In<br \/>\npursuance of the said impugned order, the detenu is detained in<br \/>\nSub-Jail, Godhra.\n<\/p>\n<p>3.\tFrom<br \/>\nthe grounds of detention, it appears that two offences being III-CR<br \/>\nNos.5149 of 2009 and 5114 of 2009 have been registered against the<br \/>\ndetenu at Junagadh City  B  Division Police Station, under the<br \/>\nprovisions of the Bombay Prohibition Act, wherein it is alleged that<br \/>\na total quantity of 875  bottles of foreign liquor was found from the<br \/>\npossession of the detenu.  On the basis of registration of these<br \/>\ncases, the detaining authority held that the present detenu was<br \/>\ncarrying on activities of selling  liquor  which is harmful to the<br \/>\nhealth of the public.   It is held by the detaining \u00a0authority<br \/>\nthat  as  the detenu is indulged in illegal activities, it is<br \/>\nrequired to restrain the detenu from carrying on further illegal<br \/>\nactivities, i.e. selling liquor. The detaining authority has placed<br \/>\nreliance on the above registered offences and statements of unnamed<br \/>\nwitnesses. In the opinion of this Court, the activities of the detenu<br \/>\ncan, by no stretch of imagination, can be said to be disturbing the<br \/>\n public order . It is seen from the grounds that a general<br \/>\nstatement that has been made by the detaining authority that<br \/>\nconsuming liquor is injurious to health. In fact, a perusal of the<br \/>\norder passed by the detaining authority shows that the grounds which<br \/>\nare mentioned in the order are in reference to the situation of  Law<br \/>\nand order  and not  public order .  Therefore, on this ground,<br \/>\nthe subjective satisfaction arrived at by the detaining authority is<br \/>\nvitiated on account of non-application of mind and the impugned<br \/>\norder, therefore, deserves to be quashed and set aside.\n<\/p>\n<p>4.\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the detenu is carrying on activities of<br \/>\nselling country made liquor which is harmful to the health of the<br \/>\npublic. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki v.<br \/>\nPolice Commissioner, Surat<\/a> [(2001) (1) GLH 393)], having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia v. State of Bihar (AIR 1966 SC 740), this Court<br \/>\nheld that the cases wherein the detention order passed on the basis<br \/>\nof the statements of the witnesses fall under the maintenance of  law<br \/>\nand order  and not  public order .\n<\/p>\n<p>5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the  public order  and<br \/>\nit is very clear that the present case would not fall within the<br \/>\ncategory of threat to  public order .  In that view of the<br \/>\nmatter, when the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\nit cannot be sustained and, therefore, it deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this petition is allowed. The impugned order dated<br \/>\n25.7.2009 passed by respondent District Magistrate, Junagadh is<br \/>\nhereby quashed and set aside. The detenu is ordered to be set at<br \/>\nliberty forthwith, if presence of detenu is not required in any other<br \/>\noffence. Rule is made absolute accordingly.
