With consent of the parties, the matter is<br \/>\ntaken up for hearing today.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned advocate for the applicant and learned Additional Public<br \/>\nProsecutor for the State.\n<\/p>\n<p>3.\tFollowing<br \/>\naspects are considered.\n<\/p>\n<p>3.1\tIt<br \/>\nappears that allegations are against main accused Pankaj Jakshi<br \/>\nPatel, who allegedly obtained loan on alleged forged documents.\n<\/p>\n<p>3.2\tThe<br \/>\napplicant stood as guarantor for repayment of the loan.\n<\/p>\n<p>3.3\tNo<br \/>\novert act is attributed except that he was a guarantor.\n<\/p>\n<p>4.\tConsidering<br \/>\nthe above aspects, the application deserves to be allowed.\n<\/p>\n<p>5.\tThe<br \/>\napplication is allowed and the applicant is ordered to be released on<br \/>\nbail in connection with Crime Register No.I 102 of 2009 of Mandvi<br \/>\nPolice Station on his executing a bond of Rs.10000\/- (Rupees ten<br \/>\nthousand only) with one surety of the like amount to the satisfaction<br \/>\nof the lower Court and subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tnot<br \/>\nleave India without prior permission of the Sessions Judge concerned;\n<\/p>\n<p>[e]\tfurnish<br \/>\nthe address of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p>[f]\tsurrender<br \/>\nhis passport, if any, to the Lower Court, within a week.\n<\/p>\n<p>6.\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>7.\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>8.\tRule<br \/>\nis made absolute.
