Justice KURIAN JOSEPH\n\n Dated :20\/02\/2007\n\n O R D E R\n                              KURIAN JOSEPH, J.\n\n                  ----------------------------------------------\n\n                       W.P.(C) No.25765 of 2006\n\n                  ----------------------------------------------\n\n                       Dated 20th February,  2007.\n\n\n                                 J U D G M E N T\n<\/pre>\n<p>              The   writ   petition   is   filed   mainly   with   the   following<\/p>\n<p>prayer :-\n<\/p>\n<\/p>\n<blockquote><p>              &#8220;Issue  a writ of mandamus or any other appropriate writ, order<\/p>\n<p>              or direction commanding the respondents 1 to 3 to disburse the<\/p>\n<p>              amount sanctioning in favour of the petitioners by issuing Ext.P1<\/p>\n<p>              letter of credit, on getting proper security\/guarantee, as may be<\/p>\n<p>              insisted   by   respondents   1   to   3,   pending   finalisation   of   the<\/p>\n<p>              enquiry ordered in Ext.P2 judgment.&#8221;\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>It   is   submitted   that   the   time   stipulated   in   Ext.P2   judgment   has<\/p>\n<p>already expired and still the payments due to the petitioners have<\/p>\n<p>not been made.   In Ext.P6 Government letter dated 26.6.2006, it<\/p>\n<p>is stated that &#8220;The question of payment of the balance amount, if<\/p>\n<p>any   due   to   them   (petitioners)   will   be   considered   on   getting<\/p>\n<p>recommendation from the Vigilance Department on completion of<\/p>\n<p>investigation.&#8221;     There   is   no   current   instruction   as   to   what   is   the<\/p>\n<p>stage of vigilance enquiry.   In the above circumstances, the writ<\/p>\n<p>petition is disposed of as follows :-\n<\/p>\n<\/p>\n<p>              There will be  a direction to the Vigilance Department,<\/p>\n<p>since   the   time   fixed   in   Ext.P2   judgment   has   already   expired,   to<\/p>\n<p>furnish the report to the Government within a period of one month<\/p>\n<p><span class=\"hidden_text\">WP NO.25765\/06                           2<\/span><\/p>\n<p>from   the   date   of   production   of   a   copy   of   the   judgment   by   the<\/p>\n<p>petitioners   before   the   6th  respondent.
