Mithani for respondents no.3,4,<br \/>\n\tlearned Advocate Mr. Supehia for respondent NO.5 and learned AGP Ms.<br \/>\n\tSachi Mathur for respondent No.6.\n<\/p>\n<p>This application is filed by<br \/>\n\tapplicant Piyush Prabhudas Kapdi making following averments in para<br \/>\n\t11:\n<\/p>\n<p> 11.\tIt<br \/>\n\tis submitted that, therefore, interim relief granted in terms of<br \/>\n\tparagraph 21(C) of the petition may kindly be vacated in view of the<br \/>\n\tfact that Special Civil Application No. 6230\/2004 has been dismissed<br \/>\n\tvide judgment dated 27.7.2006 at Annexure  C  wherein the<br \/>\n\tworkman whose prayer for regularization etc. has been upheld by this<br \/>\n\tHon&#8217;ble Court.\n<\/p>\n<p>In para 15(A) of this application,<br \/>\n\tapplicant is praying to admit and allowing this application, by<br \/>\n\tvacating interim relief granted by this Court, in terms of paragraph<br \/>\n\t21(C),o n 18.1.2005 in Special Civil Application NO.10724\/2004; and,<br \/>\n\tfurther be pleased to direct the opponent NO.1   original<br \/>\n\tpetitioner of Special Civil Application NO.10724\/2004 to execute and<br \/>\n\timplement the order dated 11\/7.1998 passed by the Labour Court,<br \/>\n\tJunagadh vide exh.22 in ID Complaint NO.53\/1998, in the interest of<br \/>\n\tjustice.\n<\/p>\n<p>Learned Advocate Mr. Desai<br \/>\n\tappearing for applicant has admitted before this court that in<br \/>\n\tSpecial Civil Application No. 10724 of 2004, order was passed by<br \/>\n\tthis Court on 18.1.2005. Said order is, therefore, quoted as under,<br \/>\n\tbeing a by-parte order:\n<\/p>\n<p> &#8216;Leave&#8217;<br \/>\n\tto amend, to incorporate the reason as to why the petition is<br \/>\n\tfiled only on 23.08.2004 challenging the  compromise-Exhibit  22<br \/>\n\tand  order dated 11.07.1998, passed by the Labour Court,  Junagadh<br \/>\n\tin  terms  of  the settlement, which  is  at Annexure &#8216;C&#8217; to this<br \/>\n\tpetition, and also the grounds, if not elaborately taken  for  such<br \/>\n\tchallenge.    Amendment  shall  be  filed on  or  before 27.01.2005.\n<\/p>\n<p>\t2.\tThis  is  a petition wherein it is<br \/>\n\tclear from the record that at the relevant time, i.e.    11.07.1998<br \/>\n\tthe then  Chief Officer, entered into a compromise, for which prima<br \/>\n\tfacie he had no power.  It is contended on  behalf of  the<br \/>\n\tconcerned workmen that what was granted to those workmen by virtue<br \/>\n\tof that compromise was only benefit  of regularisation on the basis<br \/>\n\tof seniority, as and when the vacancy  arises  in  the  set  up  of<br \/>\n\tthe Nagarpalika and therefore  there  was  nothing  illegal  about<br \/>\n\tthe  said compromise.   Prima  facie, this may appeal to the Court.<br \/>\n\tBut then it is equally important which cannot be  ignored that  for<br \/>\n\tthe  first time these workmen complained about non compliance of the<br \/>\n\t settlement  and  the  order  dated 11.07.1998 by complaint dated<br \/>\n\t27.11.2003.  Whereas, it is the  case  of  one  of  the workmen<br \/>\n\tbeing respondent no.5 herein-Piyush Prabhudas Kapdi, who has filed<br \/>\n\taffidavit in reply affirmed on 10.12.2004 that as many as  12<br \/>\n\tpersons were   regularised   during   the   period  ranging  from<br \/>\n\t08.05.1995 to 2001.  Admittedly, the  persons  at  serial nos.9,<br \/>\n\t10,  11 and 12 were regularised subsequent to the date of<br \/>\n\tcompromise, i.e.  11.07.1998.  Despite that  fact the  respondent<br \/>\n\tworkmen    chose  to remain silent till filing of complaint on<br \/>\n\t27.11.2003.  In view of  that  the bona fides  of   the  respondent<br \/>\n\tworkmen  do not  appear to be clear.\n<\/p>\n<p>3.\tRULE.\n<\/p>\n<p>\t Interim relief in terms of para 21(c).\n<\/p>\n<p>This order passed by this Court<br \/>\n\thas been challenged by present applicant by filing Letters Patent<br \/>\n\tAppeal which has been dismissed  by Division Bench of this Court.<br \/>\n\tAgainst that, SLP (Civil) was preferred by present applicant which<br \/>\n\thas also been dismissed by apex court. Therefore, now, prayer to<br \/>\n\tvacate by-parte interim order passed by this Court which has been<br \/>\n\tconfirmed upto apex court, cannot be granted by this Court,<br \/>\n\ttherefore, request and prayer made in this application is rejected.<br \/>\n\tAccordingly, this application stands dismissed.
