APP appears and waives service of rule for the<br \/>\nrespondent &#8211; State.\n<\/p>\n<p>2.\t\tConsidering<br \/>\nthe facts and circumstances of the matter and with the consent of<br \/>\nboth the sides, both these Criminal Misc. Applications are taken up<br \/>\nfor hearing and final disposal today.\n<\/p>\n<p>3.\t\tBoth<br \/>\nthese Criminal Misc. Applications are filed by the common applicant,<br \/>\nnamely Jayantibhai Savjibhai Dhol seeking permission of this Court to<br \/>\ntravel abroad for the period specified in the schedule [page 30]<br \/>\nproduced in Criminal Misc. Application No. 13376\/2011 and further<br \/>\ndirection to the concerned Passport Authority to issue passport for a<br \/>\nperiod of two years.\n<\/p>\n<p>3.\t\tPerusing<br \/>\nthe contents of both these applications, so also considering the<br \/>\nsubmissions advanced by Mr. Dagli, Ld. Advocate for the applicant, it<br \/>\ntranspires that the applicant came to be tried in Sessions Case No.<br \/>\n36\/2003 as well as Sessions Case No. 88\/2006 and at the end of the<br \/>\ntrial in both the above mentioned Sessions Cases, the applicant came<br \/>\nto be acquitted. The respondent &#8211; State challenged said<br \/>\nacquittal by preferring the above mentioned Criminal Appeals and both<br \/>\nthese appeals are pending. It is submitted that the applicant has to<br \/>\ngo abroad, namely Singapore, Thailand, South Africa, Israel, Canada<br \/>\nand America from 01\/11\/2011 to 25\/04\/2012 at the first instance, as<br \/>\nper the schedule annexed at page 30 in connection with the<br \/>\ndevelopment of agricultural work and other allied functions of the<br \/>\nAgricultural Produce Market Committee, wherein the applicant is<br \/>\nChairman. Mr. Dagli, Ld. Advocate for the applicant submitted that<br \/>\nthe instant applications are required to be preferred since the<br \/>\nacquittal appeals are pending and pursuant to the relevant<br \/>\nnotification of the Ministry of External Affairs dated 25\/8\/1993,<br \/>\nwhereby the applicant is required to produce permission order of the<br \/>\nCompetent Court to the concerned Passport Authority. Mr. Dagli<br \/>\nsubmitted that the applicant possesses movable and immovable<br \/>\nproperties and he is not likely to abscond and in past also, he<br \/>\nvisited foreign countries and returned to India.\n<\/p>\n<p>4.\t\tHeard<br \/>\nMr. Pandya, Ld. APP for the respondent &#8211; State.\n<\/p>\n<p>5.\t\tThe<br \/>\nfactual aspects contended by the applicant are not in dispute. The<br \/>\napplicant is one of the respondents in above mentioned acquittal<br \/>\nappeals and those appeals are pending. Pursuant to the above<br \/>\nmentioned notification dated 25\/8\/1993, if a proceeding in respect of<br \/>\nan offence is pending against any person and if he desires to go<br \/>\nabroad pending such proceedings, he is required to produce necessary<br \/>\norder of the Competent Court permitting him to depart from India. Mr.<br \/>\nPandya, Ld. APP drew our attention to order passed by the concerned<br \/>\nPassport Authority on 4\/7\/2011, whereby for want of such order of the<br \/>\nCompetent Court, the request made by the applicant to the concerned<br \/>\nPassport Authority came to be turned down. Mr. Dagli, Ld. Advocate<br \/>\nfor the applicant submitted that the applicant shall comply with all<br \/>\nthe directions issued by the concerned Passport Authority in the<br \/>\ncommunication dated 4\/7\/2011 and shall fulfill all such requirements.\n<\/p>\n<p>6.\t\tSeen<br \/>\nin the above context, though the request made by the applicant to<br \/>\ntravel abroad for the period of two years cannot be accepted, but the<br \/>\napplicant successfully establishes his need to go abroad in terms of<br \/>\nthe time schedule annexed at page 30 in Criminal Misc. Application<br \/>\nNo. 13376\/2011. We are, therefore, of the considered opinion that the<br \/>\napplicant should be permitted to depart from India for a period of 6<br \/>\n[six] months. It is hereby made clear that the instant permission is<br \/>\ngiven only in connection with the pending proceedings, namely the<br \/>\nabove mentioned two acquittal appeals in this Court. We are further<br \/>\nof the opinion that while granting such permission, necessary<br \/>\nconditions shall have to be laid down.\n<\/p>\n<p>7.\t\tFor<br \/>\nthe foregoing reasons, both these applications are partly allowed and<br \/>\nthe applicant is permitted to go abroad and to depart from India for<br \/>\na period of 6 [six] months hereof on the following conditions :\n<\/p>\n<p>I.\t\tThe<br \/>\napplicant shall deposit Rs.50,000\/-[Rupees fifty thousand only] in<br \/>\ncash \tbefore the concerned Sessions Court which recorded the<br \/>\nacquittal of the applicant, by way of security.\n<\/p>\n<p>II.\t\tThe<br \/>\napplicant shall produce his complete time schedule about his travel<br \/>\nto abroad before the concerned Sessions Court.\n<\/p>\n<p>III.\t\tThe<br \/>\ninstant permission as required pursuant to the notification of<br \/>\nMinistry of External Affairs dated 25\/8\/1993 is granted only in<br \/>\nconnection with the above referred two criminal acquittal appeals<br \/>\npending in this Court.\n<\/p>\n<p>IV.\t\tThe<br \/>\napplicant shall comply with all the legal requirements required for<br \/>\nhis travel to abroad including the compliance of the directions<br \/>\nissued by the concerned Passport Authority pursuant to the<br \/>\ncommunication dated 4\/7\/2011, Annexure-D in both these applications.\n<\/p>\n<p>\t\tRule<br \/>\nis made absolute accordingly.
