Mr.M.I.Sherkhan, Advocate. \n^M\/s Sunil Sethi, Sr. Advocate with Veenu Gupta, Advocate and Gagan Basotra,AAG.   \n\nHonble Mr. Justice J.P.Singh, Judge.\nDate: 29.12.2010 \n:J U D G M E N T :\n<\/pre>\n<p>Government of Jammu and Kashmir in the Home<br \/>\nDepartment accorded sanction to the placement of<br \/>\nEleven Inspectors of General Executive Cadre as I\/C<br \/>\nDeputy Superintendent of Police, in their own pay and<br \/>\ngrade with Charge Allowance, as admissible under<br \/>\n<span class=\"hidden_text\">2<\/span><br \/>\nrules, for a period of six months or till such time, the<br \/>\nposts were filled up on regular basis on the<br \/>\nrecommendations of DPC\/PSC whichever was earlier<br \/>\nvide Government Order No. Home-123(P) of 2010 dated<br \/>\n04.02.2010.\n<\/p>\n<p>Javed Iqbal Naaz, Inspector of Police, figured at<br \/>\nSerial No.11 of the List of the Officers placed as I\/C<br \/>\nDeputy Superintendent of Police indicating him to have<br \/>\nbeen adjusted against the post reserved for persons<br \/>\nbelonging to the Reserved category of persons residing<br \/>\nin the area adjoining Actual Line of Control, ALC, for<br \/>\nshort.\n<\/p>\n<p>Aggrieved by the placement of Javed Iqbal as I\/C<br \/>\nDeputy Superintendent of Police, Manzoor Hussain<br \/>\nand Ahjaz Ahmad, Inspectors of Police, approached<br \/>\nthis Court by their Writ Petitions SWP Nos. 206 and<br \/>\n203 of 2010 respectively seeking quashing of the<br \/>\nGovernment Order, in so far as it adjusted Javed Iqbal<br \/>\nagainst the post reserved for candidates belong to ALC<br \/>\ncategory, besides a Command to the respondents to<br \/>\npromote them as I\/C Deputy Superintendent of Police<br \/>\nunder ALC category.\n<\/p>\n<p>Vide Orders dated 10.02.2010 passed in their Writ<br \/>\nPetitions, Government Order No. Home-123(P) of 2010<br \/>\ndated 04.02.2010 was kept in abeyance.<br \/>\nJaved Iqbal too approached this Court by his Writ<br \/>\nPetition SWP No. 532\/2010 seeking directions against<br \/>\nthe State-respondents not to disturb his status as I\/C<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\nDeputy Superintendent of Police ordered vide<br \/>\nGovernment Order of 04.02.2010.\n<\/p>\n<p>Vide interim order dated 15.03.2010 passed in his<br \/>\nWrit Petition, the State-respondents were directed to<br \/>\nmaintain status quo with respect to his status.<br \/>\nManzoor Hussain, writ petitioner in SWP No.<br \/>\n206\/2010, has filed CMP No. 1483\/2010 for his<br \/>\nimpleadment as party respondent to Javed Iqbals Writ<br \/>\nPetition.\n<\/p>\n<p>Manzoor Hussains case in his Writ Petition<br \/>\nagainst the adjustment of Javed Iqbal as I\/C Deputy<br \/>\nSuperintendent of Police, in short, is that being junior<br \/>\nto him, as indicated in the Combined Seniority List of<br \/>\nInspectors of Jammu and Kashmir Police, Javed Iqbal<br \/>\ncould not be adjusted as such ignoring his superior<br \/>\nclaim on the basis of seniority and belonging to the<br \/>\nReserved category of ALC.\n<\/p>\n<p>Ahjaz Ahmads grievance against the adjustment<br \/>\nof Javed Iqbal too is on the similar lines.<br \/>\nProjecting his entitlement to adjustment as I\/C<br \/>\nDeputy Superintendent of Police, Zaffar Iqbalrespondent<br \/>\nNo.4 in SWP No. 532\/2010 contests Javed<br \/>\nIqbals entitlement to adjustment as I\/C Deputy<br \/>\nSuperintendent of Police urging that having entered<br \/>\nthe Police Department as Sub-Inspector of Police and<br \/>\nearned promotion as Inspector, taking benefit of the<br \/>\nReserved category of Scheduled Tribe, Javed Iqbal was<br \/>\nnot entitled to promotion as I\/C Deputy<br \/>\nSuperintendent of Police taking benefit of the Reserved<br \/>\n<span class=\"hidden_text\">4<\/span><br \/>\ncategory of ALC because such a course was<br \/>\nimpermissible in view of the provisions of the Jammu<br \/>\nand Kashmir Reservation Act, 2004. Certificate<br \/>\nobtained by Javed Iqbal indicating him a candidate<br \/>\nbelonging to the Reserved category of ALC too has been<br \/>\ndisputed.\n<\/p>\n<p>State Governments Response to Ahjaz Ahmad<br \/>\nand Javed Iqbals Writ Petitions reveals that Manzoor<br \/>\nHussain and Ahjaz Ahmad figure at Serial Nos. 536<br \/>\nand 663 respectively of the Seniority List of Inspectors<br \/>\nissued by Police Headquarters vide Order No. 1980 of<br \/>\n2004 dated 06.07.2004 whereas Javed Iqbal would<br \/>\nfigure at Serial No. 726 of the Seniority List.<br \/>\nOn examining the Representations of some of the<br \/>\nInspectors of Police including Zaffar Iqbal, the Staterespondents<br \/>\nare stated to have found the adjustment<br \/>\nof Javed Iqbal as I\/C Deputy Superintendent of Police,<br \/>\nbad in law, because having entered the State service<br \/>\ntaking benefit of the Reserved category of Scheduled<br \/>\nTribe, he was not entitled to adjustment as I\/C Deputy<br \/>\nSuperintendent of Police against another Reserved<br \/>\ncategory of ALC, because shifting from one Reserved<br \/>\ncategory to another, was not countenanced by law.<br \/>\nThe State-respondents have taken this decision<br \/>\npursuant to the clarification received from the General<br \/>\nAdministration Department of the State Government in<br \/>\nthis behalf.\n<\/p>\n<p>According to the State-respondents, the error<br \/>\nnoticed in the adjustment of Javed Iqbal as I\/C Deputy<br \/>\n<span class=\"hidden_text\">5<\/span><br \/>\nSuperintendent of Police could not be corrected<br \/>\nbecause of the continuance of the interim order in his<br \/>\nWrit Petition SWP No. 532\/2010.\n<\/p>\n<p>To deal with the issue that arises for<br \/>\nconsideration in these Petitions, as to whether or not<br \/>\nJaved Iqbals adjustment as I\/C Deputy<br \/>\nSuperintendent of Police against the Reserved category<br \/>\nof ALC was permissible, all these Petitions, were heard<br \/>\ntogether, with the consent of learned counsel for the<br \/>\nparties.\n<\/p>\n<p>Appearing for Javed Iqbal, Mr. A.V. Gupta,<br \/>\nlearned Senior Counsel, submitted that reservation of<br \/>\nALC, having become available to the petitioner for the<br \/>\nfirst time in the year 2005 in terms of SRO 294 of<br \/>\n2005, the petitioner was entitled to make choice for<br \/>\ntaking benefit of one of the two reservations to which<br \/>\nhe belonged i.e. one belonging to the Scheduled Tribe<br \/>\nand the other to the Socially and Educationally<br \/>\nBackward Class-ALC. Reliance is placed on Section 19<br \/>\nof the Jammu and Kashmir Reservation Act, to support<br \/>\nthe submission.\n<\/p>\n<p>Mr. Sunil Sethi, learned Senior Counsel,<br \/>\nappearing for Zaffar Iqbal-respondent No.4 in Javed<br \/>\nIqbals Writ Petition, on the other hand, submitted that<br \/>\nhaving taken benefit of the reservation under the<br \/>\nScheduled Tribe Category at the time of his<br \/>\nappointment as Sub-Inspector of Police and promotion<br \/>\nas Inspector of Police, the petitioner was not entitled to<br \/>\nshift to the category of ALC because shifting from one<br \/>\n<span class=\"hidden_text\">6<\/span><br \/>\nReserved category to another was not contemplated by<br \/>\nthe provisions of Section 19 of the Jammu and<br \/>\nKashmir Reservation Act.\n<\/p>\n<p>Supporting the view projected by Mr. Sethi, Mr.<br \/>\nGagan Basotra, learned Additional Advocate General,<br \/>\nsubmitted that Section 19 of the Reservation Act may<br \/>\nnot permit an employee belonging to one Reserved<br \/>\ncategory to shift to another Reserved category, at his<br \/>\noption looking to the chances of promotion in a<br \/>\nparticular category, because the Reservation Act<br \/>\ncontemplates benefit of employment and promotions<br \/>\nonly against one category, of course with choice to the<br \/>\nemployee to opt for one of the Categories in case of his<br \/>\nbelonging to more than one Reserved categories.<br \/>\nConsidered the submissions of learned counsel for<br \/>\nthe parties and perused the provisions of the Jammu<br \/>\nand Kashmir Reservation Act, 2004, hereinafter to be<br \/>\nreferred as the Act.\n<\/p>\n<p>To address the issue canvassed at the Bar, regard<br \/>\nneeds to be had to the provisions of the Act and<br \/>\nparticularly to Section 19 thereof, which for facility of<br \/>\nreference, is reproduced hereunder:-<br \/>\nSection 19-Choice<br \/>\nA candidate belonging to more than one<br \/>\ncategory shall be entitled to claim the benefit of<br \/>\nreservation in one category only, as per his<br \/>\nchoice, for appointment or promotion in<br \/>\nGovernment Service or admission in<br \/>\nprofessional institutions, as the case may be.<br \/>\nPerusal of the Scheme of Reservation<br \/>\ncontemplated by various provisions of the Act indicates<br \/>\nthat shifting from one Reserved category to another, in<br \/>\n<span class=\"hidden_text\">7<\/span><br \/>\nappointment, by Direct Recruitment, and Promotion, in<br \/>\nGovernment Service, besides Entry into Professional<br \/>\nInstitutions, was not contemplated by the legislature.<br \/>\nSection 19, when read, in the light of the Scheme<br \/>\ncontemplated by the Act, demonstrates that choice<br \/>\navailable to a candidate to opt for only one of the two<br \/>\nor more reservations available to him, does not create<br \/>\nany additional privilege in the candidate belonging to<br \/>\nthe Reserved categories to shift from one to the other<br \/>\ncategory while in Government Service. The expression<br \/>\nfor appointment or promotion in Government Service,<br \/>\nwhich appears as a separate Clause in Section 19,<br \/>\nclearly suggests that the legislature had intended<br \/>\nallowing option to a candidate seeking entry into<br \/>\nGovernment Service, to make choice for claiming<br \/>\nreservation in appointment and promotion(s) and also<br \/>\nto one or the other Reserved category, if he belonged to<br \/>\nmore than one such categories. Option of claiming<br \/>\nreservation to a particular Reserved category, once<br \/>\nexercised, and benefits of appointment and promotion,<br \/>\nas the case may be, obtained thereunder, may not be<br \/>\nwithdrawn, for shifting to another Reserved category<br \/>\nfor further promotional benefits even if the employee<br \/>\nbecame entitled to another reservation subsequent to<br \/>\nhis taking benefit of the earlier opted Reserved<br \/>\ncategory, during his Service. This is additionally so<br \/>\nbecause the intention behind providing reservation is<br \/>\nto encourage and give boost to those, who, because of<br \/>\ntheir suffering from one or the other disability, were<br \/>\n<span class=\"hidden_text\">8<\/span><br \/>\nnot entitled to enjoy the right of equality in seeking<br \/>\nEmployment, Promotion or Entry into Professional<br \/>\nColleges, like others, because of the Caste, Area,<br \/>\nBackwardness or other factors on the basis whereof<br \/>\nthey were allowed reservation in appointment,<br \/>\npromotion and entry to the Professional Colleges, so<br \/>\nthat they were able to enjoy the right of equality,<br \/>\nuntrammeled by the disability from which they<br \/>\nsuffered and which was sought to be alleviated by<br \/>\nproviding reservation. Such boost may not, however,<br \/>\npermit shifting from one Reserved category to another<br \/>\nbecause such a course would amount to conferring<br \/>\nadditional benefit to a person who having already been<br \/>\nbrought at par with others by providing him one<br \/>\nreservation, may not be entitled to another boost,<br \/>\nbecause such a course would be against the provisions<br \/>\nof Articles 14 and 16 of the Constitution of India.<br \/>\nMr. Guptas plea that the use of expression as<br \/>\nper his choice appearing in the Section gives an option<br \/>\nto an employee belonging to more than one Reserved<br \/>\ncategories, to opt for any one or the other categories at<br \/>\nthe time of seeking appointment as also at the time of<br \/>\nseeking promotion, to shift from the opted Reserved<br \/>\ncategory to another, is devoid of any substance<br \/>\nbecause such a course would ascribe to discordant<br \/>\nconstruction of the Section, in that, the emphasis<br \/>\nwhich is intended to be supplied by the legislature by<br \/>\nthe use of word only in the Section to convey that<br \/>\n<span class=\"hidden_text\">9<\/span><br \/>\nbenefit of reservation would be available in one<br \/>\ncategory alone, may not be achieved.\n<\/p>\n<p>Thus considering the phraseology employed in the<br \/>\nSection and the Scheme of the Reservation Act,<br \/>\nproviding for benefit of reservation in one category<br \/>\nalone, it is held, that regardless of a candidates<br \/>\nacquiring the status of belonging to another Reserved<br \/>\ncategory during his service career, he may not be<br \/>\nentitled to claim Service benefits under the newly<br \/>\nacquired Reserved category.\n<\/p>\n<p>The view taken by the State-respondents that a<br \/>\ncandidate belonging to more than one category shall be<br \/>\nentitled to claim benefit of reservation in one category<br \/>\nonly as per his choice and the option so exercised was<br \/>\nfinal, leaving no option to him to shift to another<br \/>\ncategory which appears to him more beneficial is,<br \/>\ntherefore, found in line with the Scheme of the Jammu<br \/>\nand Kashmir Reservation Act, 2004, warranting no<br \/>\ninterference therewith.\n<\/p>\n<p>For all what has been said above, Javed Iqbalpetitioner<br \/>\nin SWP No. 532\/2010, having taken benefit<br \/>\nof the Reserved category of Scheduled Tribe in securing<br \/>\nemployment as Sub-Inspector of Police and promotion<br \/>\nas Inspector of Police, was not entitled to claim<br \/>\npromotion\/adjustment as Deputy Superintendent of<br \/>\nPolice under the Reserved category of ALC.<br \/>\nGovernment Order No. Home-123(P) of 2010 dated<br \/>\n04.02.2010, in so far as it directs the adjustment of<br \/>\n<span class=\"hidden_text\">10<\/span><br \/>\nJaved Iqbal as I\/C Deputy Superintendent of Police<br \/>\nunder ALC category, is, therefore, found illegal.<br \/>\nOn the same analogy, Manzoor Hussain and Ahjaz<br \/>\nAhmad who had got appointment as Sub-Inspector and<br \/>\npromotion as Inspector of Police against the posts<br \/>\nreserved for Scheduled Tribe category, cannot stake<br \/>\nclaim for promotion or adjustment as Deputy<br \/>\nSuperintendent of Police against the Reserved category<br \/>\nof ALC.\n<\/p>\n<p>Resultantly, SWP No. 532\/2010, is found to be<br \/>\nwithout merit, hence dismissed, lifting the interim<br \/>\norder dated 15.03.2010 and SWP Nos. 206 and 203 of<br \/>\n2010 are allowed quashing Government Order No.<br \/>\nHome-123(P) of 2010 dated 04.02.2010, in so far as it<br \/>\npertains to the adjustment of Javed Iqbal-respondent<br \/>\nas I\/C Deputy Superintendent of Police against ALC<br \/>\ncategory.
