RADHAKRISHNAN,J.\n         ...................................................................\n                      WP(C) NO. 1353 of 2008\n                     .........................................\n\n             Dated this the 8th day of April, 2010\n\n                             J U D G M E N T\n<\/pre>\n<p>     The petitioner and respondents 4 and 5 are High<\/p>\n<p>School Assistants (Maths) in SN Trust Higher Secondary<\/p>\n<p>School.    According to the petitioner, she is senior to<\/p>\n<p>respondents 4 and 5, but she has been retrenched as an<\/p>\n<p>excess. Certain controversies had also arisen relating to the<\/p>\n<p>alleged appointment of the fourth respondent, Smt. R.<\/p>\n<p>Renju. She carried that issue to the Government and it is<\/p>\n<p>pending at that end as a revision petition. The plea of the<\/p>\n<p>petitioner against the retrenchment is based on issues of<\/p>\n<p>facts which have to be ultimately answered by the statutory<\/p>\n<p>authority in terms of the Kerala Education Act,1958 and the<\/p>\n<p>Kerala Education Rules, 1959. The petitioner has alternate<\/p>\n<p>efficacious remedy by filing a revision before the<\/p>\n<p>Government.        Therefore, though this writ petition was<\/p>\n<p>admitted in January 2008, having regard to the fact that a<\/p>\n<p>WP(C) NO. 1353 of 2008<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>revision is now pending with the Government, I am inclined<\/p>\n<p>to relegate the petitioner to the Government itself; more so<\/p>\n<p>because of the disputed questions of facts arising for<\/p>\n<p>decision in the petitioner&#8217;s case.\n<\/p>\n<p>      Therefore, it is ordered that if the petitioner files a<\/p>\n<p>revision before the Government within two weeks from the<\/p>\n<p>date of receipt of a copy of this judgment, the Government<\/p>\n<p>will consider such revision in accordance with law. Let final<\/p>\n<p>decision be taken by the Government within a period of four<\/p>\n<p>months since the petitioner stands retrenched.          It is<\/p>\n<p>clarified that nothing      is stated on merits in this writ<\/p>\n<p>petition.         The Government will ensure that necessary<\/p>\n<p>parties are given notice and are provided sufficient<\/p>\n<p>opportunity of being heard in relation to the matter.
