Ramachandra Menon, J.\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                      W.A.No. 1512 OF 2010\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n          Dated this the 22nd day of September, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>J.Chelameswar, C.J.\n<\/p>\n<p>          This appeal is preferred by respondents 1 and 3 in<\/p>\n<p>W.P.(C) No.7966 of 2010 aggrieved by an interim order dated<\/p>\n<p>03.06.2010.\n<\/p>\n<p>          2.        The     1st    respondent        herein     filed the<\/p>\n<p>abovementioned writ petition questioning the legality of certain<\/p>\n<p>orders passed by the appellant herein.              The 1st respondent<\/p>\n<p>constructed a particular building after demolishing the existing<\/p>\n<p>building on the property owned by him. The appellants passed<\/p>\n<p>the orders impugned in the writ petition. The substance of the<\/p>\n<p>order is that the construction is an illegal construction as it is<\/p>\n<p>alleged that the construction did not comply with the<\/p>\n<p>requirements of Section 220 (b) of the Kerala Panchayat Raj<\/p>\n<p>Act and subsequently action was proposed to be initiated<\/p>\n<p>against the respondents.\n<\/p>\n<p>          3. Along with the main prayer the 1st respondent<\/p>\n<p>WA No. 1512 of 2010<br \/>\n<span class=\"hidden_text\">                                     -:2:-<\/span><\/p>\n<p>sought for an interim order in the writ petition. The prayer in<\/p>\n<p>that regard is as follows:\n<\/p>\n<blockquote><p>                  &#8220;It is also just and necessary and it is also prayed for<\/p>\n<p>     accordingly that this Honourable Court may be pleased to issue<\/p>\n<p>     suitable interim directions to the 1st respondent to forthwith assign<\/p>\n<p>     number to the petitioner&#8217;s building consequent to his application,<\/p>\n<p>     pending disposal of the writ petition.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            4. The order under appeal came to be passed after<\/p>\n<p>hearing both the parties. The learned counsel for the appellant,<\/p>\n<p>Sri.Julian Xavier, argued that the interim prayer and prayer No.<\/p>\n<\/blockquote>\n<blockquote><p>(b) of the main prayers are identical and therefore the interim<\/p>\n<p>order which is the subject matter of the instant appeal could not<\/p>\n<p>have been passed.          In spite of the specific query as to the<\/p>\n<p>prejudice or irrecoverable loss that the appellant would suffer by<\/p>\n<p>complying with the interim direction, the learned counsel for the<\/p>\n<p>appellant could not point out any such prejudice or irrecoverable<\/p>\n<p>loss except asserting that it is held by the Supreme Court in<\/p>\n<p><a href=\"\/doc\/1327316\/\">P.R.Sinha v. Inder Kriwshan Raina<\/a> [(1996) 1 SCC 681],<\/p>\n<p>wherein at paragraph 6 it is stated as follows:\n<\/p><\/blockquote>\n<p>WA No. 1512 of 2010<br \/>\n<span class=\"hidden_text\">                                    -:3:-<\/span><\/p>\n<p>            &#8220;6. This Court has pointed out repeatedly that while<\/p>\n<p>     entertaining the writ petition the High Court should not pass<\/p>\n<p>     interim order, the nature of which is to grant a relief which can be<\/p>\n<p>     granted only at the final disposal of such a writ petition. Reference<\/p>\n<p>     in this connection may be made to the case of <a href=\"\/doc\/390731\/\">State of J &amp; K v.<\/p>\n<p>     Mohd. Yaqoob Khan<\/a> (1992) 4 SCC 167.&#8221;\n<\/p>\n<p>            5. It may be stated that in the matter before the<\/p>\n<p>Supreme Court the issue was whether the interim order passed<\/p>\n<p>by the High Court for the supply of coal, wherein the liability of<\/p>\n<p>the respondents to make such a supply was in dispute was right?<\/p>\n<p>The interim direction would compel a party to part with property<\/p>\n<p>which perhaps cannot be restituted even if the writ petition is<\/p>\n<p>eventually dismissed.\n<\/p>\n<p>            6. In the instant case we are of the opinion that no<\/p>\n<p>such irrecoverable situation exists nor the appellant would be<\/p>\n<p>compelled to part with any property.              The interim order was<\/p>\n<p>passed directing the appellant to provisionally assign number to<\/p>\n<p>the building already constructed by the 1st respondent. If the<\/p>\n<p>writ petition fails the building can eventually be demolished to<\/p>\n<p>the extent it is found to be illegal. In the circumstances, we see<\/p>\n<p>WA No. 1512 of 2010<br \/>\n<span class=\"hidden_text\">                               -:4:-<\/span><\/p>\n<p>no ground to interfere with the judgment under appeal and<\/p>\n<p>therefore the appeal is dismissed at the admission stage.<\/p>\n<p>                                        J.Chelameswar,<br \/>\n                                         Chief Justice.\n<\/p>\n<p>                                 P.R.
