The trial court convicted the<\/p>\n<p>petitioner for having committed the offence under Section 411 IPC<\/p>\n<p>and sentenced him to undergo rigorous imprisonment for 6 months<\/p>\n<p>and     fine of Rs.500\/-,      in default thereof, further rigorous<\/p>\n<p>imprisonment for one month.\n<\/p>\n<p><span class=\"hidden_text\"> Crl.Rev.No.2060 of 2009                  -2-<\/span><\/p>\n<p>            At the outset learned counsel for the petitioner contended<\/p>\n<p>that he does not wish to assail the impugned judgments on merit but<\/p>\n<p>only confines his submission to the fact that the petitioner has<\/p>\n<p>undergone more than 2 months out of the total imprisonment of 6<\/p>\n<p>months and that he has been facing the ordeal of criminal proceedings<\/p>\n<p>for the last 6 years. He also contends that the allegations against him<\/p>\n<p>are not so serious as he was alleged to have stolen a television set<\/p>\n<p>belonging to his neighbour which has since been recovered.<\/p>\n<p>            On the other hand, learned counsel for the State contended<\/p>\n<p>that there is no mitigating circumstance in favour of the petitioner so<\/p>\n<p>as to warrant any lenient view.\n<\/p>\n<p>            I have heard the learned counsel for the parties.<\/p>\n<p>            After noticing the fact that the petitioner has undergone<\/p>\n<p>more than 2 months out of the total period of sentence of 6 months<\/p>\n<p>and also the fact that he has faced the agony of criminal proceedings<\/p>\n<p>for 6 long years, I deem it appropriate to reduce the sentence of the<\/p>\n<p>petitioner to that of already undergone and enhance the amount of<\/p>\n<p>fine to Rs.3,000\/-. Ordered accordingly.\n<\/p>\n<p>            The amount of fine shall be deposited before the learned<\/p>\n<p>trial court within three months and failure to do so shall result in<\/p>\n<p>automatic revival of sentence of the petitioner which he shall be liable<\/p>\n<p>to undergo.
