This petition is filed by the wife seeking transfer of<\/p>\n<p>O.P. No.668 of 2010 from Family Court, Kozhikode        to Family<\/p>\n<p>Court, Ernakulam. According to the petitioner she was seduced by<\/p>\n<p>the respondent and compelled to enter into a register marriage.<\/p>\n<p>She happened to do so under threat from the respondent.<\/p>\n<p>Petitioner is a resident of Kozhikode and was working there in a<\/p>\n<p>private company.    On account of threat from the respondent and<\/p>\n<p>others she got a transfer to Ernakulam and is now working in a<\/p>\n<p>private company at Ernakulam and staying in a hostel at<\/p>\n<p>Ernakulam. Respondent filed O.P. No.668 of 2010 in Family Court,<\/p>\n<p>Kozhikode seeking restitution of conjugal rights. Petitioner has<\/p>\n<p>filed O.P No.990 of 2010 in Family Court Ernakulam        seeking<\/p>\n<p>divorce. Petitioner states that there is nobody to accompany her<\/p>\n<p>to go to Kozhikode. She has much difficulty to contest the case at<\/p>\n<p>Kozhikode also considering the distance between her place of<\/p>\n<p>Tr.P(C) No.277 of 2010<br \/>\n<span class=\"hidden_text\">                                     -: 2 :-<\/span><\/p>\n<p>stay\/work and Kozhikode.            In the circumstances petitioner<\/p>\n<p>requested for transfer.\n<\/p>\n<p>      3.    The Supreme Court in Sumitha Singh v. Kumar<\/p>\n<p>Sanjay and Another (AIR 2002 SC 396) and <a href=\"\/doc\/1640831\/\">Arti Rani v.<\/p>\n<p>Dharmendra Kumar Gupta<\/a> ([2008] 9 SCC 353) has stated<\/p>\n<p>that while considering request for transfer of matrimonial<\/p>\n<p>proceedings convenience of the wife has to be looked into. That<\/p>\n<p>of course does not mean that inconvenience if any                 of the<\/p>\n<p>husband has to be ignored. It is not disputed that O.P. No.990 of<\/p>\n<p>2010 filed by petitioner is pending consideration in Family Court,<\/p>\n<p>Ernakulam. That is a petition filed for divorce. Respondent has<\/p>\n<p>not so far requested for transfer of that case to Family Court,<\/p>\n<p>Kozhikode for any reason whatsoever.           It is stated by petitioner<\/p>\n<p>that she finds it difficult to travel all the distance from her place of<\/p>\n<p>stay\/work to Kozhikode to contest the case. In the nature of the<\/p>\n<p>reliefs claimed it is necessary that both the cases are tried and<\/p>\n<p>disposed of by the same court. Having regard to these facts and<\/p>\n<p>considering the comparative hardship of petitioner                 I am<\/p>\n<p>persuaded to think that hardship of the wife if the case is not<\/p>\n<p>transferred   to    Family      Court,    Ernakulam     outweighs     the<\/p>\n<p>inconvenience that may be caused to the husband                if case is<\/p>\n<p>Tr.P(C) No.277 of 2010<br \/>\n<span class=\"hidden_text\">                                  -: 3 :-<\/span><\/p>\n<p>transferred to      Family Court, Ernakulam. Hence I am inclined<\/p>\n<p>to allow the request of petitioner.\n<\/p>\n<p>      Resultantly, the petition is allowed in the following lines:<\/p>\n<p>            (i)    O.P No.668 of 2010    pending in Family<\/p>\n<p>      Court, Kozhikode is withdrawn from that court and<\/p>\n<p>      made over to Family Court, Ernakulam.\n<\/p>\n<\/p>\n<p>            (ii)   The transferor court while transmitting<\/p>\n<p>      records of the case to the transferee court shall fix<\/p>\n<p>      the date for appearance of parties in the transferee<\/p>\n<p>      court with due intimation to the counsel on both<\/p>\n<p>      sides.\n<\/p>\n<\/p>\n<p>            (iii)  Family Court, Ernakulam     shall ensure<\/p>\n<p>      that O.P.No.668 of 2010 (being transferred to it) and<\/p>\n<p>      O.P. No.990 of 2010 pending        in that court are<\/p>\n<p>      posted as far as possible on the same dates.<\/p>\n<pre>\n\nTr.P(C) No.277 of 2010\n<span class=\"hidden_text\">                                -: 4 :-<\/span>\n\n\n           (iv)    It is made clear that    except when\n\n<\/pre>\n<p>     physical presence of the respondent in the transferee<\/p>\n<p>     court is necessary he can appear through counsel.<\/p>\n<p>                                THOMAS P.
