The respondent herein was the writ petitioner.<\/p>\n<p>     2.    The brief facts of the case are the following:<\/p>\n<p>     The respondent\/writ petitioner was a Class IV employee<\/p>\n<p>under the 1st appellant, Food Corporation of India.       Next<\/p>\n<p>promotion post of Class IV employees is Assistant Grade-III.<\/p>\n<p>There is a quota of 1:4 between promotion and direct<\/p>\n<p>recruitment for filling up the vacancies arising in the cadre of<\/p>\n<p>Assistant Grade-III. Between 1978 and 1986, there was a ban<\/p>\n<p>against direct recruitment. But, a few persons were appointed<\/p>\n<p>under the dying-in-harness scheme and sports quota in those<\/p>\n<p>years.   The respondent\/writ petitioner was appointed as<\/p>\n<p>Assistant Grade-III on 26.6.1978. It is common ground that he<\/p>\n<p>was so appointed regularly in the quota available for regular<\/p>\n<p>promotees.      Between 1978 and 1986, 32 persons were<\/p>\n<p>appointed on compassionate ground and in sports quota. One<\/p>\n<p><span class=\"hidden_text\">W.A.No.1987 &amp; 1983\/2007          2<\/span><\/p>\n<p>Mr.Ramakrishna T.S. was appointed on 7.12.1978 and the<\/p>\n<p>next appointee, Smt. Maruthi.K., was appointed on 22.8.1980.<\/p>\n<p>Others were appointed on various dates between 1981 and<\/p>\n<p>1986. When a provisional seniority list of Assistant Grade-III<\/p>\n<p>was published by the appellants, those direct recruits between<\/p>\n<p>1978 and 1986 were placed above the respondent\/writ<\/p>\n<p>petitioner. Feeling aggrieved by his position in the seniority<\/p>\n<p>list, he filed Ext.P4 representation and thereafter, the Writ<\/p>\n<p>Petition was filed seeking appropriate reliefs.<\/p>\n<p>      3.    The official respondents, who are appellants herein,<\/p>\n<p>resisted the reliefs sought contending that seniority of direct<\/p>\n<p>recruits and promotees will have to be determined according<\/p>\n<p>to the rotation of vacancies as between them based on the<\/p>\n<p>respective quota. The relevant rule relied on by them was<\/p>\n<p>Regulation 16(3) of Staff Regulations, 1971 of the Food<\/p>\n<p>Corporation of India. The relevant portion of Regulation 16(3)<\/p>\n<p>reads as follows:\n<\/p>\n<blockquote><p>            &#8220;(3) Relative seniority of direct recruits and<br \/>\n            promotees:\n<\/p><\/blockquote>\n<blockquote><p>                  (i)  The relative seniority of direct<br \/>\n            recruits and promotees will be determined<br \/>\n            according to the rotation of the vacancies as<\/p>\n<p><span class=\"hidden_text\">W.A.No.1987 &amp; 1983\/2007         3<\/span><\/p>\n<p>            between direct recruits and promotees as<br \/>\n            based on the quotas reserved for direct<br \/>\n            recruitment and promotion respectively.&#8221;<\/p><\/blockquote>\n<p>     4.     But the learned Single Judge, after hearing both<\/p>\n<p>sides, allowed the Writ Petition, mainly, placing reliance on<\/p>\n<p>the decisions of the Apex Court in <a href=\"\/doc\/485116\/\">Direct Recruit Class II<\/p>\n<p>Engg.Officers&#8217; Association v. State of Maharashtra<\/a><\/p>\n<p>[AIR 1990 (SC) 1607], N.K.Chauhan v. State of Gujarat<\/p>\n<p>[AIR 1977 (SC) 251] and <a href=\"\/doc\/1910287\/\">Suraj Parkash Gupta v. State of<\/p>\n<p>Jammu &amp; Kashmir<\/a> [AIR 2000 (SC) 2386]. Feeling aggrieved<\/p>\n<p>by the judgment, the Food Corporation of India has filed this<\/p>\n<p>appeal.   The judgment of the learned Single Judge was a<\/p>\n<p>common judgment disposing of a connected writ petition filed<\/p>\n<p>by another promotee on identical ground.             Against the<\/p>\n<p>judgment in O.P.No.1031\/2000, the Corporation has preferred<\/p>\n<p>Writ   Appeal     No.1983\/2007.    There   was     representative<\/p>\n<p>impleadment of affected parties in the Original Petition.<\/p>\n<p>Notice to all were taken out by paper publication.<\/p>\n<p>Notwithstanding that, none of the affected parties have come<\/p>\n<p>forward to challenge the judgment of the learned Single<\/p>\n<p>Judge. Only the official respondents have chosen to file the<\/p>\n<p>appeals.\n<\/p>\n<p><span class=\"hidden_text\">W.A.No.1987 &amp; 1983\/2007        4<\/span><\/p>\n<p>     5.     The learned senior counsel, Sri. O.V.Radhakrishnan,<\/p>\n<p>who appeared for the appellants, submitted that the<\/p>\n<p>interpretation given by the learned Single Judge to the<\/p>\n<p>operation of the Quota and Rota rule will have far reaching<\/p>\n<p>repercussions, as far as the Corporation is concerned. Several<\/p>\n<p>other seniority lists will have to be disturbed and therefore,<\/p>\n<p>even in the absence of any challenge by the party<\/p>\n<p>respondents, the official respondents have chosen to file this<\/p>\n<p>Writ Appeal. The learned senior counsel mainly canvassed<\/p>\n<p>before us the point that there was no breaking down of quota<\/p>\n<p>rule in this case and therefore, the direct recruits appointed<\/p>\n<p>between 1978 and 1986 are entitled to get placement above<\/p>\n<p>the respondents\/writ petitioners, as there was vacancies<\/p>\n<p>available in the direct recruitment quota to accommodate<\/p>\n<p>them. In support of this submission, the learned counsel relied<\/p>\n<p>on the decisions of the Apex Court in <a href=\"\/doc\/853296\/\">Union of India v.<\/p>\n<p>S.D.Gupta<\/a> [1996(8) SCC 14], M.Subba Reddy v. A.P.SRTC<\/p>\n<p>[2004(6) SCC 729] and Aravinder Singh Bains v. State of<\/p>\n<p>Punjab [2006(6) SCC 673]. The special reference was made<\/p>\n<p>to the observation of the majority in     M.Subba Reddy v.<\/p>\n<p>A.P.SRTC (supra) at paragraph 9 of the judgment, wherein it<\/p>\n<p>was observed as follows:\n<\/p>\n<p><span class=\"hidden_text\">W.A.No.1987 &amp; 1983\/2007           5<\/span><\/p>\n<blockquote><p>            &#8220;Where there is inaction on the part of the<br \/>\n            Government or employer or imposed ban on<br \/>\n            direct recruitment in filing up the posts<br \/>\n            meant for direct recruits, it cannot be held<br \/>\n            that the quota has broken down.&#8221;<\/p><\/blockquote>\n<p>      6.    The learned counsel for the respondent\/writ<\/p>\n<p>petitioner, on the other hand, took us through three decisions<\/p>\n<p>relied on by the learned Single Judge. Special reference was<\/p>\n<p>made to the Constitution Bench decision in <a href=\"\/doc\/485116\/\">Direct Recruit<\/p>\n<p>Class    II   Engg.Officers&#8217;       Association     v.   State of<\/p>\n<p>Maharashtra<\/a> (supra).         The learned counsel made special<\/p>\n<p>mention of points E &amp; F at paragraph 44 of the said decision.<\/p>\n<p>The relevant portion reads as follows:\n<\/p>\n<\/p>\n<blockquote><p>            &#8220;(E) Where the quota rule has broken down<br \/>\n            and the appointments are made from one<br \/>\n            source in excess of the quota, but are made<br \/>\n            after following the procedure prescribed by<br \/>\n            the rules for appointment, the appointees<br \/>\n            should not be pushed down below the<br \/>\n            appointees from the other source inducted in<br \/>\n            the service at a later date.\n<\/p><\/blockquote>\n<blockquote><p>            (F)   Where the rules permit the authorities<br \/>\n            to relax the provisions relating to the quota,<br \/>\n            ordinarily a presumption should be raised that<br \/>\n            there was such relaxation when there is a<br \/>\n            deviation from the quota rule.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.A.No.1987 &amp; 1983\/2007           6<\/span><\/p>\n<p>The learned counsel submitted that the above decision of the<\/p>\n<p>Constitution Bench cannot be diluted by the observation in<\/p>\n<p>M.Subba Reddy v. A.P.SRTC (supra). The learned counsel<\/p>\n<p>also brought to our notice a recent decision of the Apex Court<\/p>\n<p>in B.S.Mathoor v. Union of India [AIR 2009(SC) 137]. In<\/p>\n<p>that case, it was observed that if there is delay in making<\/p>\n<p>direct recruitment, the same would show that quota rule has<\/p>\n<p>broken down. Special reference was made to paragraph 24,<\/p>\n<p>wherein it was held as follows:\n<\/p>\n<blockquote><p>            &#8220;24. A perusal of seniority list which is based<br \/>\n            on the principle of Rota Quota would show<br \/>\n            that the Rota Quota remains broken down<br \/>\n            even today. It may be pertinent to mention<br \/>\n            here that steps for appointment of direct<br \/>\n            recruits were actually taken by the High<br \/>\n            Court many years before their appointment<br \/>\n            actually took place but the appointments came<br \/>\n            in place only after considerable delay. Though<br \/>\n            as per law the direct recruits cannot be<br \/>\n            faulted with for the delay caused in their<br \/>\n            appointments, the fact remains that delay in<br \/>\n            appointments     should    not    cause     any<br \/>\n            disadvantage to the incumbents appointed in<br \/>\n            the service. We need not go into all these<br \/>\n            aspects because the fact that has emerged is<br \/>\n            that the appointment of direct recruits and<br \/>\n            promotee officers in the service have not<br \/>\n            taken place simultaneously. This only shows<br \/>\n            that Rota Quota has remained broken down<br \/>\n            right from the inception of service till now.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.A.No.1987 &amp; 1983\/2007           7<\/span><\/p>\n<blockquote><p>            There is absolutely no change in the factual<br \/>\n            position relating to breakdown of Rota Quota<br \/>\n            even after the decision of this Court in O.P.<br \/>\n            Singla and Rudra Kumar Sain&#8217;s cases. There is<br \/>\n            no reason to depart from the said principle<br \/>\n            and take a shelter under the O.M. of DOPT<br \/>\n            dated 3.7.1986 for determining the inter se<br \/>\n            seniority of the officer of DHJS.&#8221;\n<\/p><\/blockquote>\n<p>Therefore, the learned counsel prayed for dismissing the<\/p>\n<p>appeal.\n<\/p>\n<\/p>\n<p>      7.    In this case, it is the admitted position that direct<\/p>\n<p>recruitment did not take place between 1978 and 1986.<\/p>\n<p>Direct recruitment can be done away that only by invoking the<\/p>\n<p>power of the competent authority to relax the rules. So, in<\/p>\n<p>this case, since for eight years there was no direct<\/p>\n<p>recruitment, it was safely concluded that the quota has broken<\/p>\n<p>down and therefore, the learned Single Judge rightly granted<\/p>\n<p>relief to the respondent\/writ petitioner. The observations in<\/p>\n<p>M.Subba Reddy v. A.P.SRTC (supra) cannot dilute the<\/p>\n<p>declaration made by the Constitution Bench in            Direct<\/p>\n<p>Recruit Class II Engg.Officers&#8217; Association&#8217;s case (supra).<\/p>\n<p>Further, we notice that the promotions in M. Subba Reddy&#8217;s<\/p>\n<p>case (supra) were granted on temporary basis in excess of the<\/p>\n<p>quota. In this case, it is common ground, as noticed earlier,<\/p>\n<p><span class=\"hidden_text\">W.A.No.1987 &amp; 1983\/2007          8<\/span><\/p>\n<p>that the respondent\/writ petitioner was appointed regularly in<\/p>\n<p>the quota available for promotees. So, the observations in<\/p>\n<p>M.Subba Reddy v. A.P.SRTC (supra) can not be applied<\/p>\n<p>mechanically. But, we clarify that if anybody was directly<\/p>\n<p>recruited in the year of promotion of the respondent that<\/p>\n<p>direct recruit will be entitled to get seniority over him. In this<\/p>\n<p>case, from the materials on record, we notice that only one<\/p>\n<p>person was directly appointed in 1978 and the next<\/p>\n<p>appointment was two years thereafter in 1980 only.            The<\/p>\n<p>apprehension of the appellants, that this decision of the<\/p>\n<p>learned Single Judge will effect other seniority lists is<\/p>\n<p>unfounded.     In this case, there is a clear case of quota<\/p>\n<p>breaking down, as a result of ban of direct recruitment for<\/p>\n<p>eight years. So, this decision is rendered on the special facts<\/p>\n<p>of this case.\n<\/p>\n<p>      In the result, subject to the above clarification, this Writ<\/p>\n<p>Appeal is dismissed.\n<\/p>\n<p>W.A.No. 1983 OF 2007<\/p>\n<p>      The facts of this case are identical to the facts of<\/p>\n<p>W.A.No.1987\/2007.      In this case, the 1st respondent was<\/p>\n<p><span class=\"hidden_text\">W.A.No.1987 &amp; 1983\/2007        9<\/span><\/p>\n<p>promoted on 8.6.1979. If anybody was directly recruited in<\/p>\n<p>that year, that direct recruitee will get seniority over the 1st<\/p>\n<p>respondent\/writ petitioner.
