Justice KURIAN JOSEPH\n\n Dated :22\/10\/2008\n\n O R D E R\n                        KURIAN JOSEPH, J.\n               ---------------------------------------\n                   W.P.(C) No.18050 OF 2005\n               ---------------------------------------\n          Dated this the 22nd day of October, 2008.\n\n\n                         J U D G M E N T\n<\/pre>\n<p>      Exhibit P3 order passed by the District Collector is under<\/p>\n<p>challenge. The issue pertains to the proceedings initiated by the<\/p>\n<p>District  Collector  in  the matter      of  alleged  unauthorised<\/p>\n<p>transportation of river sand.\n<\/p>\n<p>      2. It is seen that the District Collector has imposed a fine<\/p>\n<p>on the petitioner. In view of the Bench decision of this Court in<\/p>\n<p>Sanjayan vs. Tahsildar (2007(4) KLT 597, the District<\/p>\n<p>Collector cannot impose a fine on the owner of a vehicle, under<\/p>\n<p>the provisions of the Protection of River Banks and Regulation of<\/p>\n<p>Removal of Sand Act, 2001 (Kerala). The District Collector is<\/p>\n<p>authorised only to confiscate the vehicle. The power of imposition<\/p>\n<p>of fine rests only with the court. Of course, the District Collector<\/p>\n<p>is also authorised to compound the offence. But the question of<\/p>\n<p>compounding arises only if the parties are willing to compound<\/p>\n<p>the offence.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.18050\/05                2<\/span><\/p>\n<p>       Accordingly, the impugned order is quashed. There will be<\/p>\n<p>a direction to the District Collector to pass fresh orders in the<\/p>\n<p>matter after affording an opportunity for hearing to the<\/p>\n<p>petitioner, within a period of four months from the date of<\/p>\n<p>receipt\/production of a copy of this judgment.
