The<br \/>\n\treinstatement was not granted in view of the fact that the workman<br \/>\n\tattained age of superannuation in the meanwhile and during pendency<br \/>\n\tof the reference. It was the case of the workman before the Labour<br \/>\n\tcourt that he was serving in the Corporation as permanent employee<br \/>\n\tsince last 28 years and he came to be arrested in respect of a<br \/>\n\tcomplaint filed by one person being FIR No. I-123\/1996 on 5\/9\/1996.<br \/>\n\tSessions Case was registered and in the trial ultimately he was<br \/>\n\tacquitted. The workman came to be charge sheeted on 21\/5\/1997  for<br \/>\n\tabsenteeism for the period from 1\/6\/1996 to 5\/6\/1996,  and the<br \/>\n\tdeparmental inquiry was conducted. The workman cooperated in the<br \/>\n\tinquiry. The inquiry officer found him not guilty and completely<br \/>\n\texonerated  him from the charge levelled  against him. The report<br \/>\n\twas submitted on 26\/11\/1998. The employee came to be served with<br \/>\n\tshow cause notice for punishment of degrading him one step down. The<br \/>\n\tworkman replied to the show cause notice on 6\/10\/2000 and ultimately<br \/>\n\tthough the notice for degrading was issued, order of dismissal came<br \/>\n\tto be passed on 20\/1\/2001.The dismissal order was ex facie bad and<br \/>\n\tuntenable and therefore Industrial Dispute was raised which came to<br \/>\n\tbe referred to the authority for adjudication,which came to be<br \/>\n\tnumbered as   Reference No. (LCB) 724\/2001. The Labour Court has<br \/>\n\theld that the order of dismissal  was completely illegal and<br \/>\n\ttherefore granted 50% back wages with continuity of service and as<br \/>\n\tthe workman had attained age of superannuation in the meanwhile did<br \/>\n\tnot grant reinstatement.\n<\/p>\n<p>Shri<br \/>\n\tPandya, learned counsel for the petitioner could attempt to assail<br \/>\n\tthe award on the count that the employee was involved in an offence<br \/>\n\twhich amounts to moral turpitude but he could not stretch this<br \/>\n\tmatter any further. Against this it deserves to be noted that the<br \/>\n\torder  of the show cause notice was issued after the findings<br \/>\n\trecorded by the inquiry authority with regard to exonerating the<br \/>\n\tworkman.\n<\/p>\n<p>Shri<br \/>\n\tBrahmbhatt, learned counsel for the respondent workman  vehemently<br \/>\n\tcontended that the show cause notice itself was  bereft of any<br \/>\n\tmerits as it did not contain any reason for disagreeing  with the<br \/>\n\tinquiry officer&#8217;s report. Moreover the show cause notice was issued<br \/>\n\tfor degrading the workman whereas order of dismissal came to be<br \/>\n\tpassed in colourable exercise of power by the Commissioner and<br \/>\n\ttherefore the order impugned before the Labour Court was rightly<br \/>\n\tquashed and set aside.\n<\/p>\n<p>This<br \/>\n\tCourt has heard learned counsels for the parties. The fact remains<br \/>\n\tto be noted that the inquiry officer once records exoneration then,<br \/>\n\tif the disciplinary authority is disagreeing with the findings<br \/>\n\tthereof, will have to issue notice recording his reasons for his<br \/>\n\tdisagreement which has to be communicated to the concerned employee.<br \/>\n\tIn this case admittedly same procedure has not been followed. This<br \/>\n\tCourt relying upon the decision of the Apex Court held in case of DL<br \/>\n\tSHARMA Vs. D.S. SHUKLA, And Or His Successor in Office &amp; Anr,<br \/>\n\treported in 2008 (1) G.L.H. 310, that such an exercise is absolutely<br \/>\n\tessential on the part of the disciplinary authority. In view of<br \/>\n\tthis, the award impugned in this petition  does not deserve to be<br \/>\n\tinterfered with. The petition, therefore, requires to be dismissed<br \/>\n\tand is accordingly dismissed. Notice discharged.
