>\nthe petition is being heard and finally decided, today.\n<\/p>\n<p>2.\tThis<br \/>\npetition has been preferred under the provisions of Articles 226 and<br \/>\n227 of the Constitution of India, challenging order dated 16.10.2009,<br \/>\npassed by the learned Addl. District Judge, F.T.C-1, Surendranagar,<br \/>\nbelow application at Exh.5 in Miscellaneous Civil Appeal No.45\/2009,<br \/>\nwhereby the order dated 14.09.2009, passed by the learned Principal<br \/>\nCivil Judge, Limbdi, below application at Exh.5 in Regular Civil Suit<br \/>\nNo.44\/2009, has been stayed till the final disposal of the appeal.\n<\/p>\n<p>3.\tThe<br \/>\nbrief facts of the case, relevant for the decision of the petition<br \/>\nare that, the petitioners herein are the original plaintiffs of<br \/>\nRegular Civil Suit No.44\/2009 and the respondents are the original<br \/>\ndefendants. The suit has been filed inter-alia with a prayer<br \/>\nfor grant of declaration to the effect that the defendants have got<br \/>\nno right, title or interest to enter into the land of the plaintiffs<br \/>\nand obstruct the plaintiffs from harvesting agricultural crops and<br \/>\nperforming agricultural activities on land bearing Revenue Survey<br \/>\nNo.85\/P\/2, admeasuring 86-Acres       0-Guntha, situated at Village<br \/>\nGokharwala, Taluka Chuda, District Surendranagar. A prayer for grant<br \/>\nof a permanent injunction has also been sought to restrain the<br \/>\ndefendants from interfering with and causing obstructions to the<br \/>\npossession of the plaintiffs, on the suit property. Along with the<br \/>\nplaint, the petitioners filed an application at Exh.5 for grant of<br \/>\ntemporary injunction, on 10.07.2009. The Trial Court allowed the said<br \/>\napplication by order dated 14.09.2009. The respondents, therefore,<br \/>\npresented an application at Exh.28 for staying the said order, with a<br \/>\nview to approaching the lower Appellate Court, which application was<br \/>\nrejected by the Trial Court. Being aggrieved by the order dated<br \/>\n14.09.2009, below application at Exh.5, the respondents filed Misc.<br \/>\nCivil Appeal No.45\/2009 before the District Court, Surendranagar, on<br \/>\n21.10.2009. Along with the said appeal, an application at Exh.5 was<br \/>\nfiled, to stay the implementation and operation of the order granting<br \/>\ntemporary injunction, dated 14.09.2009, rendered by the Trial Court,<br \/>\ntill the final disposal of the appeal. On 12.10.2009, the District<br \/>\nCourt passed an order calling for the record and proceedings from the<br \/>\nTrial Court and directed the application be listed on 16.10.2009. On<br \/>\nthat date, the said application came to be allowed ex-parte, without<br \/>\nhearing the petitioners. Being aggrieved by the impugned order dated<br \/>\n16.10.2009 passed by the District Court, the petitioners have<br \/>\napproached this Court by way of the petition.\n<\/p>\n<p>4.\tMs.Kruti<br \/>\nM. Shah, learned counsel for the petitioners has submitted that the<br \/>\nimpugned order dated 16.10.2009, passed by the lower Appellate Court<br \/>\nis patently illegal, as it has been passed in flagrant violation of<br \/>\nthe principles of natural justice, as no opportunity of being heard<br \/>\nhas been given to the petitioners before passing the said order,<br \/>\nhence, the same may be quashed and set aside. It is further submitted<br \/>\nthat upon the application at Exh.5 filed by the respondents before<br \/>\nthe lower Appellate Court, the said Court passed an order dated<br \/>\n12.10.2009, calling for the record and proceedings, to reach that<br \/>\nCourt on 16.10.2009, which is evident from the Rojkam dated<br \/>\n16.10.2009. It is also mentioned in the impugned order that the<br \/>\nrespondents of the appeal i.e. the present petitioners, were not<br \/>\npresent, but as no notice has been issued to the petitioners, they<br \/>\nwere not aware that the matter was to be heard on 16.10.2009, and the<br \/>\nimpugned order has been passed in their absence. It is emphasized by<br \/>\nthe learned counsel for the petitioners that it is only on<br \/>\n28.10.2009, that notice was issued to the petitioners to remain<br \/>\npresent on 16.11.2009, after the passing of the impugned order. This<br \/>\nis a matter of record which can be verified from the Rojkam of the<br \/>\nlower Appellate Court. The petitioners have been seriously<br \/>\nprejudiced, as they have been deprived of the opportunity of being<br \/>\nheard, and the impugned order has been passed behind their backs,<br \/>\nwhich is operative till the final disposal of the appeal, the same<br \/>\nmay be quashed and set aside, and the petition  allowed.\n<\/p>\n<p>5.\tMr.Balvantsinh<br \/>\nlearned advocate for Mr.Bhavik J. Sathwara, appearing for the<br \/>\nrespondents has fairly stated that the court may pass appropriate<br \/>\norders and if the court is inclined to set aside the impugned order,<br \/>\nan opportunity of hearing may be given to the parties, before a fresh<br \/>\norder is passed by the lower Appellate Court.\n<\/p>\n<p>6.\tThe<br \/>\nrecord and proceedings of the lower Appellate Court were summoned by<br \/>\nthis Court on 24.11.2009 and the same have been perused. It is<br \/>\nevident from the said record and proceedings that the lower Appellate<br \/>\nCourt has called for the record and proceedings from the Trial Court<br \/>\nfor 16.10.2009. No notice has been issued to the petitioners for<br \/>\n16.10.2009. The order dated 16.10.2009 also records that the learned<br \/>\nadvocate for the appellants (present respondents) is present and none<br \/>\nis present on behalf of the respondents (present petitioners). This<br \/>\nis also clear from the Rojkam of the lower Appellate Court. It is<br \/>\nfurther mentioned in the Rojkam dated 16.10.2009 that an order has<br \/>\nbeen passed below Exh.5 in the appeal after hearing the learned<br \/>\ncounsel for the appellants (present respondents). The order dated<br \/>\n28.10.2009 reveals that notice has been ordered to be issued on that<br \/>\ndate, to the petitioners. A perusal of the impugned order dated<br \/>\n16.10.2009 makes it amply clear that the said order has been passed<br \/>\nafter hearing the learned advocate for the respondents only. In fact<br \/>\nit has been recorded  in the said order that none is present for the<br \/>\nrespondents of the appeal (present petitioners). When the court has<br \/>\nnot issued notice to the petitioners to remain present on 16.10.2009,<br \/>\nit is not understood how they could have remained present before the<br \/>\nlower Appellate Court, on that date. It cannot be lost sight of that<br \/>\nthe petitioners were granted a temporary injunction by order dated<br \/>\n14.09.2009 by the Trial Court, and the application of the respondents<br \/>\nfor staying the operation of that order (Exh.28) was also rejected.<br \/>\nThe lower Appellate Court ought to have issued notice to the<br \/>\npetitioners before passing the impugned order, which has the effect<br \/>\nof staying the order granting a temporary injunction, till the final<br \/>\ndecision of the appeal without giving an opportunity of hearing. The<br \/>\nsubmissions advanced by the learned counsel for the petitioners that<br \/>\nthe impugned order has been passed in violation of the principles of<br \/>\nnatural justice are worthy of consideration and are borne out from<br \/>\nthe record and proceedings of the lower Appellate Court. The<br \/>\npetitioners would be seriously prejudiced by the impugned order,<br \/>\nwhich has been passed behind their backs. In such a situation where<br \/>\nmiscarriage of justice has taken place, the interference of this<br \/>\nCourt, under its supervisory jurisdiction, is certainly warranted.\n<\/p>\n<p>7.\tAccordingly,<br \/>\nthe impugned order dated 16.10.2009, passed below application at<br \/>\nExh.5 in Miscellaneous Civil Appeal No.45\/2009, by the lower<br \/>\nAppellate Court is quashed and set aside. The lower Appellate Court<br \/>\nis directed to hear the parties and pass a fresh order, in accordance<br \/>\nwith law, without being influenced by the factum of the filing of the<br \/>\n petition. It is made clear that while passing this order, the Court<br \/>\nhas not gone into the merits of the case.\n<\/p>\n<p>8.\tThe<br \/>\npetition is allowed in the above terms.
