Basheer, J.\n\n                 - - - - - - - - - - - - - - - - - - - - - - - - -\n\n                     Crl.M.C.No. 4252 of 2003-B\n\n                 - - - - - - - - - - - - - - - - - - - - - - - - - -\n\n              Dated this the 26th day of March, 2008.\n\n                                    ORDER\n<\/pre>\n<p>       Sri.K.Ramakumar, learned senior counsel submits that the<\/p>\n<p>prosecution launched by respondent No.1 against petitioners under<\/p>\n<p>Annexure A complaint is wholly incompetent and without<\/p>\n<p>jurisdiction. He contends that section 95 of the Co-operative<\/p>\n<p>Societies&#8217; Act is an embargo and interdiction in proceeding against<\/p>\n<p>the petitioners. According to the learned senior counsel, petitioners<\/p>\n<p>are prepared to take up this contention before the trial court. He<\/p>\n<p>further submits that petitioners may be permitted to withdraw this<\/p>\n<p>Crl.M.C with liberty to raise the above and all other contentions<\/p>\n<p>available to them. The limited prayer is to issue a direction to the<\/p>\n<p>trial court to decide the question of maintainability of the complaint<\/p>\n<p>as a preliminary point. He further prays that till such a decision on<\/p>\n<p>the question of maintainability of the complaint is taken by the trial<\/p>\n<p>court, all further action in the matter may be directed to be kept in<\/p>\n<p>abeyance.\n<\/p>\n<p>       Having regard to the facts and circumstances, the prayer as<\/p>\n<p>made above is allowed. Crl.M.C is dismissed as withdrawn in the<\/p>\n<p>above terms. The court below shall decide the question of<\/p>\n<p>maintainability as a preliminary point, if such a contention is raised<\/p>\n<p>by the petitioners. It is made clear that I have not considered the<\/p>\n<p>merit of any of the contentions raised by the petitioners.<\/p>\n<p>                                                                   A.K.
