(ORAL)\n<\/pre>\n<p>          This revision petition is directed against the order dated<\/p>\n<p>25.4.2005, passed by the learned Executing Court, vide which the<\/p>\n<p>property of the judgment-debtor was ordered to be attached for recovery<\/p>\n<p>of the balance decretal amount, amounting to Rs.24,927\/- (Rupees<\/p>\n<p>twenty four thousand nine hundred twenty seven only).<\/p>\n<p>          The respondent-decree-holder had moved an application for<\/p>\n<p>execution, claiming therein that the total decretal amount was not paid,<\/p>\n<p>as the State was insisting on adjusting the payment towards principal<\/p>\n<p>first and then interest, whereas the amount towards interest was to be<\/p>\n<p>adjusted first and thereafter towards principal.<\/p>\n<p>          The learned Executing Court, therefore, by way of order dated<\/p>\n<p>15.11.2003 directed the petitioners herein to recalculate the amount paid<\/p>\n<p>by them by first adjusting it towards principal and then towards interest,<\/p>\n<p>and the case was adjourned to 5.1.2004, for the said purpose.<br \/>\n Civil Revision No. 4043 of 2005<br \/>\n<span class=\"hidden_text\">                                                                           -2-<\/span><\/p>\n<p>          However, in pursuance to the order passed, the petitioners<\/p>\n<p>chose not to file any calculation. The calculations filed by the decree-<\/p>\n<p>holder showed that an amount of Rs.24,927\/- (Rupees twenty four<\/p>\n<p>thousand none hundred twenty seven only) was still due under the<\/p>\n<p>decree.   The warrant of attachment was ordered for recovery of<\/p>\n<p>Rs.24,927\/- (Rupees twenty four thousand none hundred twenty seven<\/p>\n<p>only), on 6.1.2004.\n<\/p>\n<p>          On 11.2.2005, the petitioner-judgment-debtors again moved an<\/p>\n<p>application, claiming therein that the total decretal amount stood paid.<\/p>\n<p>          The application was rejected by passing the following order:<\/p>\n<p>          &#8220;After hearing the Ld. counsel for the DH Claimant and<br \/>\n          Shri Dunni Chand on behalf of the JD and from perusal<br \/>\n          of the record, it is revealed that my predecessor Shri<br \/>\n          S.M.S. Mahal, the then Ld. Addl. District Judge in his<br \/>\n          order dated 6.1.2004 passed a categorical order that<br \/>\n          Rs.24,927\/- remains due from the JDs and accordingly<br \/>\n          warrants of attachment of the property of the JD<br \/>\n          regarding the payment of Rs.24,927\/- were ordered to<br \/>\n          be issued against the JD. From the record it is revealed<br \/>\n          that no amount has been paid by the JD so far after<br \/>\n          6.1.2004. Even from the application so moved on behalf<br \/>\n          of the JDs does not substantiate the objections which<br \/>\n          may warrant the dismissal of the execution can be<br \/>\n          gathered, nor any competent officer has come present on<br \/>\n          behalf of the JDs in this court. The oral version on<br \/>\n          behalf of the JDs that the amount has already been paid<br \/>\n          to the claimant does not make any cogent ground which<br \/>\n          may warrant the interference by way of objections in the<br \/>\n          order passed by Shri S.M.S. Mahal, the then Ld. Addl.<br \/>\n          District Judge dated 6.1.2004.          Accordingly, the<br \/>\n          objection petition on behalf of the JD is, hereby,<br \/>\n Civil Revision No. 4043 of 2005<br \/>\n<span class=\"hidden_text\">                                                                     -3-<\/span><\/p>\n<p>          dismissed. Warrant of attachment of the property of JD<br \/>\n          be issued for 25.5.2005.&#8221;\n<\/p>\n<p>          Learned Additional Advocate General, Punjab, contends that<\/p>\n<p>as per the calculations submitted by the petitioners, the total decretal<\/p>\n<p>amount stood paid, therefore, the impugned order deserves to be set<\/p>\n<p>aside.\n<\/p>\n<p>          On consideration, I find no force in the contention.      The<\/p>\n<p>learned Executing Court considered the calculations submitted by the<\/p>\n<p>State and held that the calculations could not be accepted, as the State<\/p>\n<p>had adjusted the amount first towards principal and then towards<\/p>\n<p>interest. The petitioners have failed to submit any calculation in this<\/p>\n<p>Court to justify their assertion that the total amount stood paid. The<\/p>\n<p>calculations submitted by the State were rightly rejected being not<\/p>\n<p>permissible in law.\n<\/p>\n<p>          No ground, therefore, is made out to interfere with the order<\/p>\n<p>passed.\n<\/p>\n<p>          No merit.\n<\/p>\n<p>          Dismissed.\n<\/p>\n<p>                                                 (Vinod K.
