Dave, J.) on 11.1.2008 had passed the<br \/>\n\tfollowing order:-\n<\/p>\n<p> \tMr.\n<\/p>\n<p>Ashish Dagli, learned advocate for the petitioner,  submits  that the<br \/>\npetitioner is ready and willing to deposit 25%  of the approximated<br \/>\namount of Rs.27,99,037\/- (Rupees Twenty Seven Lac Ninety Nine<br \/>\nThousand and Thirty Seven only) with Deputy General Manager, Region<br \/>\nOffice  of the respondent Corporation at Rajkot on or before<br \/>\n18.01.2008.\n<\/p>\n<p>\tUpon<br \/>\nthe above  statement, ad-interim relief in terms of para 7{E}<br \/>\ntill then.\n<\/p>\n<p>\tIn<br \/>\n\tcase, if the petitioner fails to deposit  25% of the above-mentioned<br \/>\n\tamount on or before 18.01.2008,  this ad-interim relief shall stand<br \/>\n\tvacated.  Direct service is permitted.\n<\/p>\n<p>Thereafter<br \/>\n\ton 17.1.2008, the following order was passed:-\n<\/p>\n<p> \t\tHeard<br \/>\nMr. A.M.Dagli, learned counsel for the petitioner. He has drawn<br \/>\nattention of this Court to the figure mentioned in the order dated<br \/>\n11.1.2008. In absence of the counsel appearing for the other side, it<br \/>\nwill not be either proper or justified for this Court to correct the<br \/>\nfigure mentioned in the above order, because, it would be a<br \/>\nsubstantive deduction. Therefore, before passing orders under Note<br \/>\nfor Speaking to Minutes, it would be in the interest of justice to<br \/>\nextend the date of payment fixed by the Court vide order dated 11th<br \/>\nJanuary, 2008.\n<\/p>\n<p>\t\tIt<br \/>\n\tis therefore directed that the petitioner can pay 25% amount on or<br \/>\n\tbefore 22nd January, 2008 instead of 18th<br \/>\n\tJanuary, 2008. By that time,  the Court will be able to ascertain<br \/>\n\tand decide the exact amount which is required to be paid under the<br \/>\n\tScheme floated by the Gujarat State Financial Corporation.  The<br \/>\n\tmatter is adjourned to 18th January, 2008. The matter be<br \/>\n\tlisted in the Ist Board. Direct service is permitted.\n<\/p>\n<p>The<br \/>\n\torder was thereafter further passed on 18.1.2008 below note for<br \/>\n\tspeaking to minutes as under:-\n<\/p>\n<p> \tHeard<br \/>\nMr. Asish Dagli, learned counsel for the petitioner.\n<\/p>\n<p>\tIn<br \/>\n\tthe background of the order passed by this Court on 11th<br \/>\n\tJanuary, 2008, Mr. Devang D. Trivedi, learned counsel appearing for<br \/>\n\tthe respondent Corporation is present. He fairly concedes on<br \/>\n\tinstructions that the amount of Rs.12,10,438\/- ought to have been<br \/>\n\tmentioned in the order in stead of Rs.27,99,037\/-. Therefore, the<br \/>\n\torder passed by this Court on 11th January, 2008 be read<br \/>\n\tand construed accordingly. Now, the petitioner is entitled to pay<br \/>\n\t25% of the amount of Rs.12,10,438\/-  to the respondent Corporation<br \/>\n\tin compliance of the Scheme adopted by the petitioner. Copy of this<br \/>\n\torder be placed in the proceedings of Special Civil Application No.<br \/>\n\t350 of 2008. This order may be conveyed to the concerned authority<br \/>\n\tby the learned counsel for the respondent GSFC, who is present in<br \/>\n\tthe Court. Note for speaking to minutes filed by the petitioner is<br \/>\n\tdisposed of accordingly. The main matter be listed for admission<br \/>\n\thearing on 30th January, 2008.\n<\/p>\n<p>As<br \/>\n\ta consequence thereof the petitioner has deposited 25% of<br \/>\n\tRs.12,10,438\/-, which has already been deposited.  It further<br \/>\n\tappears that pending the petition, the respondent Corporation had<br \/>\n\tprocessed the application of the petitioner for One-Time Settlement<br \/>\n\tand as per the respondent Corporation vide letter dated 31.5.2008<br \/>\n\tthe petitioner was called upon to make payment of Rs.24,51,916\/- in<br \/>\n\tfour equal instalments of Rs.6,12,980\/-, which would have become<br \/>\n\tpayable by June, July, August and September, 2008.  It is the case<br \/>\n\tof the respondent Corporation that the communication was forwarded<br \/>\n\tto the petitioner, however, postal endorsement has returned back<br \/>\n\twith the remarks.  As per the petitioner since he is not residing at<br \/>\n\tRajkot, the communication was not received. Be that as it may, the<br \/>\n\tlearned Counsel for the petitioner, under the instructions to his<br \/>\n\tclient, states that the petitioner is ready to pay the outstanding<br \/>\n\tamount of Rs.24,51,917\/- as per the communicated dated 31.5.2008 and<br \/>\n\tis also further ready to pay the interest at the rate of 12% p.a.<br \/>\n\tfor the delay in payment of the amount.\n<\/p>\n<p>Mr.Trivedi,<br \/>\n\tlearned Counsel for the respondent Corporation, states that as such<br \/>\n\tthe Corporation is charging 3% additional penal interest, but if<br \/>\n\tthis Court so directs, the payment can be accepted.\n<\/p>\n<p>Mr.Dagli,<br \/>\n\tlearned Counsel for the petitioner further contended that after the<br \/>\n\tCorporation took over the possession of the property, thefts have<br \/>\n\ttaken place and, therefore, some officer of the Corporation may be<br \/>\n\tdirected to inquire into the matter and if ultimately it is found<br \/>\n\tthat there is default on the part of the officers of the Corporation<br \/>\n\tor the security agency engaged by the Corporation, relaxation may be<br \/>\n\tgiven in payment of One-Time Settlement and after the payment is<br \/>\n\tmade by the petitioner, the property may be returned to the<br \/>\n\tpetitioner.\n<\/p>\n<p>Mr.Trivedi,<br \/>\n\tlearned Counsel for the respondent Corporation states that the<br \/>\n\tCorporation can inquire into the matter, if it is so directed by<br \/>\n\tthis Court.\n<\/p>\n<p>It<br \/>\n\tappears that if there are thefts of the machineries after the<br \/>\n\tCorporation took over the possession, it will be required for the<br \/>\n\tCorporation to inquire into the matter and if any loss is caused on<br \/>\n\taccount of the thefts due to laxity on the part of the Corporation<br \/>\n\tor its officer(s), including the security agency it would be<br \/>\n\trequired for the Corporation to take corrective measure and also to<br \/>\n\tmake good the loss, if any, caused to the petitioner.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid, I find that the following directions shall<br \/>\n\tmeet with the ends of justice:-\n<\/p>\n<p>(a)\t\tThe<br \/>\n\tpetitioner shall abide by the declaration made of paying the amount<br \/>\n\tby four equal instalments of Rs.6,12,980\/- each, the first<br \/>\n\tinstalment by 31st October, 2008 and thereafter, on every<br \/>\n\tnext three months, and the last instalment on of before 31st<br \/>\n\tJanuary, 2009.  The interest for the delayed payment on the basis of<br \/>\n\tthe communication dated 31.5.2008 shall be additionally paid by the<br \/>\n\tpetitioner to the Corporation on or before 28.2.2009.  It is also<br \/>\n\tobserved and clarified that in the event there is failure on the<br \/>\n\tpart of the petitioner to pay any of the instalments, it would be<br \/>\n\topen to the Corporation to sell the property by following the<br \/>\n\tprocedure in accordance with law.  However, if the amount if fully<br \/>\n\tpaid by the petitioner to the respondent Corporation as per earlier<br \/>\n\tdirection, the respondent Corporation within two weeks from the full<br \/>\n\tpayment of the amount, as indicated hereinabove, shall entrust the<br \/>\n\tpossession of the property to the petitioner by drawing proper<br \/>\n\tpanchnama.\n<\/p>\n<p>(b)\t\tIt<br \/>\n\tis also observed that the petitioner shall be at liberty to make<br \/>\n\trepresentation to the Corporation for the loss caused to him on<br \/>\n\taccount of the alleged thefts, after the Corporation took over the<br \/>\n\tpossession, within a period of four weeks from today.  Such<br \/>\n\trepresentation shall be examined and decided by the General Manager<br \/>\n\tof the respondent Corporation within a period of three months from<br \/>\n\tthe date of receipt of the representation.  If it is found that<br \/>\n\tthere was any laxity on the part of the officer(s) of the<br \/>\n\tCorporation or the security agency, the amount shall be quantified<br \/>\n\tand the petitioner shall be returned the said amount. In the event<br \/>\n\tthe officer(s) of the respondent Corporation finds that there was no<br \/>\n\tlaxity or callous approach on the part of the officer(s) of the<br \/>\n\tCorporation, including the security agency, and the representation<br \/>\n\tof the petitioner  is not accepted, the petitioner may have the<br \/>\n\tremedy in accordance with law.\n<\/p>\n<p>(c)\t\tIt<br \/>\n\tis also clarified that the pendency of the representation or the<br \/>\n\torder passed therein shall not operate as a bar for implementation<br \/>\n\tof the earlier directions and the petitioner shall be required to<br \/>\n\tmake payment as per the declaration made and recorded hereinabove<br \/>\n\tand directed accordingly.\n<\/p>\n<p>\tThe<br \/>\n\tpetition is disposed of in terms of the aforesaid directions.<br \/>\n\tDirect service is permitted.\n<\/p>\n<pre>29.9.2008\t\t\t\t\t\t(Jayant\nPatel, J.)\n \n\n\nvinod\n\n    \n\n \n\t   \n      \n      \n\t    \n\t\t   \u00a0\u00a0\u00a0\n\t   \n      \n\t  \t    \n\t\t   Top\n\t   \n      \n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Kaushikbhai vs Gujarat on 29 September, 2008 Author: Jayant Patel,&amp;Nbsp;
