SHAH\n\t\t\n\t\n\n \n\nDate\n: 30\/11\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\napplication under Section 482 of Criminal Procedure Code has been<br \/>\npreferred by the applicant &#8211; original accused to quash the<br \/>\ncomplaint\/FIR being C.R. No.I-99\/2005 registered with Bharuch City<br \/>\n&#8216;A&#8217; Division Police Station, Bharuch as well as the charge-sheet<br \/>\nfiled against the applicant for the offences punishable under<br \/>\nSections 406, 420, 465, 468 read with Section 114 of the Indian Penal<br \/>\nCode.\n<\/p>\n<p>2.\tShri<br \/>\nJoshi, learned advocate appearing on behalf of the applicant has<br \/>\nvehemently submitted that as the applicant has not committed any<br \/>\noffence as alleged and that as the main accused Prakash Parmar is his<br \/>\nneighbour, the amount in question was collected at his<br \/>\nhome\/residence.  It is submitted that even the victims were the<br \/>\nrelatives of the applicant and therefore, the amount was collected at<br \/>\nhis residence.  Therefore, it is requested to quash the impugned<br \/>\ncomplaint\/FIR and the charge-sheet.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Shri Joshi, learned advocate appearing on behalf of the<br \/>\napplicant and considering the charge-sheet and role attributed to the<br \/>\napplicant, it appears that there was a big scam and a total sum of<br \/>\nRs.13,75,000\/- was recovered from various persons who were in need of<br \/>\njob and they were assured that they will be offered job in Railway<br \/>\nDepartment.  It also appears that amount in question was recovered<br \/>\nfrom the respective victims at the residence of the applicant and<br \/>\ntherefore, prima facie, the<br \/>\napplicant can be said to be part of the larger conspiracy.  From the<br \/>\nrole attributed to the applicant and the charge-sheet filed after<br \/>\ninvestigation, there is no question of quashing the complaint\/FIR and<br \/>\nthe charge-sheet without trial.  It is also required to be noted that<br \/>\nas such the other co-accused &#8211; main accused are absconding<br \/>\nsince long though the alleged incident has taken place in the year<br \/>\n2005.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above and for the reasons stated above, no extra-ordinary<br \/>\ncase is made out to quash the impugned complaint\/FIR and the<br \/>\ncharge-sheet.
