    Revision  petitioner  is  the  accused  and<\/p>\n
first    respondent    the    complainant    in<\/p>\n
C.C.251\/2005 on the file of Judicial First<\/p>\n
Class   Magistrate-I,   Manjeri.       Revision<\/p>\n
petitioner was convicted and sentenced for the<\/p>\n
offence  under   section   138  of   Negotiable<\/p>\n
Instruments Act.    Conviction was challenged<\/p>\n
before Additional Sessions Court, Manjeri in<\/p>\n
Crl.A.23\/2007.    Learned  Additional  Sessions<\/p>\n
Judge on reappreciation of evidence confirmed<\/p>\n
the conviction and    modified the sentence to<\/p>\n
imprisonment  till  rising   of  court  and   a<\/p>\n
compensation of Rs.1,00,000\/- with a default<\/p>\n
sentence  of  simple   imprisonment  for  three<\/p>\n
months.   Revision is filed challenging the<\/p>\n
conviction and sentence.\n<\/p>\n

     2.      Learned counsel appearing for revision<\/p>\n
petitioner was heard.\n<\/p>\n
     3.    In view of the evidence on record and the<\/p>\n
concurrent     findings    of  fact  learned   counsel<\/p>\n
submitted      that  revision   petitioner   is    not<\/p>\n
challenging the conviction but revision petitioner<\/p>\n
may be granted time to pay the amount.    It was also<\/p>\n
submitted that when compensation is awarded under<\/p>\n
section 357(3) of Code of Criminal Procedure, there<\/p>\n
cannot be a default sentence and to that extent the<\/p>\n
sentence is to be modified.\n<\/p>\n
     4.      On going through the judgments of the<\/p>\n
courts below I find no reason to interfere with the<\/p>\n
conviction.       Evidence  establish  that   revision<\/p>\n
petitioner     borrowed   Rs.1,00,000\/-   from   first<\/p>\n
respondent and     towards its repayment issued Ext.P1<\/p>\n
cheque which was dishonoured for encashment.    It is<\/p>\n
also established that first respondent had complied<\/p>\n
with    all   statutory  formalities  provided   under<\/p>\n
section 138 and 142 of Negotiable Instruments Act.<\/p>\n

In such circumstance, conviction of the revision<\/p>\n
petitioner for the offence under section 138 of<\/p>\n
Negotiable Instruments Act is perfectly legal.<\/p>\n
     5.       Then the    question  is  regarding  the<\/p>\n
sentence.       Learned Sessions Judge modified the<\/p>\n
sentence to imprisonment till rising of court and<\/p>\n
compensation which was only for the amount covered<\/p>\n
by the dishonoured cheque.     In such circumstance, I<\/p>\n
find no reason to interfere with the sentence.     But<\/p>\n
as rightly pointed out by the learned counsel<\/p>\n
appearing for revision petitioner when compensation<\/p>\n
is awarded under sub section (3) of Section 357 of<\/p>\n
Code of Criminal Procedure, there cannot be a<\/p>\n
default sentence.      To that extent the sentence is<\/p>\n
illegal.      Therefore the direction of the learned<\/p>\n
Sessions Judge for default sentence for the payment<\/p>\n
of compensation is set aside.\n<\/p>\n
     Criminal     Revision   Petition   is    disposed<\/p>\n
accordingly.      Revision petitioner is granted four<\/p>\n
months time to pay the amount.      He is directed to<\/p>\n
