The Officer-On-Special Duty Bihar Public Service Commission, Jawahar Lal\nNehru Marg, Patna.......................................................................Respondents\n                                    -----------\n<\/pre>\n<p>02\/   1st August 2011              Heard the parties.<\/p>\n<p>                                   Challenge in this appeal is order dated<\/p>\n<p>                        30.08.2010 passed in CWJC No. 3139\/2004 where-<\/p>\n<p>                        under the learned single Judge dismissed the writ<\/p>\n<p>                        preferred by appellant\/petitioner on the sole ground<\/p>\n<p>                        that the list prepared by BPSC has lost its validity on<\/p>\n<p>                        account of efflux of time.\n<\/p>\n<p>                                   After    going    through   the    judgment<\/p>\n<p>                        impugned, this Court finds that it is no-where pleaded<\/p>\n<p>                        on behalf of respondents\/State as well as BPSC that<\/p>\n<p>                        the list was effective for a particular period which has<\/p>\n<p>                        already expired and on account thereof it has lost its<\/p>\n<p>                        authenticity. The simple question involved happens to<\/p>\n<p>                        be with regard to consideration of appellant&#8217;s name<\/p>\n<p>                        against the vacancies which continued on account of<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>         non joining of the other incumbents whose names<\/p>\n<p>         were recommended by the BPSC.
