He has submitted that actually it was<br \/>\nthe respondent who did not report for work and then raised industrial<br \/>\ndispute which has been decided by award dated 9.3.2010. He has<br \/>\nreferred to Annexure-G (page-41\/A) and submitted that after the award<br \/>\nwas rendered the petitioner has addressed a letter to the respondent<br \/>\nto report for work but the respondent has not reported for work. It<br \/>\nis noticed that award is dated 9.3.2010 and the letter referred to by<br \/>\nthe learned advocate for the petitioner is of 8.9.2010. Mr. Dave,<br \/>\nlearned advocate for the petitioner has submitted that earlier also<br \/>\nsimilar intimation was given.\n<\/p>\n<p>3.<br \/>\nIn this view of the matter while declining interference with the<br \/>\ndirection regarding reinstatement and taking note of the fact that<br \/>\nthe petitioner has, by the aforesaid letter, shown readiness to<br \/>\nreinstate the respondent and to allow him to report for work, office<br \/>\nis directed to issue Notice making it returnable on<br \/>\n21.3.2011.\n<\/p>\n<p>4.<br \/>\nThe petitioner will give specific intimation, citing details about<br \/>\npresent proceedings and present order, to the respondent workman<br \/>\nasking him to report for work.\n<\/p>\n<p>5.<br \/>\nSuch intimation will be given by R.P.A.D..\n<\/p>\n<p>6.<br \/>\nA copy thereof must be sent to the Union representing the workman.\n<\/p>\n<p>7.<br \/>\nThe petitioner shall place on record, on the returnable date, the<br \/>\ndetails about the calculation of the wages which becomes payable by<br \/>\nvirtue of the impugned award.\n<\/p>\n<p>8.<br \/>\nHaving regard to the submissions of the learned advocate for the<br \/>\npetitioner, the direction regarding backwages by way of ad-interim<br \/>\nrelief will remain stayed until next date of hearing.\n<\/p>\n<p>(K.M.THAKER,J.)<\/p>\n<p>Suresh*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Harshad vs Mohammadrauf on 1 March, 2011 Author: K.M.Thaker,&amp;Nbsp;
