NO. 1267 OF 2009\n                   ---------------------------------------------\n                   Dated this the 19th day of June, 2009\n\n\n                                 JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<\/p>\n<p>       The point that arises for decision in this case is whether provisional<\/p>\n<p>hands appointed in the pre revised scale of pay are entitled to get higher<\/p>\n<p>scale of pay upon revision of the pay for regular hands, with retrospective<\/p>\n<p>effect. The brief facts of the case are the following:<\/p>\n<p>       2.  The respondents herein who were the writ petitioners were<\/p>\n<p>appointed by Ext.P1 order as Lecturers in various subjects in the<\/p>\n<p>Kozhikode Medical College by its Principal. The said order provided that<\/p>\n<p>the candidates are appointed on contract basis as Lecturers in the scale of<\/p>\n<p>pay of Rs.2,200-4,000\/- plus other allowances admissible in the<\/p>\n<p>department, for a period of one year from the date of their joining duty and<\/p>\n<p>that their services will be terminated as and when candidates advised by<\/p>\n<p>the Kerala Public Service Commission or Employment Exchange join<\/p>\n<p><span class=\"hidden_text\">W.A. NO. 1267\/2009                     2<\/span><\/p>\n<p>duty. Later, the salary of Lecturers were revised by the Government as<\/p>\n<p>per Ext.P2 order dated 16.6.2000 with retrospective effect from 1.1.1996.<\/p>\n<p>On a clarification sought as to whether the writ petitioners and other<\/p>\n<p>similarly placed persons were entitled to the revised salary payable under<\/p>\n<p>Ext.P2, the Government clarified that the existing Lecturers who were<\/p>\n<p>appointed on contract basis may be terminated and reappointed on contract<\/p>\n<p>basis with effect from 16.6.2000 so that they can draw the revised salary.<\/p>\n<p>The writ petitioners and others moved the Government by filing Ext.P5<\/p>\n<p>representation claiming revised pay. The Government, by Ext.P6 order,<\/p>\n<p>issued further clarification regarding payment of salary to doctors who<\/p>\n<p>were appointed on contract basis. Feeling aggrieved by the omission of<\/p>\n<p>the Government to pay salary at the revised rate, the Writ Petition was<\/p>\n<p>filed seeking appropriate reliefs. The respondents in the Writ Petition who<\/p>\n<p>are the appellants herein resisted the prayers in the Writ Petition by filing a<\/p>\n<p>counter affidavit. But, the learned Single Judge, after hearing both sides,<\/p>\n<p>allowed the Writ Petition. Hence, this appeal by the official respondents.<\/p>\n<p>       3.  The learned Government Pleader, referring to the terms of<\/p>\n<p>Ext.P2, especially the one regarding deposit of arrears in the Provident<\/p>\n<p>Fund account of the incumbents, submitted that it is meant to apply for<\/p>\n<p>regular hands only.   Once a person is appointed on contract basis, he is<\/p>\n<p><span class=\"hidden_text\">W.A. NO. 1267\/2009                     3<\/span><\/p>\n<p>entitled to get salary only at the rates provided in the appointment order.<\/p>\n<p>Relying on the decision of the Full Bench of this Court in <a href=\"\/doc\/947686\/\">State of Kerala<\/p>\n<p>v. Philomina<\/a> (2008(1) K.L.T. 666(F.B.)), it is submitted that unless there<\/p>\n<p>are express provisions in the orders regarding grant of financial benefits,<\/p>\n<p>the courts should not order payment of additional emoluments which will<\/p>\n<p>cause great financial commitment to the State.<\/p>\n<p>       4. On a query made by this Court, the learned Government Pleader<\/p>\n<p>submitted that the respondents were appointed under Rule 9A of Part II of<\/p>\n<p>the Kerala State and Subordinate Services Rules, 1958 (hereinafter<\/p>\n<p>referred to as &#8220;the Rules&#8221;).\n<\/p>\n<\/p>\n<p>       5. The opening paragraph of Ext.P1 appointment order reads as<\/p>\n<p>follows:\n<\/p>\n<\/p>\n<blockquote><p>                    &#8220;The following candidates are appointed<br \/>\n             on contract basis as Lecturers on Rs.2200 &#8211; 4000<br \/>\n             plus   other   allowances     admissible   in   the<br \/>\n             department noted against their names for a period<br \/>\n             of one year from the date of their joining duty on<br \/>\n             the specific condition that, their services will be<br \/>\n             terminated as and when candidates advised by<br \/>\n             Kerala Public Service Commission\/Employment<br \/>\n             Exchange join duty.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.A. NO. 1267\/2009                     4<\/span><\/p>\n<p>Going by the above appointment order, we are of the view that the<\/p>\n<p>appointment has been made under Rule 9(a)(i) of the Rules. It can never<\/p>\n<p>be treated as an appointment under Rule 9A of the Rules which reads as<\/p>\n<p>follows:\n<\/p>\n<\/p>\n<blockquote><p>                  &#8220;9A. Appointment by agreements.&#8211; (1)<br \/>\n            When in the opinion of the State Government<br \/>\n            special provisions inconsistent with any of these<br \/>\n            rules or of any other rules made under the proviso<br \/>\n            to Article 309 of the Constitution of India or<br \/>\n            continued by Article 313 of that Constitution<br \/>\n            (hereinafter referred to in this rule as the said<br \/>\n            rules) are required in respect of conditions of<br \/>\n            service, pay and allowances, pension, discipline<br \/>\n            and conduct with reference to any particular post,<br \/>\n            or any of them, it shall be open to the State<br \/>\n            Government to make an appointment to such post<br \/>\n            otherwise than in accordance with these rules or<br \/>\n            the said rules and to provide by agreement with<br \/>\n            the person so appointed for any of the matters in<br \/>\n            respect of which      in the opinion of the State<br \/>\n            Government special provisions are required to be<br \/>\n            made and to the extent to which such provisions<br \/>\n            are made in the agreement, nothing in these rules<br \/>\n            or the said rules shall apply to any person so<br \/>\n            appointed in respect of any matter for which<br \/>\n            provision is made in the agreement.\n<\/p><\/blockquote>\n<blockquote><p>                  Provided that in every agreement made in<br \/>\n            exercise of the power conferred by this rule it<br \/>\n            shall further be provided that in respect of any<br \/>\n            matter in respect of which no provision has been<br \/>\n            made in the agreement the provisions of these<br \/>\n            rules or of the said rules shall apply.\n<\/p><\/blockquote>\n<blockquote><p>                  (2) A person appointed under sub-rule (1)<\/p>\n<p><span class=\"hidden_text\">W.A. NO. 1267\/2009                     5<\/span><\/p>\n<p>              shall not be regarded as a member of the service<br \/>\n              in which the post to which he is appointed       is<br \/>\n              included and shall not be entitled by reason only<br \/>\n              of such appointment to any preferential claim to<br \/>\n              any other     appointment in that or any other<br \/>\n              service.&#8221;\n<\/p><\/blockquote>\n<p>A reading of the above rule shows that the appointment of the respondents<\/p>\n<p>can never be under the said rule. Rule 9(a)(i) of the Rules reads as<\/p>\n<p>follows:\n<\/p>\n<\/p>\n<blockquote><p>                   &#8220;9.Temporary appointments.&#8211;(a) (i) Where<br \/>\n              it is necessary in the public interest, owing to an<br \/>\n              emergency which has arisen to fill immediately a<br \/>\n              vacancy in a post borne on the cadre of a service,<br \/>\n              class or category and there would be undue delay<br \/>\n              in making such appointment in accordance with<br \/>\n              these rules and the Special Rules, the appointing<br \/>\n              authority may appoint a person, otherwise than in<br \/>\n              accordance with the said rules, temporarily.&#8221;\n<\/p><\/blockquote>\n<p>In fact, the present appointment is made otherwise than in accordance with<\/p>\n<p>Rules, as contemplated under Rule 9(a)(i) of the Rules. Therefore, by<\/p>\n<p>virtue of Rule 9(a)(v), the incumbents are entitled to get the minimum pay<\/p>\n<p>in the scale of pay applicable to regular incumbents in that post. Rule 9(a)<\/p>\n<p>(v) reads as follows:\n<\/p>\n<\/p>\n<blockquote><p>                     &#8220;There shall be paid to a person appointed<br \/>\n              under clause (i) or clause (ii) the minimum pay in<\/p>\n<p><span class=\"hidden_text\">W.A. NO. 1267\/2009                     6<\/span><\/p>\n<p>             the time-scale of pay applicable to such service,<br \/>\n             class or category.&#8221;\n<\/p><\/blockquote>\n<p>In this case, the respondents were paid the minimum salary in the scale of<\/p>\n<p>pay of Rs.2,200 &#8211; 4000\/- plus other allowances, as it was the scale of pay<\/p>\n<p>applicable to regular hands at the relevant time. Since the pay was revised<\/p>\n<p>with retrospective effect, by operation of the above statutory rule, the<\/p>\n<p>respondents are entitled to get salary in the revised pay scale at its<\/p>\n<p>minimum. In view of the above legal position, we find nothing wrong<\/p>\n<p>with the direction of the learned Single Judge.<\/p>\n<p>      The Writ Appeal is accordingly dismissed. The appellants are given<\/p>\n<p>one month&#8217;s time from today to implement the direction issued by the<\/p>\n<p>learned Single Judge.\n<\/p>\n<\/p>\n<p>                                     (K.
