Justice V.K.MOHANAN\n\n Dated :27\/08\/2009\n\n O R D E R\n                 V.K.MOHANAN, J.\n      -----------------------------------------------\n    W.P(C).Nos.24804\/2007 &amp; 1199\/2006\n      -----------------------------------------------\n      Dated this the 27th day of August, 2009\n\n                  J U D G M E N T\n<\/pre>\n<p>           The fate of W.P(C) No.1199 of 2006<\/p>\n<p>depends upon the outcome in W.P.(C) No.24804<\/p>\n<p>of 2007, and therefore, the above two writ<\/p>\n<p>petitions are interconnected. Hence, these two<\/p>\n<p>writ petitions are heard together and being<\/p>\n<p>disposed of by this common order.\n<\/p>\n<p>     2.    The petitioner in W.P(C) No.24804 of<\/p>\n<p>2007 is originally appointed as a Drawing<\/p>\n<p>Teacher in the U.P.Section of the High School,<\/p>\n<p>Mundur on 28.8.1978.         In the said school, there<\/p>\n<p>were two posts of Specialist Teachers. Out of<\/p>\n<p>two, one was abolished as a result of fixation of<\/p>\n<p>strength of Teachers during the year 1998 and<\/p>\n<p>hence, the petitioner was shifted from the<\/p>\n<p>U.P.Section to the High School Section in a<\/p>\n<p>vacancy which arose due to the retirement of one<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                        :-2-:\n<\/p>\n<p>Balachandran who was holding the post of Specialist<\/p>\n<p>Teacher.    Thus, from 31.3.1998 onwards, the<\/p>\n<p>petitioner was working in the High School Section<\/p>\n<p>as Drawing Teacher till his retirement.   Out of the<\/p>\n<p>two posts of Specialist Teachers, the remaining one<\/p>\n<p>was occupied by one C.Murali,        who retired on<\/p>\n<p>31.7.2001 and to that post, the petitioner in W.P(C)<\/p>\n<p>No.1199 of 2006 was appointed with effect from<\/p>\n<p>1.8.2001. His appointment was also approved by<\/p>\n<p>the Department.\n<\/p>\n<p>     3.   That being the position, after five years,<\/p>\n<p>the   District  Educational     Officer,  the  third<\/p>\n<p>respondent issued Ext.P1 order (in W.P(C) No.24804<\/p>\n<p>of 2007) on 7.5.2003, which was eventually<\/p>\n<p>challenged by the petitioner before this Court by<\/p>\n<p>filing W.P(C) No.35916 of 2005 and this Court<\/p>\n<p>passed Ext.P4 judgment directing the Government<\/p>\n<p>to reconsider the matter and to take a fresh decision<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                         :-3-:\n<\/p>\n<p>after hearing the petitioner and other affected<\/p>\n<p>parties. Thus, the Government passed Ext.P6 order,<\/p>\n<p>declining the request of the petitioner to permit him<\/p>\n<p>to continue as Drawing Teacher in the High School<\/p>\n<p>Section. It is the above Ext.P6 order, challenged in<\/p>\n<p>W.P(C) No.24804 of 2007.\n<\/p>\n<p>     4.   The prayer in W.P(C) No.1199 of 2006 is<\/p>\n<p>to quash Exts.P2,P3 and P5 orders by issuing a writ<\/p>\n<p>of certiorari. The second prayer in the writ petition<\/p>\n<p>is to issue a writ of mandamus or other appropriate<\/p>\n<p>writ, order or direction commanding respondents 1<\/p>\n<p>to 3 to retain the petitioner as Physical Education<\/p>\n<p>Teacher in the school of the 4th respondent and to<\/p>\n<p>approve his appointment during the year 2002-03<\/p>\n<p>and subsequent years.    The petitioner in the above<\/p>\n<p>writ petition approached this Court when the third<\/p>\n<p>respondent passed an order shifting the fifth<\/p>\n<p>respondent, who is the petitioner in the other writ<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                         :-4-:\n<\/p>\n<p>petition, to the U.P.Section and retrenching the<\/p>\n<p>petitioner herein so as to accommodate the other<\/p>\n<p>petitioner holding that there would be one Specialist<\/p>\n<p>post in the Upper Primary Section. Ext.P3 is the<\/p>\n<p>said order.   Against Ext.P2 order, the petitioner<\/p>\n<p>herein preferred revision petition before the<\/p>\n<p>Government and the same was disposed of by the<\/p>\n<p>Government in the light of the direction issued by<\/p>\n<p>this Court as per the judgment in W.P(C) No.16146<\/p>\n<p>of 2003. As the order was against the petitioner, he<\/p>\n<p>again challenged the said order by filing W.P.(C)<\/p>\n<p>No.6949 of 2004 before this court and this Court, by<\/p>\n<p>order dated 13.7.2005 in the above writ petition,<\/p>\n<p>quashed the revisional order passed by the<\/p>\n<p>Government and directed the Government to re-<\/p>\n<p>examine the matter afresh. Ext.P4 is the judgment<\/p>\n<p>of this Court in the writ petition on the basis of<\/p>\n<p>which the Government passed Ext.P5 order.         In<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                          :-5-:\n<\/p>\n<p>Ext.P5 order, the Government reiterated its earlier<\/p>\n<p>stand and thus, aggrieved by Ext.P5 order, the<\/p>\n<p>petitioner preferred the present writ petition.<\/p>\n<p>     5.   In both the writ petitions, the State has<\/p>\n<p>filed separate counter affidavits.      The specific<\/p>\n<p>contention of the Department is to the effect that<\/p>\n<p>the shifting of the petitioner in W.P(C) No.24804 of<\/p>\n<p>2007 to the High School Section was illegal and<\/p>\n<p>arbitrary and therefore, he is to be reposted in the<\/p>\n<p>U.P.Section for which the petitioner in the other<\/p>\n<p>writ petition (1199\/2006) had to be retrenched.<\/p>\n<p>According to the Government, the petitioner in W.P<\/p>\n<p>(C) No.24804 of 2007 was not eligible to be<\/p>\n<p>transferred and appointed in any post in the High<\/p>\n<p>School    Section   as   he    was  not  having the<\/p>\n<p>S.S.L.C.qualification, which is one among the<\/p>\n<p>requisite qualifications.\n<\/p>\n<p>     6.   I   have     heard    Sri.P.K.Sureshkumar,<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                         :-6-:\n<\/p>\n<p>learned counsel appearing for the petitioner in W.P.<\/p>\n<p>(C) No.1199 of 2006 and also Sri.George Abraham,<\/p>\n<p>learned counsel appearing for the petitioner in W.P.<\/p>\n<p>(C) No.24804 of 2007 and the learned Government<\/p>\n<p>Pleaders.\n<\/p>\n<p>     7.   Counsel for the petitioners emphatically<\/p>\n<p>submits that by virtue of sub-rule(2) and (3) of Rule<\/p>\n<p>1 of Chapter XXXI of the Kerala Education Rules<\/p>\n<p>(for short &#8216;the K.E.R.&#8217;), the petitioner in W.P.(C)<\/p>\n<p>No.24804 of 2007 was fully qualified for transfer to<\/p>\n<p>the post occurred in the High School Section of the<\/p>\n<p>school and therefore, the contention of the<\/p>\n<p>departmental authorities and the Government is<\/p>\n<p>liable to be rejected. In support of the contention,<\/p>\n<p>counsel for the petitioners very much relied upon<\/p>\n<p>the decisions of this Court reported in <a href=\"\/doc\/1913593\/\">Rani George<\/p>\n<p>v. Deputy Director of Education<\/a> (2004(1) KLT<\/p>\n<p>460) and <a href=\"\/doc\/1349533\/\">Satheeshkumar v. State of Kerala<\/a> (2009<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                         :-7-:\n<\/p>\n<p>(3) KLT 439).\n<\/p>\n<p>     8.    On the other hand, the Government<\/p>\n<p>Pleaders contended that the exemption granted in<\/p>\n<p>sub-rule (3) to Rule 1 of Chapter XXXI of the K.E.R.,<\/p>\n<p>is not applicable in the case of the petitioner in W.P<\/p>\n<p>(C) No.24804 of 2007.        Thus, according to the<\/p>\n<p>Government Pleaders, the appointment of the<\/p>\n<p>petitioner in W.P(C) No.1199 of 2006 cannot be<\/p>\n<p>approved because the post in which he was<\/p>\n<p>appointed had to be accommodated by the<\/p>\n<p>petitioner in W.P(C)No.24804 of 2007 after shifting<\/p>\n<p>him from the High School Section.\n<\/p>\n<p>     9.   I have carefully considered the arguments<\/p>\n<p>advanced by the counsel appearing for the<\/p>\n<p>petitioners as well as the learned Government<\/p>\n<p>Pleaders and I have perused the materials on<\/p>\n<p>record.\n<\/p>\n<p>     10. At the outset, it is to be noted that the<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                         :-8-:\n<\/p>\n<p>petitioner in W.P.(C) No.24804 of 2007 has already<\/p>\n<p>retired from service on 31.3.2008 while he was<\/p>\n<p>working in the High School Section as a Drawing<\/p>\n<p>Teacher. Though the said petitioner was shifted and<\/p>\n<p>appointed to the High School Section and working<\/p>\n<p>there with effect from 31.3.1998, the objection was<\/p>\n<p>raised by the Department only after five years of his<\/p>\n<p>working in the High School Section. Ext.P6 order<\/p>\n<p>(in W.P.(C) No.24804 of 2007) is dated 25.7.2007<\/p>\n<p>and after six months from the date of Ext.P6, he<\/p>\n<p>retired from the service. Thus, it can be seen that<\/p>\n<p>he was working as Specialist Teacher in the High<\/p>\n<p>School Section right from 31.3.1998 and he was<\/p>\n<p>doing his job, without any other complaint for which<\/p>\n<p>he had already received the salary etc. It is also the<\/p>\n<p>fact that the petitioner in W.P(C) No.1199 of 2006<\/p>\n<p>was appointed in the post of Physical Education<\/p>\n<p>Teacher    right   on   1.8.2001    and   the    said<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                         :-9-:\n<\/p>\n<p>appointments were approved by the Department. In<\/p>\n<p>the meanwhile, this Court passed the interim order<\/p>\n<p>on 13.1.2006 on the basis of which he is continuing<\/p>\n<p>in service. In the interim order passed by this Court<\/p>\n<p>on 13.1.2006, it is made clear that the petitioner<\/p>\n<p>shall be allowed to continue in service on condition<\/p>\n<p>that the claims for service benefits including salary<\/p>\n<p>will depend on the final result of the writ petition.<\/p>\n<p>Thus, the petitioner was continuing in the post and<\/p>\n<p>rendering the service without receiving any salary<\/p>\n<p>for the last several years. As the petitioner in W.P<\/p>\n<p>(C) No.24804 of 2007 had already retired from<\/p>\n<p>service, at present, there is no question of<\/p>\n<p>accommodating him in the U.P.Section.<\/p>\n<p>     11. Chapter XXXI of the K.E.R. deals with<\/p>\n<p>qualifications of Private School teachers. Rule 1 of<\/p>\n<p>the said Chapter says that the teachers in the<\/p>\n<p>private schools shall have the educational and<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                           :-10-:\n<\/p>\n<p>professional    qualifications    prescribed      in that<\/p>\n<p>chapter.    It is further stated that the conditions<\/p>\n<p>regarding the age, Departmental Test qualifications,<\/p>\n<p>service qualifications and other service conditions<\/p>\n<p>shall be governed by the provisions of the Act and<\/p>\n<p>the Rules contained in the foregone chapters.         As<\/p>\n<p>per sub-rule (2) to Rule 1, for all teaching posts in<\/p>\n<p>Private   Primary     Schools     including     posts  of<\/p>\n<p>Language Teachers and Specialist Teachers, a pass<\/p>\n<p>in   S.S.L.C.    Examination      conducted       by  the<\/p>\n<p>Commissioner for Government Examination or its<\/p>\n<p>equivalent is fixed as the minimum general<\/p>\n<p>educational qualification. Sub-rule (3) to Rule 1 of<\/p>\n<p>Chapter XXXI of the K.E.R. is an exemption to sub-<\/p>\n<p>rule (2) to Rule 1. Sub-rue(3) to Rule 1 reads as<\/p>\n<p>follows:-\n<\/p>\n<blockquote><p>             &#8220;(3) Qualified teachers in service in<br \/>\n       Private Schools as on 30-6-1980 and teachers<br \/>\n       who have approved qualified service in Private<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                            :-11-:\n<\/p><\/blockquote>\n<blockquote><p>       Schools   prior   to   that   date  shall   be,<br \/>\n       permanently exempted from the requirement<br \/>\n       of  the   general    educational qualifications<br \/>\n       prescribed for all teaching posts in Private<br \/>\n       Primary Schools under sub-rule(2) above, not<br \/>\n       only in respect of posts held by them but also<br \/>\n       in respect of promotions to higher posts,<br \/>\n       provided    they    have    the  qualifications<br \/>\n       prescribed for such higher posts, but for the<br \/>\n       prescription of the revised minimum general<br \/>\n       educational qualifications.&#8221;\n<\/p><\/blockquote>\n<p>On a reading of sub-rule(3), it can be seen that the<\/p>\n<p>teachers in service in Private Schools as on<\/p>\n<p>30.6.1980 are exempted from the requirement of the<\/p>\n<p>general educational qualifications, viz., S.S.L.C. as<\/p>\n<p>fixed by sub-rule (2) to Rule 1.        It is further seen<\/p>\n<p>from sub-rule(3) that such exemption is not only in<\/p>\n<p>respect of the posts held by such teachers, who<\/p>\n<p>were in service as on 30.6.1980, but also in respect<\/p>\n<p>of promotions to higher posts. From the above rule,<\/p>\n<p>it is crystal clear that the exemption was given to<\/p>\n<p>the occupants who have entered in service before<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                         :-12-:\n<\/p>\n<p>30.6.1980 not only for continuing in the post held by<\/p>\n<p>them, but for promotion also. Therefore, I am of the<\/p>\n<p>view that by virtue of this exemption contained in<\/p>\n<p>Rule 1(3) of Chapter XXXI of the K.E.R., the<\/p>\n<p>petitioner in W.P.(C) No.24804 of 2007 was rightly<\/p>\n<p>shifted to the High School Section and his transfer<\/p>\n<p>and appointment to the High School Section is<\/p>\n<p>absolutely valid and proper. It is also relevant to<\/p>\n<p>note at this juncture that the scale of pay in both the<\/p>\n<p>sections was admittedly the same.<\/p>\n<p>     12.     A Division Bench of this Court in a<\/p>\n<p>decision reported in <a href=\"\/doc\/1913593\/\">Rani George v. Deputy<\/p>\n<p>Director of Education<\/a> (2004(1) KLT 460) has held<\/p>\n<p>that the posts of Specialist Teachers in the<\/p>\n<p>Schools\/sections are interchangeable if the same are<\/p>\n<p>belonging to one educational agency and are having<\/p>\n<p>High School with Upper Primary in the same<\/p>\n<p>district. Admittedly, in the present case, the scale of<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                        :-13-:\n<\/p>\n<p>pay of the Drawing Teacher both in the U.P.Section<\/p>\n<p>and the High School Section is one and the same.<\/p>\n<p>Therefore, the transfer and appointment of the<\/p>\n<p>petitioner to the High School Section is not a<\/p>\n<p>promotion. It is only a shifting, especially when the<\/p>\n<p>posts in High School Section and the U.P.Section<\/p>\n<p>are interchangeable as held by the Division Bench of<\/p>\n<p>this Court.    It is a fact that the departmental<\/p>\n<p>authorities   initiated  proceedings    against  the<\/p>\n<p>petitioner in W.P(C) No.24804 of 2007 only after<\/p>\n<p>five years from the date of his occupying post in the<\/p>\n<p>High School Section and in the mean while, the<\/p>\n<p>petitioner in the other writ petition was duly<\/p>\n<p>appointed in the       U.P.Section as a Physical<\/p>\n<p>Education Teacher.      It is also a fact that the<\/p>\n<p>petitioner in W.P(C) No.24804 of 2007 has already<\/p>\n<p>retired from service on 31.3.2008.<\/p>\n<p>     13. Under the above factual premises and in<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                          :-14-:\n<\/p>\n<p>view of the provisions of the K.E.R. referred above<\/p>\n<p>and in the light of the position of law settled as per<\/p>\n<p>the decisions reported in <a href=\"\/doc\/1913593\/\">Rani George v. Deputy<\/p>\n<p>Director of Education<\/a> (2004(1) KLT 460) and<\/p>\n<p><a href=\"\/doc\/1349533\/\">Satheeshkumar v. State of Kerala<\/a> (2009(3) KLT<\/p>\n<p>439), I am of the view that Ext.P6 in W.P(C)<\/p>\n<p>No.24804 of 2007 is liable to be set aside and the<\/p>\n<p>petitioner in W.P(C) No.1199 of 2006 is entitled to<\/p>\n<p>get the relief as sought in the writ petition.<\/p>\n<p>         In the result, mainly on the basis of the<\/p>\n<p>factual premises referred above, W.P(C)No.24804 of<\/p>\n<p>2007 is allowed to the extent quashing Ext.P6 order<\/p>\n<p>of the Government and W.P(C) No.1199 of 2006 is<\/p>\n<p>allowed    quashing    Exts.P2,P3     and     P5  and<\/p>\n<p>respondents 1 to 3 are directed to retain the<\/p>\n<p>petitioner as Physical Education Teacher in the<\/p>\n<p>school of the fourth respondent and to approve his<\/p>\n<p>appointment     during    the    year   2002-03   and<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                        :-15-:\n<\/p>\n<p>subsequent years and for all service purposes and<\/p>\n<p>are further directed to release his salary which was<\/p>\n<p>due to him forthwith.\n<\/p>\n<p>         W.P(C)Nos.24804 of 2007 and 1199 of<\/p>\n<p>2006 are allowed as indicated above.<\/p>\n<p>                                    V.K.Mohanan,<br \/>\n                                        Judge<\/p>\n<p>MBS\/<\/p>\n<p>WP(C) Nos.24804 of 2007&amp;1199 of 2006<\/p>\n<p>                        :-16-:\n<\/p>\n<\/p>\n<p>                                      V.K.MOHANAN,<br \/>\nJ.\n<\/p>\n<p>                        &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>&#8212;\n<\/p>\n<p><span class=\"hidden_text\">                                    O.P.NO.
