2. This appeal is filed one Asha seeking
\nenhancement of pclomperlsatiorl  her death by
\nchallenging j_. “the 5lT:.’ .._;’1logy;-11,:  illhxrard passed in<\/p>\n
Mvc.Nq..14t54~,’.:;’oos_c1atc\u00a21  by MACT, Mangalore.<\/p>\n
3. The ‘1*e_levar1t fa’ots.–  case are that on 17.10.2003<\/p>\n
the deceased Ashauras going in a motor cycle bearing No.KA–<\/p>\n
  _\ufb01fro_rn Mandya towards Gulikoppal as a pillion<\/p>\n
 theyewere near Chikka Mandya. a bus bearmg<\/p>\n
No.KA–2__140\u00a7}57 came in a rash and negligent manner and<\/p>\n
 :”‘dAasphed*a:gair1st the motorcycle. As a result, she fell down<\/p>\n
0’ and sustained grievous injuries and she was shifted to<\/p>\n
   3.\/\u00ab’~%\u00e91ndya General Hospital, Mandya where she d1ed. Imually<\/p>\n
her parents \ufb01led the claim petition seeking compensation on<\/p>\n
account of her death. 1%
\n\/.\n<\/p>\n<\/p>\n
4. After service of notice from the Tribunal, respondent
\nNo.2 appeared and contested the matter. Based on the<\/p>\n
evidence produced, the Tribunal awarded cornpensation\u00bb of<\/p>\n
Rs.1,64,000\/- with interest at 8% p.a from <\/p>\n
petition till realization. Subsequent to the displofsalfo:ffi’thefts M<\/p>\n
claim petition the father of the decea’s’eti\u00abwh*o <\/p>\n
No. 1 died and thereafter the mother of the decleaseid <\/p>\n
this appeal seeking enhancerneritvppof_cornpei:isation.V”‘~,””  <\/p>\n
5. We have heard  the appellant
\nand learned couns-\u00a7el.__for :.he”re\u00a7\u00e9po_naf\u00a2n;,  ..  ” if<\/p>\n
6. Itfis V’ of the appellant that in the<\/p>\n
instant casethe deceased  aged 28 years and her mother<\/p>\n
 was  48 yearsat the time of \ufb01ling of the claim petition.<\/p>\n
 ..deceaSe-rihevas working in a printing press and was<\/p>\n
 la Rs.4:OO0\/-p.in. However, the Tribunal<\/p>\n
V . has the notional income at Rs.2000\/- which is<\/p>\n
 .rnea.ger. “$he further submits that the award made on the<\/p>\n
 e._ccnVentional heads are also on the lower side and therefore<\/p>\n
   appeal be allowed by enhancing compensation.<\/p>\n
\ufb01e.\n<\/p>\n<\/p>\n
7. Having heard the counsel and on perusal of the
\nmaterial on record, it is evident that the deceased was not<\/p>\n
married and she was working in a printing press and though<\/p>\n
her income was stated to be Rs.4000\/–p.m, there<\/p>\n
corroborative evidence in that regard. However, we xthatj’ it<\/p>\n
the Tribunal has assessed the notional’ inconie at  V<\/p>\n
p.m which is on the lower side. We therefore.._.as,sess.:the’3<\/p>\n
notional income at Rs.3000\/ lconsidgerfingi ‘fact \u00b0<\/p>\n
that she was not married, 50% .is–.deducted*vtowa\u00a71*ds her
\npersonal expenses and “4’lteepirigE*\u00bbigI71  ‘the age of the<\/p>\n
mother as 48 years the  that would be<\/p>\n
applicablemlisi’  ejor\ufb01pens\u00e9tib\ufb01 of Rs. 2.34.000\/– is
\nawardedxg in  a sum of Rs.30.000\/~ is<\/p>\n
awarded towards. conventional heads. thereby making the<\/p>\n
“V”\u00ab..tAota-lid’ \u20ac;o:Iripensation~—-\u00ab’V at Rs.2,64,000\/– instead of<\/p>\n
  ;:awarded by the Tribunal. The enhanced<\/p>\n
cornpensatiioiri shall carry interest at the rate 6% p.a from the<\/p>\n
‘gudate ofpetition till realization.\n<\/p>\n
‘  8.; Out of the enhanced compensation 60% of the same.<\/p>\n
