Therefore, when the plot of the<br \/>\npetitioner is just on the next wall of the aforesaid commercial<br \/>\nconstruction which is actually used for commercial construction, it<br \/>\nwould be improper on the part of the Society to expect a member to<br \/>\nmake use for residential purpose since no person can comfortably use<br \/>\nfor residential accommodation, if the same is just adjacent to the<br \/>\ncommercial construction already made by the Society.  However, the<br \/>\nfact remains that the commercial construction already made by the<br \/>\nSociety and also made by the petitioner are in contravention to the<br \/>\ncondition imposed for converting the land for Non Agricultural use<br \/>\nsince permission was granted for residential use.  As the matter is<br \/>\nstill pending before the Collector, no final conclusion can be<br \/>\nrecorded on the said aspects, but it prima facie appears that the<br \/>\nSociety is also party to make breach of the condition of Non<br \/>\nAgricultural use as per the Bombay Land Revenue Code and therefore,<br \/>\nsuch ground in  any case may not be available.\n<\/p>\n<p>4.\tThe<br \/>\ncontention was raised on behalf of the petitioner by Mr. Nanavati<br \/>\nthat the respondent has agreed to abide by the bye-laws of the<br \/>\nSociety which are meant for using the plot for residential purpose<br \/>\nand therefore, the respondent cannot back out from the same and the<br \/>\npetitioner would be justified in insisting the implementation<br \/>\nthereon.  However, whether such can be enforced on the face of GDCR<br \/>\npermitting commercial construction on the road, or not is an aspect<br \/>\nwhich deserves to be considered and if yes to what extent.\n<\/p>\n<p>5.\tThe<br \/>\nlearned counsel for the petitioner submitted that the construction is<br \/>\nstill incomplete, whereas on behalf of the respondent, it was<br \/>\nsubmitted that the construction is completed as back in the year<br \/>\n2007.  Under the circumstances, the further construction, if any to<br \/>\nbe made by the respondent may be prohibited now. However, if the<br \/>\nconstruction is already completed when the Society itself is using<br \/>\nthe adjacent plot for commercial purpose, it would not be a case to<br \/>\nprohibit the respondent from making use for commercial purpose of the<br \/>\nconstruction already made.  But at the same time, the transfer of the<br \/>\nproperty, if any made by the respondent may further complicate the<br \/>\nissue and create third party rights and therefore, such deserves to<br \/>\nbe prohibited.\n<\/p>\n<p>6.\tHence,<br \/>\nI am inclined to pass the following order.\n<\/p>\n<p>\tRULE.\n<\/p>\n<p>By interim order, it is directed that there shall be stay against<br \/>\nfurther construction from today i.e. 12th November, 2008.<br \/>\nWith a view to bring on record the position of the construction as<br \/>\nexisting, it would be open to the petitioner to move the learned<br \/>\nNominee for drawing panchnama and such stay would operate qua further<br \/>\nconstruction, if any to be made by the respondent.  However, the<br \/>\naforesaid stay shall not operate as a bar to the respondent in using<br \/>\nthe already constructed premises for commercial purpose by himself in<br \/>\naccordance with law.  The respondent shall not be in a position to<br \/>\ntransfer or alienate the property in question by any manner through<br \/>\ntenant or transfer or alienate the property in any manner.\n<\/p>\n<p>7.\tIt<br \/>\nis also clarified that the present order shall operate qua commercial<br \/>\nconstruction already made or to be made by the respondent and shall<br \/>\nnot be applicable qua any residential construction made or to be made<br \/>\nby the respondent in accordance with law, which even otherwise also<br \/>\nis not the subject matter of the present proceedings.\n<\/p>\n<p>(JAYANT<br \/>\nPATEL, J.)<\/p>\n<p>shekhar\/-\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<blockquote><p>\t\t   Top<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Shree vs Lajvantiben on 12 November, 2008 Author: Jayant Patel,&amp;Nbsp;
