SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/10\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, the petitioner &#8211; Management &#8211; Institute has<br \/>\nprayed for an appropriate writ, order and\/or direction, quashing and<br \/>\nsetting aside the impugned interlocutory order dated 28\/04\/2010<br \/>\npassed by the Labour Court, Bhavnagar below Exh-20 in Reference (LCB)<br \/>\nCase No.89 of 1995, by which the Labour Court has rejected the<br \/>\napplication  submitted by the petitioner to join &#8220;The Director,<br \/>\nSocial Defence Department, State of Gujarat&#8221; as necessary party<br \/>\nto the aforesaid Reference.\n<\/p>\n<p>2.\t\tAt<br \/>\nthe outset, it is required to be noted that the dispute is between<br \/>\nthe employer and employee and, therefore, the Labour Court has not<br \/>\ncommitted any error and\/or illegality in  not  allowing the<br \/>\napplication  submitted  by  the  petitioner to join &#8220;The<br \/>\nDirector, Social Defence Department, State of Gujarat&#8221;, from<br \/>\nwhom, the petitioner is alleged to is receiving the grant. Merely<br \/>\nbecause the petitioner might be getting grant and\/or appointment of<br \/>\nthe staff is subject to approval of the concerned Department, the<br \/>\nconcerned Department would not become employer. It is the petitioner,<br \/>\nwho is employer and, therefore, in a dispute between the employer and<br \/>\nemployee, Labour Court has rightly not allowed the said application<br \/>\nsubmitted by the petitioner to join  &#8220;The Director, Social<br \/>\nDefence Department, State of Gujarat&#8221;, with whom the employee<br \/>\nhas no privity of contract.\n<\/p>\n<p>3.\t\tIt<br \/>\nis also required to be noted that the Reference is of the year 1995,<br \/>\nthe petitioner submitted the application below Exh-20 requesting to<br \/>\njoin &#8220;The Director, Social Defence Department, State of<br \/>\nGujarat&#8221; in the year 2009 i.e. after a period of 14 years.<br \/>\nConsidering the aforesaid facts and circumstances of the case, no<br \/>\nillegality has been committed by the Labour Court in rejecting the<br \/>\napplication submitted by the petitioner to join &#8220;The Director,<br \/>\nSocial Defence Department, State of Gujarat&#8221; as necessary party<br \/>\nto the aforesaid Reference.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above, there is no substance in the present petition,<br \/>\nwhich deserves to be dismissed and is accordingly dismissed.
