JOSEPH FRANCIS, J.\n                 - - - - - - - - - - - - - - - - - - - - - -\n                 Crl.R.P.No. 3390 of 2003\n                 - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 21st day of December, 2010\n\n                              O R D E R\n<\/pre>\n<p>       This Crl.R.P. is filed by the accused in S.T.No. 1051 of<\/p>\n<p>1995     on the file of the          Judicial First Class Magistrate,<\/p>\n<p>Kayamkulam. The cheque amount was Rs.25,000\/- In the trial<\/p>\n<p>court the accused was convicted under Section 138 of the N.I. Act<\/p>\n<p>and sentenced to undergo         rigorous imprisonment for three<\/p>\n<p>months and to pay a fine of Rs.50,000\/-, in default to undergo<\/p>\n<p>S.I. for one month. The appeal filed by the accused as Crl.A.No.<\/p>\n<p>162 of 1998 before the Additional Sessions Court &#8211; II,<\/p>\n<p>Mavelikkara    was     dismissed.         Against that conviction and<\/p>\n<p>sentence the accused filed this revision petition.<\/p>\n<p>      2.   Heard learned counsel for the revision petitioner,<\/p>\n<p>learned counsel for the complainant and the learned Public<\/p>\n<p>Prosecutor.\n<\/p>\n<p>Crl.R.P.No. 3390 of 2003<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>      3. The learned counsel appearing for the revision petitioner<\/p>\n<p>reiterated the same contentions raised before the trial Court and the<\/p>\n<p>appellate court. Learned counsel for the complainant supported<\/p>\n<p>the judgment of the court below.\n<\/p>\n<p>      4. The courts below have concurrently held that the cheque<\/p>\n<p>in question was drawn by the petitioner in favour of the<\/p>\n<p>complainant, that the complainant had validly complied with<\/p>\n<p>clauses (a) and (b) of the proviso to Section 138 of the N.I. Act and<\/p>\n<p>that the Revision petitioner\/accused failed to make the payment<\/p>\n<p>within 15 days of receipt of the statutory notice. Both the courts<\/p>\n<p>have considered and rejected the defence set up by the revision<\/p>\n<p>petitioner while entering the conviction. The said conviction has<\/p>\n<p>been recorded after a careful evaluation of the oral and<\/p>\n<p>documentary evidence.       I do not find any error, illegality or<\/p>\n<p>impropriety in the conviction so recorded concurrently by the<\/p>\n<p>courts below and the same is hereby confirmed.<\/p>\n<p>Crl.R.P.No. 3390 of 2003<\/p>\n<p><span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>      5. In the decision reported in <a href=\"\/doc\/1594211\/\">Damodar S. Prabhu v. Sayed<\/p>\n<p>Babalal H<\/a> (2010 (2) KHC 428 (SC)), it was held that in a case of<\/p>\n<p>dishonour of cheques, compensatory aspect of the remedy should<\/p>\n<p>be given priority over the punitive aspect. Considering the facts<\/p>\n<p>and circumstances of the case, I am of the view that sentencing the<\/p>\n<p>accused to pay a fine of Rs.25,000\/- would meet the ends of<\/p>\n<p>justice. The said fine shall be paid as compensation under Section<\/p>\n<p>357(1) of Cr.P.C. The revision petitioner is permitted either to<\/p>\n<p>deposit the said fine amount before the Court below or directly pay<\/p>\n<p>the compensation to the complainant within three months from<\/p>\n<p>today and to produce a memo to that effect before the Trial Court<\/p>\n<p>in case of direct payment. If he fails to deposit or pay the said<\/p>\n<p>amount within the aforesaid period, he shall suffer simple<\/p>\n<p>imprisonment for three months by way of default sentence. The<\/p>\n<p>amount, if any, deposited in the trial court by the accused can be<\/p>\n<p>given credit to.\n<\/p>\n<p>Crl.R.P.No. 3390 of 2003<\/p>\n<p><span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>     6.   Accordingly this Revision Petition is disposed of<\/p>\n<p>confirming the conviction entered and by modifying the sentence<\/p>\n<p>imposed on the revision petitioner.\n<\/p>\n<\/p>\n<p>                                   (M.L.
