Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                The petitioner is apprehending his arrest in connection<\/p>\n<p>                    with Dhamdaha P.S. Case No. 35 of 2010, registered under Sections<\/p>\n<p>                    147, 148, 149, 447, 324 and 307 of the Indian Penal Code.<\/p>\n<p>                                There is allegation against the petitioner that he was a<\/p>\n<p>                    member of the mob in which one Bijendra Yadav alleged to have<\/p>\n<p>                    shot arrow towards Manoj Yadav which caused injury.<\/p>\n<p>                                Learned counsel for the petitioner submits that there is<\/p>\n<p>                    not mentioned the petitioner name as member of unlawful assembly,<\/p>\n<p>                    but specific overt act against the petitioner. It is further submitted<\/p>\n<p>                    that co-accused Bijendra Yadav has been granted regular on similar<\/p>\n<p>                    footing.\n<\/p>\n<p>                                Having regard to the facts and circumstances, I am not<\/p>\n<p>                    inclined to grant bail to the petitioner. However, if the petitioner<\/p>\n<p>                    surrender and prayed for regular bail that may be considered without<\/p>\n<p>                    being prejudiced by this order as per in case of Bijendra Yadav on<\/p>\n<p>                    the same day.\n<\/p>\n<p>                                Let copy of this order be sent to the court below through<\/p>\n<p>                    FAX at the cost of the petitioner.\n<\/p>\n<\/p>\n<pre>           m.p.
