SHAH\n\t\t\n\t\n\n \n\nDate\n: 30\/09\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Ms.S.D.Rami, learned advocate waives service of notice of Rule on<br \/>\nbehalf of the respondent.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard the learned advocate appearing on behalf of the respective<br \/>\nparties and in the facts and circumstances of the case, the present<br \/>\napplication is taken up for final hearing today.\n<\/p>\n<p>3.\t\tThe<br \/>\npresent application has been preferred by the applicant herein &#8211;<br \/>\noriginal defendant to restore the main First Appeal No.66 of 2011<br \/>\nalong with Civil Application No.272 of 2011, which came to be<br \/>\ndismissed by this Court for non-prosecution vide order dated<br \/>\n20\/01\/2011.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard learned advocate appearing on behalf of the respective parties<br \/>\nand as the application is not seriously opposed by Ms.Rami, learned<br \/>\nadvocate appearing on behalf of the respondent, the present<br \/>\napplication is allowed and  First Appeal No.66 of 2011 along with<br \/>\nCivil Application No.272 of 2011 are hereby ordered to be restored to<br \/>\nfile. Subsequent development, if any, shall be considered in the<br \/>\naforesaid  First Appeal No.66 of 2011 along with Civil Application<br \/>\nNo.272 of 2011 in accordance with law and on merits.
