Heard the counsel for the petitioners.<\/p>\n
2. This is Landlord’s revision  tiieil 0 <\/p>\n
of the Decree dated 30.7.2009 passed
\nThe petitioners herein are  it;\n<\/p>\n
which was \ufb01led by the resgefxaexrg  refund of
\nsum of Rs.6,020\/~\u00ab being  paid by the<\/p>\n
respondent riereirr “while taking on lease the
\npremises, whiclriiis ” agt..’i’Market Road, Chikkamagalur
\nbeazirlg  t&s’ses_sment N0.62()4 \/ 1808\/ 2 hereinafter<\/p>\n
referred” to as.1eassed’preII1ises.<\/p>\n
3. A   leading to this Revision Petition are that<\/p>\n
C it “the-re’sp0nde11t:’ herein had taken the aforesaid premises on a<\/p>\n
 of Rs.660\/\u00ab~ from the petitioners herein in June<\/p>\n
M<\/p>\n
1997. Subsequently, on 31.7.1999 the tenancy was<\/p>\n
terminated and suit in O.S.No. 322\/99 was \ufb02ied <\/p>\n
petitioners against the respondent which  .<\/p>\n
dismissed in View of the provisions of Section  9″<\/p>\n
Control Act coming into force. Subseq1i’en_t7}y,” ‘evicttionii<\/p>\n
in HRC No.11\/2002 was fied. rm;-iing the,_pendene_y”‘~of”the = ”<\/p>\n
said eviction petition, the  respondent ihereirii’ va.eated the<\/p>\n
property in August 2005   possession<\/p>\n
of the same to petition ers.\n<\/p>\n
4. Thereaftel} differences between the
\nparties herein a_ appointed to ascertain the
\ncondition of    thereafter the key of the
\npren1isesp,.f\u00a7\u00a7rase.   the court. Subsequently, the<\/p>\n
respondenthierein \ufb01led SC.No.96\/2006 seeking refund<\/p>\n
 of was paid by the respondent\/ tenant to<\/p>\n
Vfthe’ petitioners’\/Ihand lord while taking the premises on lease. it<\/p>\n
  case of respondent herein that on vacating the leased<\/p>\n

premises he was entitled to receive a sum of Rs.6020\/–after<\/p>\n
deducting Rs.1,980\/- towards arrears of rent from ouvtylofjlthe<\/p>\n
rent advance of Rs.8,000\/~. Since the petitioners   .<\/p>\n
the said anlount, respondent herein \ufb01ied..a_suit’ ‘for”recoveify of 0″‘<\/p>\n
said sum along with interest at the of 11%’?\/9″‘  <\/p>\n
20.8.2005. Accordingly, as on ~..date'”  petitioriers * 0′<\/p>\n
herein were liable to pay to respon.der1’t..pAin la’ tc-.ta.,1:\u00a7 sum of
\nRs.7,400\/–. In the said proceedir;gs\u00bbl::’ herein who
\nwere defendants enteired  \/the claim of
\nrespondent, set   thongh the initial rent
\nwas Rs.660~\/”–;”  nfiderstandirig between the
\nparties thatxjif\ufb02l  in possession of leased
\npremises   3 years he has to pay 15%
\n  tac\u00e9oraingiy, respondent is in arrears of<\/p>\n
enhar\ufb01-ed” rer’1t.,La4fter”adjusting the advance amount lying with<\/p>\n
:”them  responderit himself will have to pay a sum of<\/p>\n
Q vtowards arrears of enhanced rent for which they<\/p>\n
“””\\}<\/p>\n
will be initiating necessary proceedings for recovery of the<\/p>\n
said amount.\n<\/p>\n
5. Thereafter, the suit was proceeded;-._ evj;denc’e–..: V’ <\/p>\n
recorded. after hearing the parties  on  <\/p>\n
pleadings and evidence on record,,the trialddcourtyhas ‘come to <\/p>\n
the conclusion that the respondent provded\ufb01d  of
\nrent deposit of Rs.8,000\/–    of rent
\nof Rs.1,980\/” for 3 of the sarne
\nrespondent herein \/_ along
\nwith the    the court also held
\nthat the  failed to establish the rent
\nagreed to be  by the  more than Rs.660\/~ and
\nthat the V,._\u00a7respondent..V_dlfiirnseli is in arrears of a sum of<\/p>\n
Rs’.~._1_ ‘Court further held that even assuming that<\/p>\n
  suchd’an:”an1o\ufb01n_t\u00bb–isarrears as stated by the petitioners, till<\/p>\n

.1 said.’~s1\u00a71m—.._.’ Therefore, there is no merit in the contention of<\/p>\n

the petitioners herein that. the respondent himself is liable to<\/p>\n
pay a sum of Rs.11,620\/– and that respondent is not <\/p>\n
to refund of Rs.6,020\/– which is due to  .<\/p>\n
petitioners herein. Accordingiy, suit of_th.e__respon(ient dherein. id”<\/p>\n
is decreed. The petitioner herein has chai1enge_d  <\/p>\n
decree in this revision.\n<\/p>\n

    per the final order for the following reasons:<\/p>\n

7. The relationship of tenant and iandiord between<\/p>\n
respondent. and petitioners is admitted. The fact: that the<\/p>\n
initial rent: for leased premises is Rs.660\/–\u00bb and payrt1.eln.tT~:)f<\/p>\n
Rs.8OO0\/W as rent advance by respondent to  .<\/p>\n
admitted. The only point in dispute is,__yWhether”there.y\ufb01as’  K ”<\/p>\n
agreement. for enhancement of rent  v'{r_he’t.her_ <\/p>\n
has failed to pay the said enhance_d”~rent’, At’:oV_petttioners;… The * it<\/p>\n
fact that there is no document. s1ich..yag:5eement
\nbetween the parties for enhanc’en;eri\u00bbt::’ failure on<\/p>\n
the part of petit’,ionersLhereignltol_s?ub:stantiate.’ the same either<\/p>\n
though oral  establishes that
\nthe said pleaby   an excuse to deny refund
\nof advance   them. The trial Court has
\n   in the light of the fact that till<\/p>\n
disp’osa3_oi’– A~st1_jit nosnit was \ufb01ied by petitioners for<\/p>\n
7,:'”recovery -of st1chl’4j’.e::nhanced rent and not even a notice was<\/p>\n
‘  the same. Hence, the trial Court has rightiy<\/p>\n
 _'”rej’ec’t.ed’  piea of petitioners herein and decreed the suit of<\/p>\n

respondent. It is seen that there is no irregularity <33: infirmity<\/p>\n
in the order passed by the Trial Court which requires.<\/p>\n
revised in this Revision Petition and petit'1oners_-5ha4v'e7 .<\/p>\n
made out any ground to set aside ~.\u00bb.the 9ifei1"":re.a'soned~s.V_ ti"<\/p>\n
judgement passed by the Court of  "\n<\/p>\n
