Mr.Kamal Sojitra, learned advocate<br \/>\nfor the applicant has submitted that the other co-accused, all of<br \/>\nthem, have been arrested.\n<\/p>\n<p>2.\tHowever,<br \/>\n learned APP has submitted that one of the co-accused is still not<br \/>\narrested and is absconding.\n<\/p>\n<p>3.\tMs.Manisha<br \/>\nShah, learned APP for the respondent has further submitted that the<br \/>\ntrial has already begun and it is in progress towards completion.<br \/>\nHowever, the learned advocate for the petitioner and the learned APP<br \/>\nare not certain about the number of witnesses, who have been examined<br \/>\nand\/or are yet to be examined.\n<\/p>\n<p>4.\tIn<br \/>\nany case, since the trial has already begun and according to the<br \/>\ninformation of the learned APP, one of the accused is still not<br \/>\narrested and having regard to the nature of the offence, this Court<br \/>\nis not inclined to entertain the application at this stage.\n<\/p>\n<p>5.\tHowever,<br \/>\nthe request of the learned advocate for the petitioner is that the<br \/>\nlearned Trial Court may be requested to expedite the trial in view of<br \/>\nthe fact that the trial has already begun. Therefore, it is hoped<br \/>\nthat the learned Trial Court would make endeavor to complete the<br \/>\ntrial as early as possible.\n<\/p>\n<p>6.\tWith<br \/>\nthe aforesaid clarification, the application is disposed off.
