C. Kodekar, learned Additional Public Prosecutor, appears and<br \/>\nwaives service of notice of Rule on behalf of the opponent- State of<br \/>\nGujarat.\n<\/p>\n<p>\t\tHaving<br \/>\nregard to the facts of the case, the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p>2.\t\tThe<br \/>\npresent application has been filed by the applicant-wife for grant of<br \/>\nparole for a period of four weeks to the convict prisoner ?  Vibha @<br \/>\nBhuriyo Popatbhai Bharwad, who has been convicted for the offences<br \/>\nunder Sections 302, 307, 397 and 423 by the judgement and order dated<br \/>\n27th January, 1997 in Sessions Case No.44 of 1995 by the<br \/>\nAdditional Sessions Court, Bharuch and is sentenced to<br \/>\nimprisonment for life.\n<\/p>\n<p>3.\t\tHeard<br \/>\nMs. K. D. Parmar, learned Advocate for the applicant, and Mr. R. C.<br \/>\nKodekar, learned Additional Public Prosecutor for the opponent-State<br \/>\nof Gujarat. Ms. K. D. Parmar has submitted that as the wife of the<br \/>\nconvict prisoner is required to undergo the operation for<br \/>\nhysterectomy, which is scheduled to be held on 20th May,<br \/>\n2008, and the presence of the convict prisoner is necessary, the<br \/>\nparole may be granted. On the other hand, Mr. R. C. Kodekar has<br \/>\nsubmitted that the convict prisoner has been absconding for about<br \/>\n1534 days and looking to the antecedents, the impugned order is<br \/>\njustified. However, Mr. Parmar has submitted that thereafter, the<br \/>\nconvict prisoner has been granted parole on five or six occasions and<br \/>\nhe has reported in time and no untoward incident is reported. Mr.<br \/>\nKodekar has submitted that on all such occasions of granting the<br \/>\nparole, there was justifiable reasons. It is stated that the appeal,<br \/>\nbeing Criminal Appeal No.225 of 1997, has also been dismissed vide<br \/>\norder dated 17th February, 2005. As against that, Ms.<br \/>\nParmar submitted that the convict prisoner has not filed any further<br \/>\nproceedings before the Honourable Supreme Court challenging the<br \/>\njudgement and order dated 17th February, 2005 in Criminal<br \/>\nAppeal No.225 of 2007.\n<\/p>\n<p>4.\t\tThis<br \/>\nCourt has considered the submissions advanced by the learned<br \/>\nAdvocates for the parties and have gone through the application and<br \/>\nthe supporting documents that form part of the application.  This<br \/>\nCourt has also gone through the jail remarks sheet submitted by the<br \/>\nlearned Additional Public Prosecutor.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the rival submissions, though the convict prisoner has<br \/>\nabsconded for 1534 days, but, thereafter, on genuine ground, he was<br \/>\nenlarged on parole. However, in view of the ground mentioned about<br \/>\noperation of the wife, which is scheduled to be held on 20th<br \/>\nMay, 2008, this Court is of the opinion that if the convict prisoner<br \/>\nis granted parole for a period of 7 days from the date of his actual<br \/>\nrelease, it would meet the ends of justice.\n<\/p>\n<p>6.\t\tFor<br \/>\nthe foregoing reasons, the application succeeds in part.<br \/>\nAccordingly, it is partly allowed. The convict prisoner ?  Vibha @<br \/>\nBhuriyo Popat Bharvad is ordered to be released on parole for a<br \/>\nperiod of 7 days from the date of his actual release on usual terms<br \/>\nand conditions. The convict prisoner shall surrender to the jail<br \/>\nauthority on completion of 7 days from the date of his release<br \/>\nwithout fail.  During the period of parole, the convict prisoner<br \/>\nshall not abuse the liberty granted to him and shall maintain law and<br \/>\norder.  Rule is made absolute accordingly to the aforesaid extent.<br \/>\nDirect Service is permitted.\n<\/p>\n<p>[R.\n<\/p>\n<p>H.
