(Oral)\n<\/pre>\n<p>             The plaintiff-Phuman Singh filed a suit for permanent injunction<\/p>\n<p>restraining the defendants from dispossessing the plaintiff forcibly and illegally<\/p>\n<p>from the suit land. The suit of the plaintiff was decreed by Civil Judge<\/p>\n<p>(Jr.Divn.) Ferozepur vide judgment and decree dated 25.8.2006 . In appeal, the<\/p>\n<p>Addl. District Judge, Ferozepur upheld the said judgment and decree vide<\/p>\n<p>judgment and decree dated 4.4.2007. Hence, the present appeal has been filed<\/p>\n<p>by the defendants.\n<\/p>\n<p>             The facts of the case as noticed by learned Additional District<\/p>\n<p>Judge, Ferozepur in para Nos.2 to 3 of its judgment reads as under:-<\/p>\n<blockquote><p>             &#8220;2.     Briefly stated, the facts of the case of the plaintiff are that<br \/>\n                     he is absolute owner in possession of the suit land<br \/>\n                     measuring 8 kanal fully detailed nd described in para no.1<br \/>\n                     of the plaint. Previously, the suit land was owned by the<br \/>\n                     Provincial Govt. and the same was purchased by him from<br \/>\n                     the Provincial Govt. and mutation to this effect was also<br \/>\n                     sanctioned. The suit land was allotted to him on the basis<br \/>\n                     of his possession. His possession over the suit land is<br \/>\n                     lawful, peaceful and continuous being owner and the same<br \/>\n                     has also been recorded in the revenue record.             The<br \/>\n                     defendants have got no concern either with possession or<br \/>\n                     with the title of the suit land. The defendants being<br \/>\n                     influential persons tried to dispossess the plaintiff from the<br \/>\n                     suit land but their efforts were foiled due to intervention of<br \/>\n<span class=\"hidden_text\"> RSA No.4260 of 2009(O&amp;M)                                                      2<\/span><\/p>\n<p>                    respectable of the locality. As such plaintiff filed a suit for<br \/>\n                    permanent injunction restraining the defendants from<br \/>\n                    dispossessing him from the suit land.\n<\/p><\/blockquote>\n<blockquote><p>             3.     Upon notice, the defendants appeared and filed written<br \/>\n                    statement taking preliminary objections that the suit is<br \/>\n                    counter-blast to the application filed by defendant No.1 for<br \/>\n                    correction of Khasra girdawri and that the plaintiff has not<br \/>\n                    come to the court with clean hands and has suppressed<br \/>\n                    material facts from the court. On merits, it was pleaded that<br \/>\n                    plaintiff is not in possession of the suit land rather<br \/>\n                    defendant no.1 is in possession of the last for the last more<br \/>\n                    than 10 years. It was further pleaded that the suit land is<br \/>\n                    situated after crossing Indo-Pak fencing wire.         Khasra<br \/>\n                    girdawri was wrongly recorded in favour of the plaintiff<br \/>\n                    and allotment of the suit land in faovur of the plaintiff is<br \/>\n                    wrong and illegal. It was further pleaded that when the<br \/>\n                    defendants came to know about the khasra girdawri in the<br \/>\n                    name of the plaintiff, he applied for correction of khasra<br \/>\n                    girdawri in the Court of A.C.II, Guru Har Sahai, District<br \/>\n                    Ferozepur. Rest of the averments made in the plaint were<br \/>\n                    denied being incorrect. Lastly, it was prayed that the suit of<br \/>\n                    the plaintiff may be dismissed with costs.&#8221;<\/p><\/blockquote>\n<p>             From the pleadings of the parties, the following issues were<\/p>\n<p>framed by the learned trial Court:-\n<\/p>\n<blockquote><p>             &#8220;1.    Whether the plaintiff is entitled to the injunction prayed<br \/>\n                    for? OPP.\n<\/p><\/blockquote>\n<blockquote><p>             2.     Whether plaintiff is in possession of the suit property?OPP.\n<\/p><\/blockquote>\n<blockquote><p>             3.     Whether the defendants are forcibly and illegally<br \/>\n                    dispossessing the plaintiff over the suit land?OPP\n<\/p><\/blockquote>\n<blockquote><p>             4.     Whether the plaintiff has suppressed the material facts<br \/>\n                    from the Court?OPD.\n<\/p><\/blockquote>\n<blockquote><p>             5.     Relief.&#8221;<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> RSA No.4260 of 2009(O&amp;M)                                                    3<\/span><\/p>\n<p>             After hearing learned counsel for the appellants, I am of the<\/p>\n<p>opinion that the instant appeal is devoid of any merit and deserves to be<\/p>\n<p>dismissed.\n<\/p>\n<p>             The plaintiff-respondent had filed a suit for permanent injunction<\/p>\n<p>restraining the respondents from dispossessing him forcibly from the suit land.<\/p>\n<p>             The plaintiff successfully led evidence to establish that he was<\/p>\n<p>owner in possession of the suit land measuring 8 kanals. The Provincial Govt.<\/p>\n<p>had transferred the suit land in favour of the plaintiff and in this regard<\/p>\n<p>mutation No.168 was sanctioned in favour of the plaintiff. The said mutation<\/p>\n<p>was duly reflected in the revenue record. As per entry in the khasra-girdawari,<\/p>\n<p>the plaintiff was earlier shown to be in possession of the suit land as gair<\/p>\n<p>marusi. The appellant-defendants on the other hand, failed to establish that they<\/p>\n<p>were in possession of the suit land.\n<\/p>\n<p>             Both the courts below, after appreciating the evidence led by the<\/p>\n<p>parties have given a finding of fact that the plaintiff was in possession of the<\/p>\n<p>suit property. The said finding of fact cannot be interfered by this Court in<\/p>\n<p>appeal.\n<\/p>\n<p>             No substantial question of law arises for consideration by this<\/p>\n<p>Court in this appeal.
