Prem Kumar,<br \/>\n                                             BE-360, Lane-I, Hari Nagar,<br \/>\n                                             Delhi-110064.\n<\/p>\n<pre>Respondent 1                         :       PIO,\n                                             Municipal Corporation of Delhi,\n                                             Karol Bagh Zone, Anand Parbat,\n                                             Delhi.\n\nRTI application filed on             :       29\/08\/2007\nPIO replied                          :       14\/09\/2007\nFirst appeal filed on                :       29\/10\/2007\nFirst Appellate Authority order      :       29\/11\/2007\nSecond Appeal filed on               :       20\/03\/2008\n\nInformation Sought:\n<\/pre>\n<p>The Appellant had filed an application seeking information in respect of the deceased<br \/>\npensioner &#8220;Late Natho Devi&#8221;. The information sought as under:\n<\/p>\n<p>   1. Why the Dept. failed to fix pension and with held all retrial benefits at the time of her<br \/>\n       retirement?\n<\/p>\n<p>   2. Why the same was denied during her life time i.e. upto three years beyond the date of<br \/>\n       superannuation?\n<\/p>\n<p>   3. Why the Dept. failed to account for such benefits to the LRs of the deceased<br \/>\n       employee and the reason thereof despite elapse of three consequential years from the<br \/>\n       day of death of ex-employee?\n<\/p>\n<p>   4. What is the progress of above said matter?\n<\/p>\n<p>The appellant was not satisfied with the cursory reply given by the PIO, hence he filed a First<br \/>\nappeal.\n<\/p>\n<p>The First Appellate Authority Ordered by his order no. 576 on 22\/11\/2007:<br \/>\n&#8220;From the perusal of the reply furnished by the PIO it is apparent that a halfhearted attempt<br \/>\nhas been made to furnish the reply. The PIO is directed to furnish the requisite categorical<br \/>\nreply within 15 days from the receipt of this order and also look into the grievances of the<br \/>\nAppellant personally.&#8221;\n<\/p>\n<p>Since the PIO did not furnish the information even after the specific order of the First<br \/>\nAppellate authority, the appellant filed a second appeal.<br \/>\nDecision:\n<\/p>\n<p>The appeal is allowed.\n<\/p>\n<p>The complete information will be sent to the appellant before 5 January, 2008.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information<br \/>\nby the PIO within 30 days as required by the law.\n<\/p>\n<p> It also appears that the First appellate authority&#8217;s orders have not been implemented. From<br \/>\nthe facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying<br \/>\nwithin 30 days, as per the requirement of the RTI Act. He has further refused to obey the<br \/>\norders of his superior officer, which raises a reasonable doubt that the denial of information<br \/>\nmay also be malafide. The First Appellate Authority has clearly ordered the information to be<br \/>\ngiven. .\n<\/p>\n<p>It appears that the PIO&#8217;s actions attract the penal provisions of Section 20 (1) . A showcause<br \/>\nnotice is being issued to him, and he is directed give his reasons to the Commission to show<br \/>\ncause why penalty should not be levied on him.\n<\/p>\n<p>He will give his written submissions showing cause why penalty should not be imposed on<br \/>\nhim as mandated under Section 20 (1) before January, 2009.
