Justice K.M.JOSEPH\n\n Dated :15\/02\/2008\n\n O R D E R\n                             H.L.Dattu, C.J. &amp;  K.M.Joseph, J.\n\n                            ------------------------------------------------\n\n                              W.P.(C).No.8431 of 2007-S\n\n                            ------------------------------------------------\n\n                         Dated, this the 15th  day of February, 2008\n\n\n                                           JUDGMENT\n<\/pre>\n<p>H.L.Dattu,C.J.\n<\/p>\n<\/p>\n<p>                Sri.Jijo   Paul,   learned  counsel  appearing   for   the   petitioner   submits<\/p>\n<p>that, for the present he would not seek the relief made in prayer No.3 in the writ<\/p>\n<p>petition before us, since he has already filed appropriate civil proceedings before<\/p>\n<p>an appropriate civil forum. Therefore, we are not considering prayer No.3.<\/p>\n<p>                (2)  The other two prayers are as under:\n<\/p>\n<\/p>\n<p>                (i)   Issue a writ of mandamus or any other appropriate writs,<\/p>\n<p>       orders of directions directing the first respondent to issue necessary<\/p>\n<p>       guidelines   in   such   a   manner   as   to   co-ordinate,   control,   supervise<\/p>\n<p>       and regulate the trenching of roads and road margins.<\/p>\n<p>                (ii)       Issue   a   writ   of   mandamus   or   any   other   appropriate<\/p>\n<p>       writs,   orders   of   directions   directing   the   first   respondent   to   set   up<\/p>\n<p>       and keep in place appropriate supervisory and controlling bodies to<\/p>\n<p>       regulate and supervise the trenching of roads and road margins&#8221;.<\/p>\n<p>                (3)     The 5th  respondent  has filed  a counter affidavit  before  us. In<\/p>\n<p>paragraph 9 of the counter affidavit, it is stated as under:<\/p>\n<blockquote><p>                &#8220;9.       The 2nd respondent as the Chairperson of the District<\/p>\n<p>       Co-ordination committee has also issued directions to the agencies<\/p>\n<p>       to carry out excavation of trenches in a systematic manner only in<\/p>\n<p>       short   lengths   of   200   meters   at   a   time.   The   cable   trenches   were<\/p>\n<p>       directed   to   be   covered   immediately   and   cutting   of   adjacent<\/p>\n<p>       stretches was directed to be done only after removing excess earth<\/p>\n<p>       on  the   sides   of   trenches.   Instructions   were   given   to   install   proper<\/p>\n<p>       signals   and   precautionary   ribbons   and   posts   on   the   sides   of   the<\/p>\n<p>       roads before commencing the trenching  work. It was also decided<\/p>\n<p>       to  enforce   the  conditions   of   PWD  for  trenching  works   without   fail;<\/p>\n<p>       which conditions among others comprise the following:-<\/p>\n<\/blockquote>\n<blockquote><p>                a)        trenching   shall   be   done   with   proper   sharing   and<\/p>\n<p>       shuttering   so   that   safety   of   adjacent   structures   and   carriage   way<\/p>\n<p>       shall not be affected to any extent;\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                b)        proper   fencing,   lighting   and   watching   shall   be<\/p>\n<p>       ensured for the trenching work undertaken;\n<\/p><\/blockquote>\n<blockquote><p>\n<span class=\"hidden_text\">W.P.(C).No.8431 of 2007-S                            &#8211; 2 &#8211;<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                   c)      necessary   boards   of   caution   should   erected   on<\/p>\n<p>         salient and obligatory points of the trenching alignment;<\/p>\n<\/blockquote>\n<blockquote><p>                   d)      trenching   shall   not   be   commenced,   carried   out   or<\/p>\n<p>         continued during the period of monsoon;\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                   (e)     the earth  cut  and removed shall not be  dumped on<\/p>\n<p>         the road side of the trench, and it shall be deposited on the other<\/p>\n<p>         side or away from the road margin&#8221;.<\/p><\/blockquote>\n<p>                   (4)     After   going   through   the   counter   affidavit   filed   by   the   5th<\/p>\n<p>respondent, in our opinion, for the present except placing on record paragraph 9<\/p>\n<p>of the counter affidavit of the 5th  respondent, no other relief need be granted to<\/p>\n<p>the petitioner.\n<\/p>\n<\/p>\n<p>                   (5)  Accordingly, we pass the following:-\n<\/p>\n<\/p>\n<p>                                               Order<\/p>\n<p>         (i)  Prayer No.3 is rejected for the present, as not pressed.<\/p>\n<p>          (ii)   In view of what has been stated by the 5th respondent in paragraph 9<\/p>\n<p>of the counter affidavit, the other reliefs need not be considered by us.<\/p>\n<p>                   Ordered accordingly.<\/p>\n<pre>\n\n\n\n\n\n                                                                       H.L.Dattu\n\n                                                                   Chief Justice\n\n\n\n\n\n\n\n                                                                     K.M.Joseph\n\nvku\/-                                                                     Judge\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Shiji vs The State Of Kerala on 15 February, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 8431 of 2007(S) 1.
